Sec. 48-542. - Purpose and intent.

The R4 Multiple-Family Residential District is intended to develop a wide range of quality housing opportunities throughout the city and to allow for quality multifamily dwelling units within developments that establish and maintain a safe and secure living environment. The R4 Multiple-Family Residential District shall be a high intensity land use, generally relating to other high intensity, moderate intensity, commercial or industrial land uses.

Sec. 48-543. - Permitted uses.

The following uses are permitted in the R4 district:

(1)

Multifamily dwelling units;

(2)

Four-family dwellings;

(3)

Parks;

(4)

Day care homes;

(5)

Group homes (large);

(6)

Manufactured homes;

(7)

Accessory uses as set forth in sections 48-103 through 48-109.

Sec. 48-544. - Conditionally permitted uses.

Conditionally permitted uses in the R4 Multiple-Family Residential District shall include all conditional uses in the R1 district as well as assisted living facilities.

Sec. 48-545. - Lot area.

Lot area requirements for the R4 district shall be:

(1)

Prorated on the basis of one acre which shall have a maximum of 12 units per acre or 24 bedrooms whichever is less;

(2)

All residential uses permitted in this district shall be served by public water, and sanitary and storm sewer systems.

Sec. 48-546. - Lot width.

Lot width requirements for the R4 district shall be:

(1)

Multiple-family dwellings, not less than 100 feet wide at the established building setback line;

(2)

Conditional uses, not less than 140 feet at the established building setback line.

Sec. 48-547. - Building height.

Maximum building height for all uses shall be 45 feet.

Sec. 48-548. - Minimum floor area per dwelling.

Minimum floor area per dwelling in the R4 district shall be not less than 750 square feet per unit, excluding common areas.

Sec. 48-549. - Floor area ratio.

Floor area ratio in the R4 district shall be: Not applicable to residential use; but for all other permitted or conditional uses, the total floor area of all buildings or structures shall not exceed 25 percent of the total area of the zoning lot.

Sec. 48-550. - Yards.

No building shall be erected or enlarged unless the following yards are provided and maintained except as otherwise provided herein:

(1)

Front yard: Not less than 25 feet in depth at the established building setback line;

(2)

Side yards: A side yard on each side of the zoning lot of not less than ten feet except where a side yard adjoins a street, the minimum width shall be not less than 25 feet;

(3)

Rear yard: Not less than 30 feet in depth.

Sec. 48-551. - Spacing between buildings.

When two or more structures which contain multiple-family dwellings, or combinations thereof, are on a lot or on continuous lots comprising a unified development under the same ownership or control, the distance between the exterior walls shall be as follows:

(1)

When the front wall of the structure faces any wall of another structure, the distance between the two structure walls shall not be less than 60 feet;

(2)

When the rear wall of a structure faces the rear wall of the nearest structure, the distance between the two structure walls shall not be less than 50 feet;

(3)

When the side wall of a structure faces the side wall of the nearest structure, the distance between the two structure walls shall not be less than 20 feet, except when the facing side walls of either of such structures contain more than two windows on a floor that are not bathrooms or storage rooms, then the distance between such structures shall not be less than 50 feet, or 60 feet if a main entrance doorway is in such side wall;

(4)

Where structures are not parallel to each other, the required spacing shall be measured at the midpoints of the distance along which they face each other; however, the spacing between the structures at the narrowest point shall in no event be less than one-half the required distance.

Sec. 48-552. - Off-street parking and loading.

Off-street parking and off-street loading shall be in accordance with the regulations set forth in article XXIII of this chapter.
