16 - R-1 LOW-DENSITY RESIDENTIAL DISTRICT
The intensity of permitted use regulations is as follows:
A.
Public utility buildings and facilities, if such use is essential to the service of the immediate area, and provided that:
1.
All buildings over one hundred and twenty (120) square feet shall be located at least thirty-five (35) feet from all property lines;
2.
Fences or other appropriate safety devices are installed to protect the public safety and welfare;
3.
The repair and storage of vehicles and equipment shall be within a completely enclosed building;
4.
All structures are in keeping with the residential character of the neighborhood, if at all possible; and
5.
Adequate landscaping, screening or buffering shall be provided to insure compatibility with the neighborhood.
B.
Home occupations, as defined by this code, and which comply with Chapter 17.49;
C.
Customary accessory buildings and structures, including private garages and non-commercial workshops and greenhouses, provided that:
1.
Such buildings shall be located in the rear yard and shall comply with all applicable setbacks of this code and the town's adopted building code;
2.
No accessory building on a corner lot shall extend beyond the front building line on any street side;
3.
No accessory building shall be used for residential purposes.
D.
Additional dwelling units, if lots are in excess of five thousand (5000) square feet, provided that the following criteria are met:
1.
Applicant applies for and receives a special use permit prior to installation of the unit;
2.
An additional dwelling unit may never be subdivided from the primary structure, either by subdivision, subdivision exemption or condominiumization;
3.
Additional dwelling units may not exceed one thousand (1000) square feet, or half the size of the primary residential unit, whichever is less;
4.
Additional dwelling units and primary residential units are provided with adequate parking per Chapter 17.52 of this title; and
5.
Additional dwelling units are built and/or installed per the town's adopted building code.
