CHAPTER 20

I-1 LIGHT INDUSTRIAL DISTRICT

10-20-1: GENERAL DESCRIPTION:

The Light Industrial District is intended to provide for the development of most types of industry with regulations designed to protect adjacent properties. (Ord. 18-08, 6-3-2019)

10-20-2: PERMITTED PRINCIPAL USES:

Any use or structure permitted outright or when authorized by the Board of Zoning Appeals in the B-3 and B-4 Districts, but not in the B-1 or B-2 District, except as hereinafter modified.
The following uses if located not less than one hundred feet (100') from any R District provided that any such operations are enclosed by fence not less than six feet (6') in height:
Builder's or contractor's plant or storage yard.
Building material sales and storage yard, including concrete mixing.
Lumber yard, including millwork.
Open yard for storage and sale of feed or fuel.
The following uses provided not part of a building occupied by such uses shall have any openings other than stationary windows or required fire exits within one hundred feet (100') of any R District:
Automobile repair, major.
Blacksmith, welding or other metalworking or machine shop.
Laboratory: experimental, film or testing.
Machine repair.
Machinery manufacturing.
Perfume manufacturing.
Railroad freight stations, trucking or motor freight terminals.
The manufacture, compounding, processing, assembling, packaging or treatment of such merchandise, products, articles, devices, or raw materials as:
Apparel.
Bakery goods.
Brewery.
Candy.
Canvas.
Cellophane.
Cloth.
Cosmetics.
Electric and neon signs.
Fiber.
Food products.
Fur.
Glass.
Leather.
Paper.
Pharmaceuticals.
Phonographs.
Plastics.
Precious or semiprecious metals or stone.
Public parks.
Radio and television sets.
Refrigerators and stoves.
Rubber.
Textiles.
Toiletries.
Wool.
Yarn.
Any other use that is determined by the Board of Zoning Appeals to be of the same general character as the foregoing permitted uses, but not including any use which may become noxious or offensive in an I-1 District.
Shall be permitted without exception:

10-20-3: PERMITTED ACCESSORY USES:

B-4 Business District accessory uses.
Offices.
Other accessory uses customarily incidental to a permitted principal use, including signs as regulated by City ordinance and State Statutes, whichever is more restrictive. (Ord. 18-08, 6-3-2019)

10-20-4: PROHIBITED USES:

Auto salvage and wrecking operations, industrial metal and waste salvage operations and junkyards.
Disposal or storage of toxic waste.
Dwellings, except for watchman or caretaker on the premises.
Schools, hospitals, clinics and other institutions for human care except when incidental to a permitted principal use. (Ord. 18-08, 6-3-2019)

10-20-5: YARD REQUIREMENTS:

The following minimum requirements shall be observed, subject to the additional requirements, exceptions and modifications in chapter 28, "Additional Requirements, Exceptions And Modifications", of this title:

10-20-6: SPECIAL USES:

   (A)   A special use as designated above may be permitted only after a public hearing before the Plan Commission, and only upon the presentation of evidence by the applicant that the proposed use:
      1.   Will be located in an area which will have minimum impact upon neighboring properties; and
      2.   Will be located in an area without the creation of nuisances or hazards to the public health or safety; and
      3.   Such operation complies with all other existing laws, ordinances and rules properly promulgated by any Federal, State or local governmental entity having jurisdiction over the subject premises.
   (B)   Additionally, all special uses must be approved by ordinance and adopted by the City Council that are properly brought before the Corporate Authorities pursuant to formal application and duly approved.
   (C)   Proposed uses requiring a special use permit include:
Adult Use Cannabis Craft Grower.
Adult Use Cannabis Cultivation Center.
Adult Use Cannabis Dispensing Organization.
Adult Use Cannabis Infuser Organization.
Adult Use Transporting Organization.
Adult Use Processing Organization.
Excavation and extraction of sand, gravel, dirt, topsoil and other resources.
Landfill, recycling and activities directly related thereto.
