CHAPTER 16

38 - RECREATION FACILITIES

16.38.010 - General requirements.

All recreation areas and facilities shall be designed in accordance with the New Jersey Department of Environmental Protection Publication entitled Administrative Guidelines: Barrier Free Design Standards for Parks and Recreational Facilities.

16.38.020 - Recreation standards for residential developments.

A.

All major subdivision residential development shall provide:

1.

Eight acres of land to be used for recreational purposes for every one thousand (1,000) projected residents of the development; provided however, that such acreage shall not be required to exceed ten (10) percent of the total acreage of the proposed development;

2.

Land provided in accordance with subsection (A)(1) of this section shall be provided in a single area or in individual parcels of at least one acre in size;

3.

All residential units for which the recreational land is provided in accordance with subsection (A)(1) of this section shall be located within one-quarter mile of such recreation land;

4.

At least fifty (50) percent of the recreational land provided in accordance with subsection (A)(1) of this section shall be turfed or landscaped with suitable materials to permit informal recreational activities;

5.

Only in the cluster provisions of residential subdivisions shall exceptions to subdivisions 1 through 4 of this subsection, be permitted.

B.

The developer's recreation plans shall be submitted to the reviewing board for its review and approval. For the purposes of this section, a single-family detached house shall be deemed to contain three and-a-half persons; a townhouse or condominium shall be deemed to contain two and three-quarters persons; and an apartment shall be deemed to contain two and-a-half persons, except in the case of an age-restricted or senior citizen community, or an assisted living facility, in which case the provisions of Section 16.19.070 shall prevail. The planning board shall evaluate the plans in terms of the following considerations:

Parks. Standards as to District Parks, Neighborhood Parks, and Major Community Parks, are set forth in Section 16.19.070 of Chapter 16.19. Large tracts of fifty (50) acres or more are preferable to scattered sites. Lands with mature vegetation, high scenic qualities, historical significance, or other unique characteristics are especially recommended. Picnic areas may be incorporated into such parks where appropriate.

Neighborhood Playgrounds and Play (Tot) Lots. Individual sites should be in accordance with the standards set forth in Section 16.19.070 of Chapter 16.19 and within walking distance of the people served. Separate play areas for the age groups one through five, six through ten (10) and eleven (11) through fifteen (15) should be included. Equipment for these areas should be based on the recreation needs of each age group.

Infants through five years old should have a sand area, small swings, static play animals, a small sliding board and other similar equipment. A sitting area for the parents should be provided in close proximity to the play areas. Tricycle space and pavement should be a part of this area.

Children through ten (10) years of age are interested in movement type activities, and should be provided with slides, seesaws, balance beams, rope climbing areas, chin-up bars and other similar equipment.

Children eleven (11) through fifteen (15) are interested in two kinds of spaces, a general use field where a frisbee or football can be thrown, and a space of identity for the age group. Bicycle paths and hills, jumps and other similar features are recommended in this area. Landscaping should provide shade and separation for each area.

Tennis Courts. Recommended standards are set forth under Section 16.19.070 of Chapter 16.19.

Baseball and Softball Fields. Recommended standards are set forth under Section 16.19.070 of Chapter 16.19.

5.

Basketball Courts. Recommended standards are set forth under Section 16.19.070 of Chapter 16.19.

6.

Soccer Fields, Football, Volleyball, Street Hockey. Recommended standards are set forth under Section 16.19.070 of Chapter 16.19.

7.

Bike, Walking Trails and Jogging Paths. These should link homes with local recreation and service opportunities, and be integrated into district parks, whenever possible. Recommended standards are set forth under Section 16.19.070 of Chapter 16.19.

16.38.030 - Developer contributions in-lieu of.

Whenever a developer cannot meet a part or all of the provisions for recreational facilities as set forth herein, or if by mutual agreement by and between the developer and the planning board, it is determined that an off-site recreational facility would best serve the interests of the prospective residents of the proposed development, the developer shall be permitted to make a contribution in lieu of all or a part of the requirements set forth herein, by contributing to off-tract recreational improvements pursuant to the terms and conditions as are set forth under Section 16.19.070 ("Off-Tract Recreational Improvements") of Chapter 16.19 ("Developer Contributions for Off-Tract Improvements").
