ARTICLE XIII

- BUSINESS DISTRICTS

Sec. 48-972. - Purpose; intent.

Business district regulations are intended to govern the locations and uses of a full range of business and commercial establishments needed to serve the citizens and its trade area. The regulations of the various business districts are designed to provide for groupings of business and commercial establishments that are compatible in scope of services and method of operations.

Sec. 48-973. - Dwelling units.

Dwelling units and lodging rooms are not permitted in any business district except in a permitted hotel, motel, resort, convent, monastery, parsonage, or rectory; as a conditionally permitted use in the B2 Central Shopping District and the B3 Commercial District; or within a structure existing on the effective date of the ordinance codified in this article.

Sec. 48-974. - Enclosure of operations.

All business, servicing, or processing shall be conducted within completely enclosed buildings except:

(1)

Off-street parking or loading;

(2)

Drive-in type of operations and open sales lots when conducted as a conditionally permitted use in the B2 Central Shopping District and the B3 Commercial District, or as a permitted use in the B3 Commercial District.

Sec. 48-975. - Performance standards.

All activities shall conform with the performance standards established for the M1 Manufacturing District, and in every case shall be applied at the boundaries of the lot on which such activities take place.

Sec. 48-976. - Parking limitations.

(a)

Parking of trucks when accessory to the conduct of a permitted use shall be limited to vehicles having not over 1½ tons capacity, except for pickup or delivery services during normal business hours.

(b)

Trucks in excess of 1½ tons capacity shall not be parked in the open within 150 feet of a residence district boundary line.

Sec. 48-977. - Scope of operations.

All business establishments shall be retail trade or service establishments dealing directly with consumers, and all goods produced on the premises shall be sold on the premises where produced except for specific uses in the B2 Central Shopping District and the B3 Commercial District where processing and fabricating or wholesale sales are permitted.

Sec. 48-978. - Buildings; foundation and covering requirements.

Notwithstanding any other provision herein to the contrary, all buildings built in the B1, B2, B3, and B4 zoning districts shall have continuous concrete foundation from below the frost line to above grade with all sides of the building facing a street covered 100 percent up to the top eave with one or more of the following and at least ten percent of each interior sidewall being covered with one or more of the following: Face brick, approved type masonry, glass, stone, wood, stucco or other siding with similar type materials and appearances as approved by the building and zoning officer.
