The I-1 District (Industrial District) is intended and designed to provide for the location of certain manufacturing and industrial uses of a non-nuisance character in areas near residential and commercial uses, and the location of other industrial uses in areas likely to develop with such uses.
1. Plat Requirement. Each petition for the I-1 zoning classification submitted to the Planning and Zoning Commission shall be accompanied by a plat of the proposed I-1 development. Among other things the plat shall show: (i) all existing and proposed streets, access roads, easements, and other public right-of-way; (ii) the location of existing and proposed utilities; (iii) building lines; and (iv) lot sizes. The development plat shall be considered by the Planning and Zoning Commission and Council in their review of the I-1 Zoning petition. The Council may require the filing and approval of the development plat, in accordance with the requirements of the subdivision ordinance, prior to the final approval of the I-1 Zoning classification. The Council and Commission may consider any deed restrictions or covenants placed upon the lots by the owner.
2. Principal Permitted Uses. Only the use of structures or land listed in this section shall be permitted in the I-1 district, provided, however, that all manufacturing, assembling, compounding, processing, packaging, or other comparable treatment, including storage of any and all materials and equipment, shall take place within completely enclosed buildings if possible, except for parked motor vehicles and off-street parking and loading as required by
165.22 and
165.23, if adjacent to any R district. In addition, all open areas not used for off-street parking or loading shall be landscaped and planted with trees, shrubs, and grass, properly maintained, and kept free from refuse debris.
A. Assembly of small electrical appliances, small industrial and electronic instruments and devices, radios, phonographs, and television sets, including the manufacture of small accessory parts only, such as coils, condensers, transformers, crystal holders, and similar products.
B. Commercial trade schools and business colleges.
C. Compounding and packaging of drugs, pharmaceuticals, cosmetics, perfumes, and toiletries.
D. Manufacturing, assembling, compounding, processing, packaging, and other comparable treatment of the following:
Bakery goods, candy, and food products.
Cameras and other photographic equipment.
Electric and neon signs, outdoor advertising signs.
Medical, dental, and drafting instruments.
Musical instruments, toys, novelties, and rubber and metal hand stamps.
Pottery and other ceramic products using only previously pulverized clay, and kilns fired only by electricity or gas.
Products from the following previously prepared materials: bone, canvas, cellophane, cloth, cork, rope, cord, twine, feathers, felt, fiber, fur, glass, hair, horn, leather, paper, cardboard, plastics, natural and synthetic rubber, precious or semiprecious metals or stones, shells, textiles, tobacco, wax, wood, yarns, light metal mesh, pipe, rods, strips, or wire.
Small precision instruments, such as barometers, clocks, watches, and compasses.
F. Printing, lithographing, or film processing plants.
G. Warehouses for storage of merchandise or material in connection with the uses permitted in this district only.
H. Wholesaling and warehousing but not including the bulk storage of liquid fertilizer or petroleum products under pressure.
I. Farm implement display, sales, service, and repair.
J. Lumber yard and building material sale and storage.
K. Truck and freight terminal.
L. Truck display, sales, repair, and storage.
N. Grain elevator and feed mill.
O. Railroads and public utilities including storage and maintenance yards.
P. Contractor’s storage yard.
3. Permitted Accessory Uses.
A. Accessory use of land or structures customarily incidental and subordinate to any of the above principal uses.
B. Dwelling for watchman or caretaker.
C. Employee cafeteria or other food concession in conjunction with permitted use.
4. Bulk Regulations. The following minimum requirements shall be observed subject to the modifications contained in 165.24.
A. Lot Area: No minimum requirement.
B. Lot Width: No minimum requirement.
D. Side Yards: Two side yards, each 3 feet wide; street side, corner lot – 25 feet.
F. Maximum Height: 60 feet.
5. Conditional Uses In the I-1 District. Uses not otherwise prohibited by law may be permitted in the I-1 District by the Board of Adjustment after public hearing, and after report and recommendations by the Planning and Zoning Commission, provided the conditions and standards set forth in this chapter are met.
A. In its determination as to the appropriateness of any such use at the particular location requested, the Board of Adjustment shall consider the following conditions:
(1) The proposed location, design, construction, and operation of the particular use adequately safeguards the health, safety, and general welfare of persons residing or working in adjoining or surrounding property.
(2) Such use shall not impair an adequate supply of light and air to surrounding property.
(3) Such use shall not unduly increase congestion in the streets or public danger of fire, panic, and flood.
(4) Such use shall not diminish or impair established property values in adjoining or surrounding property.
(5) Such use shall be in accord with the intent, purpose, and spirit of this chapter and the Comprehensive Plan of the City.
B. The following uses shall be permitted as conditional uses:
Slaughter houses or stockyards.
Acid manufacture or wholesale storage of acids.
Salvage yards, including automobile, tractor or machinery wrecking, and used parts sales and junk, iron, rag or waste paper storage, and baling, provided that any wrecking operation is carried on within a building completely enclosed with walls and roof and the yard completely enclosed with a wall or fence, reasonably maintained, at least eight (8) feet high completely obscuring the activity from adjoining or surrounding property and roadways. There shall be only one opening in each wall or fence facing any public street for each 200 feet of length. Further provided, no portion of a front yard shall be used for any of said activities.
Cement, lime, gypsum, or plaster of paris manufacture.
Distillation of bones, coal, refuse, grain, or wood.
Explosives manufacture or storage; including those materials or products such as manganese or fuel oil and similar materials which represent fire hazards.
Garbage, offal, or dead animal reduction or dumping.
Gas manufacture and cylinder recharging.
Glue or gelatin manufacture.
Petroleum or its products, refining or wholesale storage of, and asphalt plants.
Rubber goods manufacture.
Mineral extraction, including sand or gravel pits.
Smelting of tin, copper, zinc, or iron ores.
Wholesale storage of gasoline.
Commercial livestock feed lots or confinement stations.
Commercial communication and transmission towers.
Any other use, which is objectionable by reason of emission of odor, dust, smoke, gas, vibration, or noise, or may impose hazard to health or property.
6. Permitted Accessory Uses. Accessory uses customarily incidental to a permitted principal or conditional use.
7. Required Conditions; Performance Standards; Conditional Uses.
A. The best practical means known for the disposal of refuse matter or water-carried waste, the abatement of obnoxious or offensive odor, dust, smoke, gas, noise, or similar nuisance shall be employed to meet or exceed the standards set forth in
165.25.
B. All principal buildings and all accessory buildings or structures, including loading and unloading facilities, shall be located at least 100 feet from any R District boundary, except where adjoining a railroad right-of-way.
C. The Board of Adjustment may, as a condition for securing necessary permits for building and occupancy, require all operations, including the storage of anything except merchandise displayed for sale, be conducted in a fully enclosed building or entirely behind walls or fences and or off the lot. Planting screens which meet the requirements of Section
165.11 may also be required when any industrial use abuts any R District.
8. Off-Street Parking And Loading
. Spaces for off-street parking and loading shall be provided in accordance with the provisions of Sections
165.22 and
165.23.
