165.17 C-1

DISTRICT REGULATIONS.

The C-l District (Commercial District) is designed to provide space for the general retail and professional office uses and efficient development of major retail shopping areas. The district includes commercial property existing along major streets and highways for the City. The uses permitted are intended to accommodate both the general retail consumer and the needs and services of the automobile traveling public.
   1.   Principal Permitted Uses. Only the use of structures or land listed in this section shall be permitted in the C-l District.
      A.   Publicly owned museums, libraries, community centers, governmental offices, and recreation areas; institutions of a religious, educational, or philanthropic nature; private clubs, lodges, or veterans organizations.
      B.   Retail businesses or service establishments such as the following:
         Animal hospital, veterinary clinic, or kennel, provided that any exercising runway shall be at least 200 feet from any R District.
         Antique shops.
         Apparel shops.
         Art shops.
         Automobile, truck, farm implement, motorcycle, and mobile home sales and repairs. In addition, this paragraph shall not be construed to include automobile, tractor, or machinery wrecking and rebuilding, and used parts yards.
         Baby and children’s stores.
         Bakeries or bakery outlets – retail sales only.
         Banks, savings and loan associations, and similar financial institutions.
         Barber shops and beauty parlors.
         Bicycle shops – sales and repair.
         Book stores.
         Bowling alleys.
         Camera shops.
         Clothes cleaning and laundry pick-up stations.
         Collection office of public utility.
         Swimming pools, skating rinks, miniature golf courses, trampoline centers, and similar recreational uses and facilities.
         Confectionery stores, including ice cream, candy, or snack bars.
         Dairy stores, retail only.
         Delicatessens.
         Drive-in restaurants.
         Drug stores.
         Dry goods stores
         Florist shops and greenhouses.
         Fruit and vegetable markets.
         Funeral homes.
         Furniture stores.
         Gasoline service stations.
         Gift shops.
         Grocery stores, including supermarkets.
         Hardware stores.
         Hotel, motel, or motor lodge.
         Hobby shops.
         Household appliance – sales and repair.
         Jewelry stores and watch repair shops.
         Launderettes, coin-operated dry cleaning establishments.
         Lawn mower repair shops.
         Locker plant for storage and retail sales only.
         Music stores and studios.
         Office buildings.
         Paint and wallpaper stores.
         Photographic studios.
         Plumbing and heating shops.
         Post office substation.
         Printing and lithograph shops.
         Radio and television – sales and repair.
         Real estate office.
         Restaurants, nightclubs, cafes, taverns, or private clubs and lodges.
         Shoe sales and repair shops.
         Sporting goods stores.
         Tailor and dressmaking shops.
         Theatres.
         Toy stores.
         Variety stores.
         Automobile washing establishments.
         Tool, machine, or welding shops.
      C.   Combinations of the above uses.
      D.   Hospitals, medical, and dental clinics.
      E.   The office of a doctor, dentist, osteopath, chiropractor, optometrist, or similar profession.
      F.   Business and professional offices including the following: law, engineering, architecture, real estate, insurance, accounting, bookkeeping, woodshops, and similar uses.
      G.   Commercial communication and transmission towers (conditional use only).
   2.   Permitted Accessory Uses.
      A.   Off street parking and loading areas if it does not constitute a sight hazard.
      B.   Dwelling units, located on the second floor of a two-story building provided that such use be incidental to a principal permitted use and have off-street parking and meet the requirements of the Prairie City Building Code
      C.   Merchandise displayed for sale or rent in any required yard abutting a public street if it does not constitutes a sight hazard.
      D.   Storage Facility as approved by the Board of Adjustment following a public hearing.

   3.   Bulk Regulations. The following minimum requirements shall be observed, subject to the modifications contained in Section 165.24.
      A.   Lot area: No minimum requirement.
      B.   Lot Width: No minimum requirement.
      C.   Front Yard: No minimum requirement except lots fronting on Second Street, which is 25 feet.
      D.   Side Yards: No minimum requirement for any principal uses except when adjoining any R district or street right-of-way, in which case 15 feet.
      E.   Rear Yard: None, provided that when adjacent to any R District, there shall be provided along the rear lot line a screen of sufficient height and opacity to effectively shield such R District property. Screens shall meet the minimum requirements of Section 165.11 of this chapter and shall be approved by the City Council.
      F.   Maximum Height: 50 feet.
   4.   Off-Street Parking and Loading. Spaces for off-street parking and loading shall be provided in accordance with the provisions of Sections 165.22 and 165.23.
