DEVELOPMENT REVIEW PROCESS AND PROCEDURES1
Overview
All application submittals shall follow the review process and procedures outlined in Table A of this Appendix. Additional information about the specific application process is located in the code reference sections included in Table A.
Table A—Development Review Process and Procedures
Pre-application meeting
(a)
When required. A pre-application meeting with the development review committee (DRC) is required for certain development applications, as identified in Table A below. The purpose of this meeting is to:
(1)
Review applicable Belton City Code and ordinances.
(2)
Review the requirements of the comprehensive plan and any other adopted plans.
(3)
Discuss the nature and design of the proposed development.
(4)
Discuss the procedures for development application review and approval.
(5)
Discuss items/issues including, but not limited to, impact fees, drainage studies and traffic studies.
(6)
Discuss need for review comments from other agencies and jurisdictions.
Application
(a)
Filing the application. An application must be completed and submitted to the community development department with the appropriate checklist and filing fee made payable to the City of Belton. See the Schedule of Fees for the applicable filing fee.
Deadlines
(a)
The community development department will establish and make available at its office a list of submission and revision deadlines for development applications. Failure to submit a complete or revised application on or before the deadline will preclude the city from placing the application on the scheduled planning commission agenda.
Completeness
(a)
An application is complete when all of the items required by the regulations on the application form are prepared and/or answered, the associated checklist is completed and any required supplemental or additional applications are submitted with the appropriate fee to the community development department.
(b)
Incomplete applications will be returned to the applicant. The director will take no further action on incomplete applications. Applications that have been returned to the applicant for revisions will not be processed until such revisions have been determined to be complete by the director or director's designate.
(c)
A determination of completeness shall not constitute a determination of compliance with the substantive provisions of these regulations.
Staff Review
(a)
Staff review. The staff shall review the application and supporting information. After reviewing the submittal, staff shall prepare and provide written comments of any items that are not in compliance with code, adopted plans, or other deficiencies or incomplete items that prevent staff from completing the review and preparing a final recommendation to the review and decision-making bodies. Upon review of staff comments, staff or the applicant may request an applicant's meeting as outlined below. After all comments have been addressed and any supporting documentation has been provided, staff shall prepare a report summarizing the application request, pertinent information, and recommendation and conditions to the review and decision-making bodies. The staff report will be provided to the application for review prior to the hearing at which the application will be heard. The staff report will be included in the agenda packet posted for public review in advance of the scheduled meeting date.
(b)
Communication. Staff reports and review comments will be sent to applicant via email.
Applicant's meeting
An applicant's meeting may be requested by either staff or the applicant after staff has reviewed an application submittal and provided comments and requests for revisions or additional information. The purpose of the meeting is:
• To allow city staff to present a preliminary, technical review of submitted plans;
• To request from the applicant any necessary plan revisions;
• To give the applicant an opportunity to ask questions; and
• To work out a schedule for submitting revised plans.
