ESTABLISHMENT OF DISTRICTS, DISTRICT BOUNDARIES ON ZONING MAP AND RESTRICTIONS ON LAND, WATER, BUILDINGS AND STRUCTURES
In order to classify, regulate, and restrict the uses of land, water, buildings, and structures; to regulate and restrict the height and bulk of buildings; to regulate the area of yards, courts, and other open spaces between buildings, and to regulate the intensity of land use, all the area of the City of Altamonte Springs, Florida, is classified into one of the following districts:

3.2.2.1 Where the phrases "all residential districts," "residential districts," "zoned residentially," or "residentially zoned," or phraseology of similar intent, are used in these zoning regulations, the phases shall be construed to include the following districts:
3.2.2.2 Where the phrases "commercial district," "zoned commercially," "commercially zoned," "commercial zoning," or phraseology of similar intent, are used in these zoning regulations, the phrases shall be construed to include:
3.2.2.3 Where the phrase "activity center" is used in these zoning regulations, the phrase shall be construed to indicate lands within the designated regional business center, the east town center and the west town center as identified in the adopted comprehensive plan.
The following zoning districts shall only be found in the regional business center:
Mixed office commercial-3
Mixed office residential-3
Mixed office industrial-2
The following zoning districts are found primarily in the town centers or the regional business center:
Mixed office commercial-2
Mixed office commercial-1
Mixed office residential-2
Mixed office industrial-2
The boundaries of the various districts are shown upon an official zoning atlas of sectional maps and a chart explaining the symbols which appear on said sectional maps. The official zoning atlas is hereby made a part of this ordinance and all maps, references, and other information shown therein shall be as much a part of this ordinance as if all matter and information set forth by said maps were fully described herein.
3.2.3.1 Official zoning map (or atlas).
3.2.3.1.1 Each page of the official zoning atlas shall be identified by a signature of the zoning official under the following words:
"This is to certify that this is page _____ of the Official Zoning Atlas referred to and adopted by the City of Altamonte Springs, Florida, ___________, A.D., 19___."
3.2.3.1.2 The boundaries of each district shall be shown on the official zoning atlas and the district symbol, as set out in section 3.2.1, shall be used to designate each district.
3.2.3.1.3 Changes in district boundaries. If, in accordance with the provisions of these zoning regulations and applicable provisions of Florida law, changes are made in district boundaries or other matter portrayed on the official zoning atlas, such changes shall be entered promptly on the official zoning atlas after the amendment has been approved by the city commission, with an entry on the appropriate page of the official zoning atlas as follows:
"On April 21, 1992, A.D., 1992, by Ordinance No. 1124-92 of the City of Altamonte Springs, the official zoning atlas was changed as shown on this page."
No amendment to those zoning regulations which involves matter portrayed in the official zoning atlas shall become effective until such change and entry has been made on the official zoning atlas in the manner herein set out; such change shall be made within two working days after the date of adoption of the amendment.
3.2.3.1.4 Unauthorized changes prohibited. No changes of any nature shall be made in the official zoning atlas, or any matter shown thereon, except in conformity with the procedures set out in these zoning regulations. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of these zoning regulations.
3.2.3.1.5 Final authority as to zoning. Regardless of the existence of purported copies of all or part of the official zoning atlas, which may from time to time be made or published, the official zoning atlas, which shall be maintained by the office of the city clerk, shall be the final authority as to the current zoning status of all lands and waters in the incorporated area of the city.
3.2.3.1.6 Retention of earlier zoning maps or atlases. All zoning maps or atlases, or remaining portions thereof, which have been officially adopted and recognized as the official zoning maps or atlases for the City of Altamonte Springs prior to the effective date of adoption of these zoning regulations shall be retained as a public record and as a guide to the zoning status of lands and waters prior to such date. Upon the date of adoption of these zoning regulations, the official zoning atlas of that date shall be microfilmed and such filmed record retained permanently in a place separate from the original atlas.
3.2.3.1.7 Replacement of official zoning atlas. If the official zoning atlas, or any page or portion thereof, becomes damaged, lost, destroyed, or difficult to interpret by reason of the nature or number of changes, the city commission may, by resolution, adopt a new official zoning atlas, or any page or pages thereof, which shall supersede the prior official zoning atlas, or page or pages thereof. The new official zoning atlas, or page or pages thereof, may correct drafting or other areas or omissions in the prior official zoning atlas, or page or pages thereof, but no such correction shall have the effect of amending the original official zoning atlas, or page or pages thereof.
If, in the process of adopting a replacement official zoning atlas, or any page or pages thereof, district boundaries are changed or altered, then action in regard to such change of district boundaries shall be taken only in the form of an amendment to these zoning regulations.
The new official zoning atlas, or page or portion thereof, shall be authenticated, as for the original, with wording to the following effect:
"This is to certify that this official zoning atlas (or page or pages thereof) replaced the official zoning atlas (or page or pages thereof) adopted April 21, 1992, A.D., 1992, as part of Ordinance No. 1124-92 of the City of Altamonte Springs, Florida."
Unless the prior official zoning atlas has been lost or has been totally destroyed, the prior atlas, or any significant parts thereof remaining, shall be preserved as a public record together with all available records pertaining to its adoption or amendment.
Except as otherwise specifically provided, a district symbol or name shown within district boundaries on the official zoning atlas indicates that district regulations pertaining to the district extend throughout the whole area surrounded by the boundary line. Where uncertainty exists as to the boundaries of any district shown on said maps, the following rules shall apply:
3.2.4.1 Where boundaries are indicated as approximately following street and alley lines, land lot lines, military district lines or lot lines, such lines shall be construed to be such boundaries.
3.2.4.2 In unsubdivided property or tracts, where a district boundary divides a lot, the location of such boundaries, unless same are indicated by dimensions, shall be determined by use of the scale appearing on such maps.
3.2.4.3 Where a public road, street, or alley is officially vacated or abandoned, the regulations applicable to the property to which it is reverted shall apply to such vacated or abandoned road, street, or alley.
3.2.4.4 Where boundaries are so indicated that they are approximately parallel to the center lines or street lines of streets or to the central lines of alley lines of alleys or the center lines or right-of-way lines of highways, such boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the zoning maps. If no distance is given, such dimension shall be determined from the supplementary maps.
The regulations herein set out within each district shall be minimum or maximum limitations, as the case may be, and shall apply uniformly to each class or kind of structure, use, or land or water. Except as hereinafter provided:
3.2.5.1 Zoning affects use or occupancy. No building, structure, land, or water shall hereafter be used or occupied and no building, structure, or part thereof, shall hereafter be erected, constructed, reconstructed, located, moved, or structurally altered except in conformity with the regulations herein specified for the district in which it is located.
3.2.5.2 Zoning affects height of structures, population density, lot coverage, yards, and open spaces. No building or structure shall hereafter be erected or altered in any manner contrary to the provisions of these zoning regulations, and especially:
(a)
To exceed height, bulk, or floor area;
(b)
To provide a greater number of dwelling units;
(c)
To provide less lot area per dwelling unit or to occupy a smaller lot;
(d)
To occupy a greater percentage of lot area;
(e)
To provide narrower or smaller yards, courts, or other open spaces; or
(f)
To provide for lesser separation between buildings or structures of portions of buildings or structures.
3.2.5.3 Multiple use of required open space prohibited. No part of a required yard or other required open space, required off-street parking, or off-street loading space, provided in connection with one building, structure, or use shall be included as meeting the requirements for any other building, structure, or use, except where specific provision is made in these zoning regulations.
3.2.5.4 Reduction of lot are prohibited. No lot or yard existing at the effective date of these zoning regulations shall thereafter be reduced in size, dimension, or area below the minimum requirements set out herein, except by reason of a portion being acquired for public use, in any manner, including dedication, condemnation, purchase, and the like. Lots or yards created after the effective date of these zoning regulations shall meet at least the minimum requirements established herein.
3.2.5.5 Continuity of zoning. In the event any unincorporated territory within the City of Altamonte Springs shall hereafter become incorporated, to ensure that there shall be no lapse of zoning, then, any and all zoning regulations, which may be in effect in such territory and administered by the city, shall remain in full force and effect and shall continue to be administered and enforced by the city under this zoning law until such time as municipal zoning within such territory shall be adopted and take effect.
3.2.5.6 Effect of lots. Every building or structure hereafter erected shall be located on a lot as defined herein; and, in no case, shall there be more than one single-family residence or duplex main building and its accessory buildings on one lot, except as hereinafter provided. When an unrecorded lot or parcel of land is used, the owner thereof shall furnish the land development division a statement of unity of title, allocating to such uses a specific area of land, the unity of which shall not be subject to further subdivision and shall furnish proof of legal access thereto. Uses, area, and yard requirements for such unrecorded lots shall be the same as for lots of record located in the same district.
