CHAPTER 17

10 - ZONES AND BOUNDARIES

17.10.010 - Division of city into districts.

A.

In order to classify, regulate and restrict the location of buildings and land uses; to control the height and bulk of buildings hereafter erected or structurally altered; to regulate and limit the intensity of the use of lot areas; and to regulate and determine the area of yards, courts, and other open spaces within and surrounding such buildings, Bullhead City, Arizona is divided into zoning districts. The use, height, and area regulations are consistent in each zone and the zones shall be known as follows:

R1L district (residential: single-family limited);

R1S district (residential: single-family suburban);

R1FB district (residential: single-family factory built);

R1MH district (residential: single-family manufactured home);

R2MF district (residential: multiple-family);

RS district (residential and services);

P1 district (parking);

C1 district (commercial: neighborhood sales and service);

C2 district (general commercial);

C3 district (commercial and minor industrial);

M1 district (industrial: general limited);

M2 district (industrial: heavy);

PAD district (planned area development);

PL district (public lands);

ANH district (airport noise and height overlay);

RP district (residential park);

GC district (golf course);

P/OS (parks/open space).

B.

The incorporated area of the city may be further divided into density districts as follows: D1 district, D2 district, D3 district, D6 district, D7 district, D8 district, D9 district, D10 district, D12 district, D35 district and D43 district.

17.10.020 - Boundary lines on the zoning maps.

The boundaries of the aforesaid districts are established as shown upon the maps designated as Bullhead City Zoning, which accompany the ordinance codified in this title. The zoning maps, along with all the notations, references and other information shown thereon, are a part of this title and have the same force and effect as if said maps and all the notations, references and other information shown thereon were fully set forth or described herein.

17.10.030 - Boundary determination.

Where uncertainty exists with respect to the boundaries of any district as shown on the district maps, the following rules shall apply:

A.

Unless shown otherwise, the boundaries of the district or zones are lot lines, the centerlines of streets, alleys, roads or such lines extended, and the corporate limits of Bullhead City.

B.

Where district boundaries are indicated as approximately following the line of any stream, irrigation canal or other waterway or railroad right-of-way, or the boundary line of public land, the center of such stream, canal or waterway or the boundary line of such public land shall be construed to be the district boundaries.

C.

Where, due to the scale, lack of detail or illegibility of the zoning map accompanying this title, there is any uncertainty, contradiction or conflict as to the intended location of any zone boundaries shown thereon, interpretation concerning the exact location of zone boundary lines shall be determined upon written application, or upon its own motion, by the board of adjustment after recommendation by the zoning administrator.

17.10.040 - Regulations governing annexed territory.

A.

Areas, when annexed to Bullhead City, shall, until officially zoned in accordance with this title by the city council of the city, bear the same land use district classification possessed by it under the regulations of Mohave County.

B.

Any use or activity conducted contrary to county zoning regulations at the effective date of annexation and not constituting a nonconforming use under the county zoning regulations shall not be considered a nonconforming use under this title and the continuance thereof shall constitute a violation of this title.

17.10.050 - Public way vacation—Right-of-way permit.

A.

Whenever any street, alley or other public way is vacated by official action of the city council, the zone of the abutting properties shall be extended to the centerline of the areas vacated.

B.

Whenever a right-of-way permit is issued for a sign in any street, alley or other public way, the zone of the abutting properties shall be extended to the area that is the subject of the right-of-way permit.

17.10.060 - Establishment of use districts and density districts.

In conformity with the purpose and effect of this title, use districts and density districts are established in order to effect the purposes set forth in Section 17.10.010. The districts are designed to be used in combinations and in such are referred to as a zoning district.

17.10.070 - Interpretation of provisions.

In interpreting and applying the regulations of this title, they shall be held to be the minimum requirements for the promotion of the public health, safety and general welfare. It is not intended by this title to interfere with or abrogate or annul any ordinances, rules, regulations or permits previously adopted or issued, and not in conflict with any of the regulations of this title, or which shall be adopted or issued pursuant to law relating to the use of buildings or premises and likewise not in conflict with this title; nor is it intended by this title to interfere with or abrogate or annul any easements, covenants or other agreements between parties, except that if this title imposes a greater restriction, this title shall regulate.
