CHAPTER 16

62 - ZONING—RR-C RURAL RESIDENTIAL CLUSTER ZONE

16.62.010 - Specific intent.

The rural residential cluster zone permits new development on lot sizes that encourage cluster development for open space, recreation or other township benefit.

16.62.020 - Permitted uses.

A.

Agricultural uses, as permitted in the RR district;

B.

Single-family detached dwellings;

C.

Municipal buildings, parks, playfields and/or other township services.

16.62.030 - Permitted accessory uses.

A.

Customary accessory uses;

B.

Private garages;

C.

Private swimming pools, in conformance with Section 16.18.150;

D.

Renewable energy facilities in accordance with Sections 16.85.020 and 16.85.030;

E.

Retaining wall structures, in conformance with Section 16.18.160.

16.62.040 - Conditional uses.

The following conditional uses shall be allowed in accordance with Chapter 16.84:

Churches;

B.

Schools.

16.62.050 - Dimensional restrictions—Other regulations.

A.

Lot Size.

1.

For any parcel ten (10) acres or less, the minimum lot size shall not be less than thirty-two thousand (32,000) square feet for each family, subject to the lot and area requirements that follow. The minimum open space requirement for developments with such lot sizes shall be twenty-five (25) percent. The area of open space for parcels ten (10) acres in size or less must be exclusive of stormwater management (detention/retention) basins, but may include wetlands and the wetlands buffer area.

For all parcels over ten (10) acres within the sanitary sewer district, the subdivision shall comply with Section 16.40.010. The lot size shall be a minimum of twenty-two thousand five hundred (22,500) square feet, provided that fifty (50) percent of the total tract area shall be set aside for open space, recreation, or other public purpose as approved by the planning board. Of the set aside open space area, the land required for recreation as set forth in the recreation element and the land development ordinance must be usable upland. The remaining open space shall be contiguous with existing open spaces or farmlands and/or proposed open space in the master plan, and may be wetlands or otherwise environmentally sensitive lands. Open space is encouraged along township and county roads.

B.

Minimum Frontage Requirement. Each lot shall have a minimum frontage on at least one municipal street of not less than one hundred twenty-five (125) feet.

C.

Impervious Coverage Limit. The maximum impervious coverage (to include buildings and permanent structures, driveways, and in-ground swimming pools) shall be no greater than thirty (30) percent.

D.

Front Yard. There shall be a front yard on each street on which a lot fronts of not less than seventy-five (75) feet in depth. (See Section 16.48.040.)

E.

Side Yards. There shall be an aggregate side yard total of not less than thirty-five (35) feet on each lot, with a minimum of fifteen (15) feet on one side.

F.

Rear Yard. There shall be a rear yard on each lot which shall not be less than fifty (50) feet in depth.

G.

Building Heights. Buildings and other structures shall not exceed thirty-five (35) feet in height.

H.

Minimum Yard Setbacks for Accessory Buildings.

Front yard 110 feet
Side yard 10 feet
Rear yard 10 feet

 

I.

Open Space. The open space may be offered to the township for dedication, maintained by a homeowners' association or, at the planning board's direction, may be placed into the lot area and deed restricted to serve a conservation purpose.
