CHAPTER 18

B-3 GENERAL BUSINESS DISTRICT

10-18-1: GENERAL DESCRIPTION:

The General Business District is intended to be a diverse and intensive business, office, service and entertainment area. This district is one of high traffic generation and is thus located where there can be a concentration of a variety of commercial activities. (Ord. 18-08, 6-3-2019)

10-18-2: PERMITTED PRINCIPAL USES:

Any use or structure permitted and as regulated in the B-2 District of this title, except as hereinafter modified.
Animal hospitals, veterinary clinics with kennels (both indoor and outdoor), provided that buildings or enclosures in which animals are kept shall be at least one hundred feet (100') from any lot in any R District.
Commercial baseball field, bath house or boat house, golf driving range, skating rink, swimming pool or similar open air recreational uses and facilities, but not within two hundred feet (200') of any R District.
Tourist homes.
Wholesale businesses.
The following uses provided no part of a building where any activity is conducted shall have any openings other than stationary windows or required fire exits within one hundred feet (100') of any R District:
Auto accessory stores with indoor storage.
Bottling of soft drinks or milk, or distribution stations.
Bowling alley, pool hall or billiard parlor, and similar enterprises.
Carpenter shop, sign painting shop, and similar establishments.
Any other use that is determined by the Board of Zoning Appeals to be of the same general character as the foregoing permitted uses, but not including any use which may become noxious or offensive in a B-3 District. (Ord. 18-08, 6-3-2019)

10-18-3: PERMITTED ACCESSORY USES:

B-2 Business District accessory uses.
Other accessory uses customarily incidental to a B-3 permitted principal use, including signs as regulated by City ordinance and State Statutes, whichever is more restrictive. (Ord. 18-08, 6-3-2019)

10-18-4: WHEN AUTHORIZED BY BOARD OF ZONING APPEALS:

Any use permitted on review in a B-2 District.
Auto repair, minor, when outdoor operations are enclosed by a solid eight foot (8') fence.
Automobile display, hire, sales, including sales lot at least one hundred feet (100') from Residentially zoned private property.
Commercial equipment storage facility (large storage units, recreational vehicle storage, mobile agricultural vehicle or equipment storage) with structures at least one hundred feet (100') from Residentially zoned private property.
Any other similar uses deemed to be consistent by the Board of Zoning Appeals. (Ord. 18-08, 6-3-2019)

10-18-5: LOT REQUIREMENTS:

The following minimum requirements shall be observed, subject to chapter 28, "Additional Requirements, Exceptions And Modifications", of this title.

10-18-6: PROHIBITED USES:

Major auto repair, auto salvage and wrecking operations, and industrial metal and waste salvage operations and junkyards.
Outdoor storage. (Ord. 18-08, 6-3-2019)

10-18-7: SPECIAL USES:

   (A)   A Special Use as designated in Chapter 23 may be permitted only after a public hearing before the Plan Commission, and only upon presentation of evidence by the applicant that the proposed use:
      1.   Will be located in an area which will have minimum impact upon neighboring properties; and
      2.   Will be located in an area without the creation of nuisances or hazards to the public health or safety; and
      3.   Such operation complies with all other existing laws, ordinances, and rules properly promulgated by any Federal, State or local governmental entity having jurisdiction over the subject premises.
   (B)   Additionally, all special uses must be approved by ordinance and adopted by the City Council that are property brought before the Corporate Authorities pursuant to formal application and duly approved.
   (C)   Proposed uses requiring a special use permit include:
Adult Use Cannabis Craft Grower.
Adult Use Cannabis Cultivation Center.
Adult Use Cannabis Dispensing Organization.
Adult Use Cannabis Infuser Organization.
Adult Use Transporting Organization.
