CHAPTER 17

84 - CONDITIONAL USES

17.84.010 - Intent.

The intent of conditional use permits is to provide for specific uses other than those permitted in each district, which may be appropriate in the district under certain safeguards or conditions.

17.84.020 - Conditional use requirements.

No structure or land may be used for any purpose in any district where such use is not a permitted use, unless such use is listed as a conditional use in this chapter and approval for that use is obtained through the proper procedure. Conditional use permits shall be granted only by the city council when their findings are that:

A.

The use will not adversely affect public health, safety, general welfare of the community and conforms to the objectives of the master plan and the intent of this chapter; and

B.

Such use will not adversely affect nearby properties or their occupants; and

C.

Such use meets density, coverage, yard, height and all other regulations of the district in which it is to be located, unless otherwise provided for in this chapter; and

D.

A public hearing has been held, after the required legal notices have been given and the public has been given a chance to be heard upon the matter.

17.84.030 - Conditional use permit procedure.

A.

All applications for conditional use permits shall be filed with the zoning officer and must be accompanied by the fee established as set forth in Chapter 17.116 to cover associated administrative and review costs. All applications must be signed by the property owner and applicant.

B.

The zoning officer shall then cause to be made such investigation of facts bearing on the application as will provide necessary information to assure that the action on each such application is consistent with the intent and purpose of this title.

C.

The zoning officer shall cause to be sent to the city council a written report on the application containing any and all pertinent facts. The applicant shall also be provided with a copy of the zoning officer's report to the city council.

D.

Upon receipt of the zoning officer's report, the city council shall schedule a public hearing on the application.

E.

Notice of the public hearing shall be posted on the property at least fifteen (15) days prior to the date of the public hearing. In addition, the zoning officer shall mail notice of the public hearing to the owners of property located within one hundred fifty (150) feet of the boundary of the property described in the application for a conditional use permit by depositing the notice properly addressed in the United States mail with postage paid at the first-class rate at least fifteen (15) days prior to the date of the public hearing. Names and addresses of adjoining property owners will be provided to the zoning officer by the applicant and will be certified by the county clerk and recorder or an authorized title company.

F.

During the public hearing, the zoning officer's report shall be read and additional testimony may be taken from interested parties. After duly considering the matter, the city council shall either approve or deny the application. Conditional approval may be granted as provided under Sections 17.84.040 and 17.84.050. If the application is denied, reasons for denial shall be given.

17.84.040 - Conditional approval.

The city council may make the granting of a conditional use permit subject to reasonable limitations or conditions as it may deem necessary to enhance the appearance of the property, to reduce any adverse effects on nearby property or residences, to preserve the character of the area, or to make it more acceptable in other ways.

17.84.050 - Conditions of approval.

Any conditional approval under this chapter shall be subject to the terms of the conditions designated in connection herewith. Conditions of approval may include but are not limited to:

A.

A time period within which the proposed structures shall be erected or use will occur;

B.

Requiring landscaping or fencing and maintenance thereof;

C.

Requiring the surfacing and marking of off-street parking and loading areas;

D.

Requiring special health or safety precautions to be taken;

E.

Any other conditions as will make possible the development of the city in an orderly and efficient manner and in conformity with the intent and purpose set forth in this title.

17.84.060 - Conditional uses.

Permitted conditional uses for each zoning district are listed in the appropriate chapter for each zoning district.

17.84.070 - Revocation of conditional use permit.

Failure of any person or persons who holds a conditional use permit issued by the city council to abide by all of the restrictions and conditions of the conditional use permit shall be adequate grounds for the city council to revoke such conditional use permit and order that the conditional use shall be discontinued within thirty (30) days of the revocation of the conditional use permit.
