1. Position Created; Duties and Powers. There is hereby created the position of Zoning Administrator, who shall be appointed by the Mayor subject to confirmation by the City Council. The Zoning Administrator shall administer and enforce the provisions of this chapter and shall have the following powers and duties, in connection therewith:
A. The Zoning Administrator shall issue and keep record of all permits and certificates required by this chapter.
B. The Zoning Administrator shall be responsible for and keep up-to-date a book, to be known as the Zoning Orders Book, in which the Zoning Administrator shall list, with a brief description, all variances, conditional use permits, authorizations for planned unit developments, all nonconforming uses and any termination of any of them, mobile home park licenses and permits, and special permits.
C. Each item shall be assigned a number when entered. The Zoning Administrator shall also keep a map of the City, to be known as the Zoning Orders Map, on which the Zoning Administrator shall record the numbers in the Zoning Orders Book to indicate the location of various conditional uses, nonconforming uses, and special permits. The Zoning Orders Book and Map shall be open to public inspection.
D. The Zoning Administrator shall exercise all enforcement powers under Section
165.33 and investigate all complaints of zoning violations. If the Zoning Administrator shall find that the provisions of this chapter are being violated, the Zoning Administrator shall notify in writing the person(s) responsible for such violations, indicating the nature of the violation, and ordering the action necessary to correct it. The Zoning Administrator shall order the discontinuance of illegal use of land, buildings, or structures; removal of illegal buildings, or structures or of additions, alterations, or structural changes thereto; discontinuance of any illegal work being done; or shall take any other action authorized by this chapter to insure compliance with or to prevent violation of its provisions. If any zoning violation(s) shall continue unabated after exhaustion of reasonable administrative remedies toward their abatement, the Zoning Administrator shall prepare and submit reports of said violation(s) to the City Council for such legal action as the facts of each such report may require.
E. In all cases where the City commences court action, the Zoning Administrator shall cooperate with the City Prosecutor by performing such additional investigative work, as the City Prosecutor shall require.
F. The Zoning Administrator shall attend the meetings of the Planning and Zoning Commission and the Zoning Board of Adjustment as requested by those bodies, shall investigate and review all cases presented to the Board, and shall advise that body on those cases upon request.
2. Appointment. The Council may, by resolution passed by a majority vote of the entire Council, delegate the powers and duties of the Office of Zoning Administrator to any other officer or employee or may combine the powers and duties of this office with any other office or position.
