CHAPTER 19

B-4 HIGHWAY/INTENSIVE BUSINESS DISTRICT

10-19-1: PERMITTED PRINCIPAL USES:

Any use permitted in a B-3 District, but not dwellings.
Agricultural implement sales and services with building(s) and outdoor storage at least one hundred feet (100') from Residentially zoned private property.
Auto repair, major, with building(s) and outdoor storage at least one hundred feet (100') from Residentially zoned private property.
Boat sales with building(s) and outdoor storage at least one hundred feet (100') from Residentially zoned private property.
Building material sales yards, if enclosed on all sides by an eight foot (8') high fence and at least one hundred feet (100') from Residentially zoned private property.
Car wash.
Contractors offices and shops within building.
Feed and seed store, wholesale.
Greenhouses (with outside storage).
Truck, trailer, travel trailer, and garden implement establishments for display, hire, sales, including sales lot at least one hundred feet (100') from Residentially zoned private property.
Any other similar uses deemed to be consistent. (Ord. 18-08, 6-3-2019)

10-19-2: PERMITTED ACCESSORY USES:

B-3 General Business District accessory uses.
Other accessory uses customarily incidental to a B-4 permitted principal use, including signs as regulated by City ordinance and State Statutes, whichever is more restrictive. (Ord. 18-08, 6-3-2019)

10-19-3: WHEN AUTHORIZED BY BOARD OF ZONING APPEALS:

Any uses permitted on review in a B-3 District.
Auditorium.
Commercial equipment storage facility (large storage units, recreational vehicle storage, mobile agricultural vehicle or equipment storage) with structures at least one hundred feet (100') from Residentially zoned private property.
Mini-warehousing with structures at least one hundred feet (100') from Residentially zoned private property. (Ord. 18-08, 6-3-2019)

10-19-4: LOT AREA AND YARD REQUIREMENTS:

The following minimum requirements shall be observed for both primary and accessory buildings along with bufferyard requirements subject to chapter 28, "Additional Requirements, Exceptions And Modifications", of this title. No accessory building shall be located in a front yard.

10-19-5: SPECIAL USES:

   (A)   A Special Use as designated in Chapter 23 may be permitted only after a public hearing before the Plan Commission, and only upon presentation of evidence by the applicant that the proposed use:
      1.   Will be located in an area which will have minimum impact upon neighboring properties: and
      2.   Will be located in an area without the creation of nuisances or hazards to the public health or safety; and
      3.   Such operation complies with all other existing laws, ordinances, and rules properly promulgated by any Federal. State or local governmental entity having jurisdiction over the subject premises.
   (B)   Additionally, all special uses must be approved by ordinance and adopted by the City Council that are property brought before the Corporate Authorities pursuant to formal application and duly approved.
   (C)   Proposed uses requiring a special use permit include:
Adult Use Cannabis Craft Grower.
Adult Use Cannabis Cultivation Center.
Adult Use Cannabis Dispensing Organization.
Adult Use Cannabis Infuser Organization.
Adult Use Transporting Organization.
