1. No building or other structure shall be erected, moved, added to, or structurally altered without a permit therefor, issued by the Zoning Administrator. No zoning compliance permit shall be issued except in conformity with the provisions of this chapter, except after written order from the Board of Adjustment. Permits shall not be required for accessory buildings which do not exceed 64 square feet, nor shall permits be required for a retaining wall or combination of retaining walls less than two (2) feet in height.
2. If the work described in any permit has not begun within 90 days from the date of issuance thereof, said permit shall expire, it shall be cancelled by the Zoning Administrator, and written notice thereof shall be given to the person affected. If the work described in any building permit has not been substantially completed within two (2) years of the date of issuance thereof, said permit shall expire and be cancelled by the administrative official, and written notice thereof shall be given to the person affected, together with notice that further work as described in the cancelled permit shall not proceed unless and until a new building permit has been obtained.
3. No land shall be occupied or used, and no building hereafter erected or structurally altered shall be occupied or used in whole or in part for any purpose whatsoever, until a zoning compliance permit is issued by the Zoning Administrator, stating that the building and use comply with the provisions of this chapter and the Building and Health Ordinances of the City.
4. No change of use shall be made in any building or part thereof, now or hereafter erected or structurally altered, without a permit being issued therefor by the Zoning Administrator. No permit shall be issued to make a change unless the changes are in conformity with provisions of this chapter.
5. No permit for excavation for or the erection or alteration of any building shall be issued before the application has been made for certificate of compliance, and no building or premises shall be occupied until that certificate of zoning compliance is issued.
6. Certificates for compliance shall be applied for coincidentally with the application for a building permit, and shall be issued within 10 days after the lawful erection or alteration of the building is completed. A record of all zoning compliance permits shall be kept on file in the Office of the Zoning Administrator and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected upon payment of copying costs.
7. A temporary zoning compliance permit may be issued by the Zoning Administrator for a period not to exceed six (6) months during alterations or partial occupancy of a building pending its completion, provided that such temporary certificate may require such conditions and safeguards as will protect the safety of the occupants and public.
8. Failure to obtain an occupancy permit shall be a violation of this chapter and punishable as provided by
165.33 of this chapter.
