The R-1A District (Restricted One-Family and Multi-Family Residential District) is intended and designed to provide for certain low density, high value residential areas of the City to be developed primarily with One-Family Dwellings and Multi-Family Dwellings in areas where similar residential development seems likely to occur.
1. Permitted Uses. Only the use of structures or land listed in this section shall be permitted in the R-1A District.
A. One-family dwellings, condominiums, row dwellings, and multi-family dwellings.
B. Churches, chapels, temples, and similar places of worship.
C. Public and parochial schools, elementary and secondary, and other educational institutions having an established current curriculum, the same as ordinarily given in the public schools.
D. Publicly owned museums, libraries, community centers, governmental offices, parks, playgrounds, golf courses, and recreation areas.
E. Private non-commercial recreational areas and facilities, institutions or community recreation centers, including country clubs and golf courses.
F. Agricultural uses including nurseries and truck gardens, provided that no offensive odors or dusts are created.
2. Permitted Accessory Uses.
A. Uses of land or structures customarily incidental and subordinate to one of the permitted principal uses, unless otherwise excluded.
B. The home office of a physician, dentist, artist, attorney, architect, engineer, teacher, or other member of a recognized profession in their bona fide place of residence provided that: not more than one assistant shall be regularly employed therein and no colleagues or associates shall use such office; not more than one-half the area of one floor shall be used for such office; no advertising sign or display shall be permitted except an indirectly lighted name plate not to exceed two square feet in area, attached flat against the building. It is the intent of this paragraph to include home occupations such as dance studios, music studios, beauty salons, and barber shops as long as all provisions are complied with and the occupations do not create noise, traffic congestion, or other nuisances.
C. Private swimming pools, one enclosed with a non-climbable fence at least six (6) feet in height.
E. Temporary buildings for uses incidental to construction work which buildings shall be removed upon the completion or abandonment of the construction work.
F. Temporary use of a dwelling structure within a new subdivision as a job office and real estate office for the subject subdivision which use shall terminate upon completion or abandonment of the project.
G. Church bulletin boards.
3. Bulk Regulations.
The following minimum requirements shall be observed subject to the modifications contained in Section
165.24 for one-family dwellings:
A. Lot area: Dwellings – 9,000 square feet.
B. Lot width: Dwellings – 75 feet.
C. Front yard: Dwellings – 25 feet.
D. Side yard: Dwellings – 8 feet; street side, corner lots – 25 feet.
E. Rear yards: Dwellings – 30 feet.
F. Maximum height: Dwellings – 35 feet.
G. Other uses: Front – 35 feet; rear – 30 feet; side – 20 feet; street side, corner lot – 35 feet.
H. For Condominiums, Row Dwellings, and Multi-Family Dwellings, those requirements set forth per R-2 District regulations.
4. Building Requirements.
A. All one-family dwellings shall have a minimum of 1,200 square feet of living area excluding basements, breezeways, and garages. The living area at ground level shall have the following minimum square feet:
One story - a minimum of 1,200 square feet;
One and one-half stories – a minimum of 1,000 square feet;
Two stories - a minimum range from 800 to 999 square feet of living area shall be 45 percent of the total living area above ground level. Living area of 1,000 square feet shall be 100 percent of the required minimum ground level living area.
B. All one-family dwellings shall have a two-stall garage with a minimum width of 22 feet and minimum depth of 22 feet.
C. All condominiums, row dwellings, and multi-family dwellings shall have a minimum of 1,000 square feet of living area per unit with not less than two (2) bedrooms.
5. Off-Street Parking and Loading. Spaces for off-street parking and loading shall be provided in accordance with the provisions of 165.22 and 165.23.
