68 - MOBILE HOMES, TRAILER COACHES AND TRAVEL TRAILERS4

17.68.010 - Foundation and removal of axle and wheels—Title purged.

A.

An applicant wishing to establish a new manufactured home, modular home or factory-built home within a residential zone district shall first apply for and obtain a building permit:

1.

The town shall not allow an applicant to place a used or formerly occupied manufactured home, modular home or factory-built home on a residential lot;

2.

The town shall not allow the movement of an existing mobile home, manufactured home, modular home or factory-built home from one residential lot to another.

B.

As a condition of building permit issuance, applicant shall remove all axles and wheels on the residential unit and shall place such residential unit on a full perimeter foundation, designed by an engineer licensed in the state of Colorado and following recommendations from the site-specific soils study:

1.

The applicant shall remove axles and wheels in such a manner as to render the manufactured home, modular home or factory-built home an improvement to real property as a permanent structure;

2.

Prior to the town's issuance of a certificate of occupancy for such new manufactured home, modular home or factory-built home, owner shall purge the title to such home, indicating that it is no longer mobile.

17.68.020 - Common ownership and taxation.

Any owner of a manufactured home, modular home or factory-built home located in the town and occupied or used as a residential unit shall prove to the town that the unit has the same record title ownership as the real property upon which the manufactured home, modular home or factory-built home is located. Such unit shall be taxed as an improvement to the real property.

17.68.030 - Exemption for manufactured home, modular home, or factory-built home parks.

Any owner of a manufactured home, modular home or factory-built home located within a legally established manufactured home, modular home, or factory-built home park within the town shall be exempt from the requirement to remove axles and wheels; provided, however, that the owner of the manufactured home, modular home or factory-built home in fact leases the property within the park and has not entered into a contract to purchase the land, lot or rental space on which the manufactured home, modular home or factory-built home is located. In such case, the provisions of other sections of this title shall still apply.

17.68.040 - Skirting requirements for manufactured home, modular home, or factory-built home in manufactured home, modular home and factory-built home parks.

A.

Any owner of a manufactured home, modular home, or factory-built home located within a legally established manufactured home, modular home, or factory-built home park within the town shall skirt such unit with a durable, opaque material, similar in color to the home, so that the area beneath the manufactured home, modular home, or factory-built home is not visible from any direction.

B.

The town, in its sole discretion, shall review and approve, approve with conditions, or deny proposed skirting.

C.

This skirting requirement shall continue to be a requirement for the duration of time that the manufactured home, modular home or factory-built home is located within the park.

17.68.050 - HUD insignia or state inspection tag.

A.

An applicant for a manufactured home, built to housing and urban development (HUD) standards shall prove to the town that such home bears the insignia of HUD, prior to the town's issuance of a certificate of occupancy.

B.

An applicant for a modular home or factory-built home, built to the approved local building standard, shall prove to the town that such home bears the insignia of the state of Colorado, Division of Housing, prior to the town's issuance of a certificate of occupancy.

17.68.060 - Recreational vehicle (independent or dependent) used as residence.

Recreational vehicles, either dependent or independent, and including truck-mounted campers, camper shells and toppers shall not be used as residences unless such vehicles are utilized within a legally established recreational vehicle park or campground designed and designated for the temporary placement of recreational vehicles. Notwithstanding the foregoing, one recreational vehicle may be used as a residence on a temporary basis on a residential lot for a period not to exceed 14 days within a single calendar year. For purposes of this chapter, "recreational vehicle" means a travel trailer, motor home, truck camper, or camping trailer that is primarily designed and used as temporary living quarters, is either self-propelled or mounted on or drawn by another vehicles.
