SECTION VIII

- "C-2" COMMERCIAL DISTRICT REGULATIONS.

The regulations set forth in this section, or set forth elsewhere in this Ordinance when referred to in this section, are the district regulations of the "C-2" Commercial District.

1.

Use regulations. A building or premises shall be used only for the following purposes:

a.

Any use permitted in the "C-1" Commercial District, to include restrictions imposed on said district, except that mobile homes will be allowed, but for office uses only.

b.

Boarding and lodging houses.

c.

Printing, publishing and engraving.

d.

Wholesale merchandising or storage warehouses.

e.

Laboratories, research, experimental, or testing.

f.

Theaters and assembly halls, indoor.

g.

Outdoor advertising sign or structure be expanded to include provisions to prohibit, the modification of existing outdoor advertising structure, or the placement of any off-premises sign within the sign code application area that utilize any changeable electronic variable message sign (CEVMS) technology.

h.

Accessory buildings and uses.

i.

Automobile parking lots, automobile or trailer display or storage lot and sales room.

j.

Bowling alleys, dance halls or skating rinks.

k.

Farm machinery and equipment sales and repair.

l.

Commercial garages and automobile repair shops.

m.

Motorcycle repair, sales, and rentals.

n.

Building material yards wholly within an enclosed structure and with no millwork done out of doors.

o.

Veterinarian or animal hospital, each with a Special Use Permit only.

p.

General services and repair establishments including dyeing works, plumbing, heating and air conditioning, printing, upholstering, or tinsmiths.

q.

Other similar uses when approved by the City Council after receipt of review and recommendations from the Planning and Zoning Commission.

r.

Restricted residential conversions of existing buildings and limited residential uses as follows.

1)

Existing commercial structures less than two stories in height may be renovated to provide a residential use, provided the residential portion is totally within the limits of the commercial structure and does not exceed twenty-five percent of the floor area of the structure.

2)

Total Residential conversion shall be allowed only on the second floor, no conversions shall be permitted as a part of the ground floor. Residential conversions shall be subject to the multifamily construction code, life safety code and fire protection requirements. ALL residential conversions shall have an exterior independent means of access from the street level, as well as emergency egress to the exterior of the building terminating at the street level.

Parking regulations. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set out in Section XV (15) [Section XIV]; however, in this district, parking may be provided on a separate lot if it is within 300 feet of the business use. Two or more owners may join together in the provision of this parking space.

3.

Height and area regulations. The height and area regulations set forth in Sections XIII (13) and XIV (14) [Sections XII and XIII] shall be observed.

4.

Outdoor advertising regulations. Outdoor advertising sign or structure, for the purpose of this Ordinance for approved land use in "C-2," "M-1" and "M-2" zones shall mean, nonilluminated freestanding sign structures, and externally illuminated nonflashing, steady light intensity sign structures.

Outdoor advertising structures designed to mechanically, or electronically change messages periodically, flash, modulate in lighting intensity by means of internal illumination, light-emitting diodes commonly known as Changeable Electronic Variable Message Sign (CEVMS) or any similar form of message delivery method are prohibited within the sign code application area.
