CHAPTER 17

22 - P1 PARKING DISTRICT

17.22.010 - Purpose.

The purpose of the P1 district is to establish and preserve areas for the parking of motor vehicles in close proximity to land uses which create a need for substantial amounts of vehicle parking, and to assure that parking in those areas is so located and screened as not to be incompatible with uses in any adjoining residential district.

17.22.020 - Permitted uses.

The following uses are permitted outright in the P1 district:

A.

Vehicular parking facilities to provide all or a portion of the parking appurtenant to a permitted use in a district. Installation, operation and maintenance of parking facilities shall be in accordance with the provisions of Chapter 17.44.

17.22.030 - Landscaping and screening.

The landscaping and screening provisions of Chapter 17.48 of this code apply in the P1 district.

17.22.040 - Signs.

Signs are permitted in the Pl district as follows:

A.

One sign to identify who the parking lot belongs to which does not exceed thirty-two square feet in area;

B.

Entrance and exit signs which do not exceed one square foot in area are permitted on each side of each driveway.

17.22.050 - Violation—Penalty.

A.

Any owner, responsible party or other person having control over a structure or parcel of land, who causes, permits, facilitates or aids or abets any violation of any provision of this chapter, or who fails to perform any act or duty required by this chapter, shall be subject to a civil sanction of not less than fifty dollars nor more than two thousand five hundred dollars.

B.

Notwithstanding subsection (A) of this section, the prosecutor may, in the exercise of their discretion, file a complaint against any person violating any provision of this chapter as a class 1 misdemeanor and, upon conviction thereof, they shall be punished by a fine of not less than one hundred fifty dollars nor more than two thousand five hundred dollars, or by imprisonment in the county jail for a period not to exceed six months, or by both such fine and imprisonment.

C.

Each day any violation of any provision of this chapter or the failure to perform any act or duty required by this chapter exists shall constitute a separate violation or offense.

D.

The owner of record as recorded in the Mohave County recorder's office of the property upon which a violation of this chapter exists shall be presumed to be the person having lawful control over that structure or parcel of land. If more than one person shall be recorded as the owner of the property, such persons shall be jointly and severally presumed to be the persons having lawful control over a structure or parcel of land.
