"Abated" and "abatement"mean the complete discontinuance of any nonconforming use where no building or structure is involved, or the complete discontinuance and removal of a nonconforming use of a conforming building, or the complete removal of a nonconforming building or structure, or the structural alteration of a building or structure to make it conform to the uses permitted in the zone in which the property is located.
"Abut" and "abutting"mean to touch along a border, or possessing a common property line. Where an alley or an easement separates two pieces of property, such properties shall be considered as abutting.
"Access"as used in this title, means the providing of a way of approach to, or entrance to or on to a piece of property from a street, easement or alley.
"Access control"means the creation and reinforcement of physical and psychological boundaries, limits and barriers to distinguish between spaces belonging to residents only, to residents and visitors, and to the general public. It involves the careful placement of entrances, exits, signs, fencing, landscaping and lighting, as well as supportive safety design.
"Accessory structure"means a building, structure, or part of a building or other structure that (1): is subordinate to, and the use of which is incidental to, that of the primary building, structure or use on the same lot; (2) complements or is reasonably related to the proposed or permitted uses on site. Any structure that is not clearly related to the principal use on site shall not be permitted.
"Accessory building or structure"means a physical structure that is incidental and subordinate to the primary building on the property and is physically detached from the primary building. Accessory buildings or structures include, but are not limited to, detached garages, sheds, playhouses, storage buildings, garden structures, pool houses, and cabanas. An "accessory dwelling unit" is defined separately and addressed in Chapter
17.21.
"Accessory use"A use or service subordinate in extent and purpose to the primary use of a lot or building and which is compatible with the permitted or proposed primary use on said lot or building. Any use that is not clearly related to the principal use on site will not be allowed.
"Affordable rent"means monthly housing expenses, including a reasonable allowance for utilities, for rental target units reserved for very low or lower income households, not exceeding the following calculations:
A. Very low income: fifty percent of the area median income for Los Angeles County, adjusted for household size, multiplied by 0.30 and divided by twelve.
B. Lower income: eighty percent of the area median income for Los Angeles County, adjusted for household size, multiplied by 0.30 and divided by twelve.
"Affordable sales price"means a sales price at which moderate, lower or very low income households can qualify for the purchase of target units, calculated on the basis of underwriting standards of mortgage financing available for the development.
"Airport, heliport or aircraft landing field"means any runway, landing area, or other facility whether publicly or privately owned and operated, and which is designed, or used or intended to be used either by military aircraft, public carriers or by private aircraft for landing and taking off of aircraft, including all necessary taxiways, aircraft storage and tie-down areas, hangars and other necessary buildings and open spaces.
"Alcoholic beverage"includes alcohol, spirits, liquor, wine, beer, brandy, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.
"Alcoholic beverage manufacturer"means a beer manufacturer, a winegrower, a distilled spirits manufacturer, or a brandy manufacturer, licensed by the Department of Alcoholic Beverage Control of the state of California, or any officer, director, employee or agent of any such person.
"Alcoholic beverage manufacturing"means the manufacture or production of alcoholic beverages by any person licensed by the Department of Alcoholic Beverage Control of the state of California and includes the sale or distribution of said products.
"Alcohol license"means that license granted by the state which authorized the licensee to sell alcoholic beverages.
"Alley"means a public thoroughfare or way which affords only a secondary means of access to abutting property.
"Amendment"means a change in wording, context or substance of this title, or a change in the zone boundaries upon the zoning map, which map is a part of this title when adopted hereunder.
"Antiques"mean any articles which, because of age, rarity or historical significance, have a monetary value greater than the original value, or which have an age recognized by the United States Government as entitling the article to an import duty less than that prescribed for contemporary merchandise. A store or shop selling such articles or offering them for sale shall be considered as an antique shop or store, and not considered as a dealership handling used or secondhand merchandise.
"Antique shop"means a retail establishment that primarily engages in the sale of antiques.
"Apartment"means a room, or a suite of two or more rooms occupied or suitable for occupancy as a dwelling unit for one family in a multiple-dwelling or any other building not a single-family dwelling or duplex.
Apartment, bachelor. "Bachelor apartment"means a room or a suite of two or more rooms, without kitchen facilities, but with bath. A bachelor apartment constitutes a dwelling unit within the meaning and intent of this title.
"Apartment conversion"means the conversion of rental property originally developed with two or more units to condominiums.
"Apartment hotel"means a building, or portion thereof, which is designed or used for both two or more dwelling units and six or more guest rooms or suites which may be rented to either or both transients or nontransients.
"Apartment house"means a building or a portion of a building, designed for occupancy by three or more families living independently of each other, and containing three or more dwelling units.
"Approve"means an action to sanction officially, or to ratify or confirm any proposal to add to, to delete from, or to modify the provisions of this title by the council or any officer, commission or board having authority so to act.
"Amusement arcade"means a commercial establishment containing ten or more mechanical, electrical or electronic amusement machines or devices having an amusement feature connected therewith, or which utilize the skill of the operator thereof, and where any charge is made by the person conducting such establishment or any consideration is paid by any player for the right to play or operate the amusement device.
"Assembly hall"means a building or portion of a building in which facilities are used by the public or membership groups, on a regular or occasional basis, for civic, educational, political, or social purposes. Assembly hall includes an auditorium but does not include a church or assemblage for worship (see "Church").
"Automobile commercial trailer"means a vehicle without motor power designed to be drawn by a motor vehicle and which trailer is used or may be used for carrying goods and property.
"Automobile house trailer"means a vehicle without motor power designed to be drawn by a motor vehicle and to be used for human habitation, including a trailer coach, tourist trailer, mobile home, camper or any other self-propelled vehicle having a body designed for or converted to the same uses as a house trailer.
Automobile repair—major."Major automobile repair" means a use which services and makes repairs to automobiles and other motorized vehicles, including, but not limited to, engine rebuilding, replacement of major components such as radiators, fuel injectors, pistons and other internal components of internal combustion engines, rebuilding or refurbishing engines, and other similar uses that require significant deconstruction and/or immobility of the vehicle.
Automobile repair—minor."Minor automobile repair" means a use which services and makes repairs to automobiles and other motorized vehicles limited in intensity to diagnostics, oil changes, filter changes, tuning, tire changes, alignments, battery changes, brake service, exhaust systems service, window tinting, upholstery, and other similar repairs not specifically named as major repairs.
"Automobile wrecking or dismantling"means any dismantling, disassembling or demolition of motor vehicles, trailers or other automotive equipment, or the storage, sale or dumping of dismantled, partially dismantled, obsolete or wrecked vehicles or their parts, whether or not for the purpose of salvaging and dealing in usable parts or materials.
"Barbers"can prep, style, cut and color hair, apply cosmetic preparations, antiseptics, powders or lotions to the scalp, face or neck. Barbers are the only licensees who can perform a shave on a customer. They may not perform procedures that penetrate the skin or affect any living tissue.
"Billboard"means any sign, signboard or outdoor advertising display, including electronic billboards, which is used for advertising purposes or display purposes except advertising displays used exclusively:
A. To advertise the sale or lease of the property upon which such advertising displays are to be placed;
B. To designate the name of the owner or the occupant of the premises upon which such advertising display is placed, or to identify such premises;
C. To advertise goods manufactured, produced, or for sale or services rendered, on the property upon which such advertising display is placed.
"Block"means all property abutting upon one side of a street between either intersecting or intercepting streets, or between a street and a railroad right-of-way, terminus or dead-end street, or city boundary. An intercepting street shall determine only the boundary of the block on the side of the street which it intercepts.
"Boarding home and guest home"mean homes for aged persons in good health, such homes are restricted to caring for fifteen or less persons, not including the operator thereof or his or her family, and in which homes no professional medical care is given, and no person kept who may be suffering from a mental sickness, mental disease, disorder or ailment, or from a contagious or communicable disease, and in which homes no surgery nor primary treatments such as are customarily provided in sanitariums and hospitals are performed or given, and in which no persons are kept or served who would normally be admittable to a mental hospital. If more than fifteen persons are cared for, such home shall be classified as a home for the aged.
"Boardinghouse"means the same as lodging house, but where meals (with or without lodging) are provided for compensation for not more than fifteen persons other than the family. Boardinghouses shall not include rest homes or convalescent homes.
"Body piercing"means the act of penetrating the skin to make, generally permanent in nature, a hole, mark, or scar.
"Bona fide public eating place"means a place which is regularly used and kept open for, the serving of full course meals, as opposed to serving only snacks or appetizers, to customers for compensation and which has suitable kitchen facilities connected therewith, containing commercial-grade refrigeration and cooking appliances as well as an assortment of ingredients which may be required for ordinary meals. Any public eating place that satisfies the foregoing criteria but has areas designated for uses other than food preparation or consumption such as a bar/lounge area, billiards, dart boards, dance floors and so forth, in excess of twenty percent of the total gross floor area, shall not be deemed a bona fide public eating place.
"Bookstore"means a retail establishment that, as its primary business, engages in the sale or rental of new or used books, magazines, newspapers or any other printed or electronically conveyed information or media. This classification excludes any "adult bookstore" establishments, as defined in Section
5.92.020.
"Boxing gym"means place in which an individual or group for sport, recreation or the purposes of learning, participate in competition using their fists.
"Brewery, low intensity"means an establishment in which the brewing of beer is the ancillary use commonly associated with tap-rooms, tasting-rooms, and/or dining areas which allow on-site consumption. Limitations for manufacturing and distribution of beer are defined by California Law, which may change from time to time.
"Buildable area"means:
A. In R zones, any portion of a lot or building site not contained in required yards and open spaces and not exceeding the maximum percentage of the total area of the lot or building site permitted to be covered by buildings as prescribed for the zone in which the lot or building site is located;
B. In C and M zones, all of the area of a lot or site not devoted to required parking, loading facilities or required open spaces; and
C. For an area contained within a site development plan, the permissible buildable area shall be governed by the applicable provisions of this title concerning yards and open spaces, off-street parking, loading and unloading facilities and facilities for ingress and egress, all as correlated and shown on the map of the site development plan, and the buildable area shall be limited to that area shown on the approved site development plan.
"Building"means any structure having a roof, but excluding all forms of vehicles even though immobilized. When a use is required to be within a building, then the term "building" means so designed and constructed that all exterior walls of the structure shall be solid from the ground to the roof line, and shall contain no openings except for windows and doors which are designed so that they may be closed for the purpose of controlling sound and for other purposes.
"Building height commercial/industrial"means the vertical distance from the average elevation of the existing grade around the building to the highest point of the coping of a flat roof, or to the deck line of a mansard roof, or to the maximum height of the highest point of a pitched roof or to the highest point of a structure as defined herein.
"Building height residential"means the vertical distance from the average elevation of the existing grade around the building to the top plate of the uppermost unit.
"Building line"means a building setback line, a property line where no setback line is required, or a future property line as established by a building line or mapped street ordinance.
Building, main. "Main building"means the principal building or structure on a lot or building site designed or used to accommodate the primary use to which the premises are devoted; where a permissible use involves more than one building or structure designed or used for the primary purpose, as in the case of group houses, each such permissible building or other structure on a lot or building site as defined by this title shall be construed as comprising a main building or structure.
"Building site"means the ground area devoted to a main building and its accessory buildings, or to a group of main buildings and their accessory buildings, together with all required yards and open spaces, and containing not less than the prescribed area for lots as required by this title, whether the area so devoted is comprised of one lot, a combination of lots, a combination of lots and fractions of lots, a portion of a lot, or a piece of unsubdivided land identified by a lot split as provided in Title 16, Subdivisions.
"Business or commerce"means the purchase, sale, offering for sale or other transaction involving the handling or disposition of any article, substance or commodity for livelihood or profit; or the management or occupancy of office buildings, offices, recreational or amusement enterprises; or the maintenance and use of offices, structures or premises by professions and trades or persons rendering services.
"Caliper"means the diameter of a newly planted tree measured at six inches above the ground.
"Cannabis business"is a business engaged in any commercial cannabis activity pursuant to local and state laws.
"Cannabis consumption area"is a licensed retail premise where cannabis may be purchased for on-site consumption only by persons twenty-one years of age and over.
"Cannabis delivery services"means the commercial transfer of cannabis or cannabis products to a customer, including the use by a retailer of any technology platform owned and controlled by the retailer.
"Cannabis distribution"means the procurement, sale, and transport of cannabis and cannabis products between licensees only, not to retail customers or medical patients.
"Cannabis manufacturer"is an establishment that conducts production, propagation, blending, infusion, or, compounding of cannabis or cannabis products either directly or indirectly by extraction methods, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis at a fixed location that packages or repackages cannabis products or labels or relabels its container.
"Cannabis product"means cannabis that has undergone a process whereby the plant material has been transformed into a concentrate. This includes, but is not limited to, concentrated cannabis, an edible or topical product containing cannabis, or concentrated cannabis with other ingredients.
"Cannabis testing laboratory"means a laboratory or facility that offers or performs tests of both adult use and medical cannabis or cannabis products and that is both of the following: (1) accredited by an accrediting body (i.e., International Organization for Standardization (ISO)) that is independent from all other persons involved in commercial cannabis activity in the state; and (2) is licensed by the Bureau of Cannabis Control.
"Canopy"means a protective cover, usually made of fabric, suspended from or attached to a self-supporting framework or structure and designed to provide protection from the elements. Shade umbrellas and awnings are not considered canopies.
"Carport"means a structure consisting of a roof supported by columns, or enclosed by walls on not more than two sides, and shall meet all other requirements for garages.
Car wash, hand. "Hand car wash"means any permanent facility where stall(s) with water-spraying devices are used for the washing of vehicles as a retail service, and where typically vacuuming services are provided. Hand car washes are further classified as either full-service or self-service car washes.
Car wash, mechanical. "Mechanical car wash"means any permanent facility where power-driven equipment, or steam-cleaning equipment are used for the washing of vehicles as a retail service. Mechanical car washes are further classified as either full-service or self-service car washes. This classification includes automatic car washes.
Car wash, self-service. "Self-service car wash"means a mechanical and/or hand car wash where facilities are provided for customers to wash their own vehicles. This classification includes a drive-through car wash where customers remain in the vehicles during washing operation.
"Charitable organization"means a nonprofit organization granted federal tax exemption pursuant to Section
501(c)(3) of the Internal Revenue Code which distributes or facilitates the giving of goods and services for the relief of the needy.
"Child care facility"means a child day care facility other than a family day care home, including, but not limited to, infant care centers, preschools, extended day care facility and school age child care centers, that provide nonmedical and supervised care on a less than twenty-four-hour basis.
"Church"means an institutional land use providing facilities for worship or assemblage of the public for worship. This definition includes cathedrals, mosques, shrines, synagogues, or temples, and other religious worship places.
"Classification"means a refined identification of uses which, either individually or as to type, are identified as possessing similar characteristics or performance standards and are permitted as compatible uses in a zone. A classification, as the term is employed in this title, includes provisions, conditions and requirements related to the permissible location of permitted uses.
Club, private. "Private club"means an association of adult persons for some common purpose, but not including groups organized primarily to render a service which is customarily carried on as a business. Private clubs shall be considered to include women's clubs, Y.M.C.A. and Y.W.C.A.
"Collection facility"means a processing facility for recyclables which has processing and storage area and has up to an average of two outbound truck shipments per day. Collection facilities for recyclables are limited to baling, briquetting, crushing, compacting, grinding, shredding and sorting of source-separated recyclable materials and repairing of reusable materials. A collection facility for recyclables shall not shred, compact or bale ferrous metals other than food and beverage containers. A collection facility does not include storage containers for clothing and does not include processing activity located on the premises of a residential use.
"Combustible"means any materials, mixture, substances, products, structures or items that are in a physical state or condition that will permit them to burn.
"Commercial cannabis activity"is any commercial activity involving retail, delivery, distribution, planting, growing, harvesting, drying, curing, grading, trimming, or testing of cannabis, as well as the manufacturing of cannabis products, except for the personal cultivation allowed for medical patients and adults under state law.
"Commercial cannabis cultivation"is any commercial activity involving planting, growing, harvesting, drying, curing, grading, or trimming of cannabis, except for the personal cultivation allowed for medical patients and adults under state law.
"Commercial coach"means a vehicle, with or without motive power, designed and equipped for human occupancy for industrial, professional or commercial purposes, and includes a trailer coach.
"Commercial daycare center"is a business that provides care and supervision to children or adults without overnight stays and is located in a commercial zone. Large and small family daycare are residential uses and are not included in this definition.
"Commercial mailing"means an activity for the exclusive purpose of conducting a commercial enterprise via mail or telephone correspondence within a dwelling.
"Community apartment project"means a project in which an undivided interest in the land is coupled with the exclusive occupancy of any apartment therein.
"Community business project"means a project in which an undivided interest in the land is coupled with the exclusive occupancy of any commercial unit therein.
"Community events permit"means a permit issued in compliance with Chapter
9.39, Community Events Permits, in its entirety. Such permits shall be required for the following:
A. An assembly on public or private property consisting of persons, animals, vehicles, or any other combination thereof, which may impact a public street, highway, alley, sidewalk or other city-owned property or public right-of-way and which: (1) may impede, obstruct, impair or interfere with free use of such public street, highway, alley, sidewalk, or other public way owned, controlled, or maintained by the city; (2) does not comply with normal or usual traffic regulations or controls; or (3) requires Los Angeles County fire department approval. Examples of such events may include recreation events, competition/contests/spectator sports, fairs, festivals, carnivals, ticketed events, or sales/trade shows;
B. Any activity or event involving fifty or more persons on property owned, leased, controlled, or maintained by the city or a school district, and not subject to the requirements of subsection
A of this section, or where the city or school district is acting strictly in a proprietary role;
C. Farmers markets, as further governed by Section
9.39.150 of this code;
D. Exemptions. An activity or event is exempt from the community event permit requirement if it falls within one of the following categories:
1. An activity or event conducted pursuant to the terms of a permit, lease, or contract which has been specifically authorized by the city council,
2. An activity or event conducted by the city of Hawthorne or the Hawthorne, Wiseburn or Centinela Valley School District, and held on its own property for a duration of no longer than two consecutive days, such as a car wash or bake sale. This specific exemption does not apply when: (a) such events on school district property impede upon any city-owned property or right-of-way, or (b) the city or school district acts strictly in a proprietary role,
3. Parades, which are governed by Chapter
9.38 of this code,
4. Events occurring at city parks or within city park facilities and buildings, which are governed by Chapter
2.24 of this code.
However, departmental service charges may still be incurred for events undertaken pursuant to this subsection to the extent otherwise authorized by this chapter and the administrative guidelines adopted pursuant to this chapter. |
Community events are exempt from the provisions of this title, however, community events shall not be permitted in a residential district, except schools, religious institutions, and places of public assembly located in such districts, as defined in this title. |
"Community industrial project"means a project in which an undivided interest in the land is coupled with the right of exclusive occupancy of any industrial unit located therein.
"Conditional use"means a use permitted in one or more classifications as defined by this title but which use, because of characteristics peculiar to it, or because of size, technological processes or type of equipment, or because of the exact location with reference to surroundings, streets and existing improvements or demands upon public facilities, requires a special degree of control to make such uses consistent with and compatible to other existing or permissible uses in the same zone or zones, and to assure such use shall not be inimical to the public interest.
"Conditional use permit"means the documented evidence of authority granted by the city to locate a use at a particular location, and the property owner or proprietor of which use is required by this title to secure such a permit before locating.
"Condominium"means an estate in real property consisting of an undivided interest in common property together with a separate interest in space in a residential, industrial or commercial building on such real property, such as an apartment, office or store. A condominium may include in addition, a separate interest in other portions of such real property. Such estate may, with respect to the duration of its enjoyment, be either: (1) an estate of inheritance or perpetual estate; (2) an estate for life; or (3) an estate for years, such as leasehold or a subleasehold.
Conforming building.A. In the R zones a "conforming building" is one designed for and suitable for residential uses as defined by the State Housing Act and the building code as they pertain to buildings to accommodate uses permitted in the zone in which the building is located, and which building also conforms to the requirements of this title in the matter of use, height, yards and area coverage and which does not contain more than the number of dwelling units prescribed for the zone in which it is located; and
B. In C and M zones, a "conforming building" is one which meets the requirements of the building code in matters of structural design and building materials and their assembly to accommodate uses permitted in commercial or industrial zones, as the case may be.
"Conforming use"means an activity the nature and type of which is permitted in the zone in which the property on which it is established is located.
"Consignment shop"means a retail establishment engaged in the re-selling of new or used items, such as antiques, clothing, furniture, books, shoes, or musical instruments, through a seller/broker (a consignee) and pays a portion of the proceeds to the owner of the merchandise (the consignor). This classification excludes pawn shops and thrift shops.
"Convenience store"means a small retail establishment that offers for sale convenience goods, such as prepackaged food items, tobacco, periodicals, hygiene items, limited over-the-counter pharmaceuticals, and household goods. Such stores typically have on-site service of food or drink items for immediate consumption.
"Coordinated entry system"means a centralized or coordinated assessment system developed pursuant to the applicable provisions of California
Government Code Section
65662, and any related requirements, designed to coordinate program participant intake, assessment, and referrals.
"Cosmetologist"can prep, style, cut and color hair on the body including tinting eyelashes. They may also perform facials and remove hair by waxing or tweezing. Their license also allows them to provide the services of a manicurist and esthetician. They may not perform procedures that penetrate the skin or affect any living tissue.
"Day care facility"means a facility other than a family day care home, including, but not limited to, infant centers, preschools, extended day care facilities, adult-care facilities and school-age child care centers, that provide non-medical and supervised care on a less than twenty-four-hour basis.
"Density bonus"means a density increase over the otherwise maximum allowable residential density under the applicable zoning ordinance and land use element of the general plan as of the date of application by the applicant to the city.
"Density bonus housing agreement"means a legally binding agreement between a developer and the city to ensure that the requirements of Chapter
17.17 are satisfied. The agreement, among other things, shall establish the number of target units, their size, location, terms and conditions of affordability and production schedule.
"Density bonus units"mean those residential units granted pursuant to the provisions of Chapter
17.17 that exceed the otherwise maximum residential density for the development site.
"Development"means any property improvement or properties as a unit with a common parking area that is contiguous to the development. A shopping center under a single or multiple ownership constitutes a development.
"Development standards"include site or construction conditions that apply to a residential development pursuant to any ordinance, general plan element, specific plan, charter amendment, or other local condition, law, policy, resolution or regulation.
"Drive-in"means an establishment which by design, physical facilities, and/or service procedures, encourages or permits customers to receive and consume goods or services, while remaining in their parked motor vehicles on the premises.
"Drive-thru"means an establishment which by design, physical facilities, and/or service procedures encourages or permits customers to receive goods or services at a driveup window or station and then leave the premises without parking their vehicles.
"Driveway"means a privately-owned and appropriately paved surface or roadway which provides vehicular access from a street to parking lots, garages, or loading facilities and includes drive aisles within parking lots.
"Dump"means an open area devoted to the disposal of refuse, including incineration, reduction or dumping of ashes, garbage, combustible or noncombustible refuse, but not including transfer stations.
"Dwelling"means a building or portion thereof designed or used primarily as living quarters for one or more families but not including hotels, motel units having no kitchens, or other accommodations for the transient public.
"Dwelling group"means three or more separate buildings on a single lot or building site, each containing one or more dwelling units.
"Dwelling unit"means one or more rooms designed for or occupied by one family for living or sleeping purposes and containing kitchen facilities for use solely by one family. All rooms comprising a dwelling unit shall have access through an interior door to other parts of the dwelling unit. A bachelor apartment constitutes a dwelling unit within the meaning of this title.
Dwelling unit, live-work. "Live-work dwelling unit"means a unit that has both living quarters and workshop space for artistic and commercial and/or light industrial activities, such as studios, parts assembly or light fabrication, and equipment repair or modification, including antiques, furniture, and the like.
Dwelling unit, multifamily. "Multifamily dwelling unit"means a building or portion thereof designed for occupancy by three or more families living independently of each other, containing three or more separate dwelling units, and constituting a single proprietary or operating unit.
Dwelling unit, primary. "Primary dwelling unit"means a separate, complete dwelling unit that is the larger of two dwelling units on a lot or parcel of land or when a single-family dwelling unit site plan proposes or contains an accessory dwelling unit.
Dwelling unit, single-family attached. "Single-family attached dwelling unit"means a dwelling unit attached to another dwelling unit on two sides by shared common walls at the lot line, with each on a separate lot and separated from any other building by open space to the front and to the rear, designed for occupancy exclusively by one family, and containing one dwelling unit. The end units are deemed single-family semi-attached dwelling units.
Dwelling unit, single-family semi-attached. "Single-family semi-attached dwelling unit"means a dwelling unit attached to another dwelling unit by a shared common wall at the lot line, with each on a separate lot and separated from any other building by open space on the side lot line opposite the common wall and by open space to the rear and to the front, designed for occupancy exclusively by one family, and containing one dwelling unit.
"Electrologists"perform services with a needle or probe to remove the hair on the body of a person using electric currents. This is the only license that allows a licensee to use a needle. They may penetrate the skin with the appropriate tools in the scope of their license, per the California Board of Barbering and Cosmetology.
"Electronic billboard"shall mean a billboard utilizing digital message technology, capable of changing the static message or copy on the sign electronically or wirelessly via computer. This includes, without limitation, billboards also known as digital billboards or LED billboards.
"Emergency shelters"means a facility that provides immediate and short-term housing for homeless persons that is limited to occupancy of six months or less. Supplemental services may include counseling and access to social programs.
"Employee housing"means any portion of any housing accommodation, or property upon which a housing accommodation is located, if both of the following factors exist:
A. The accommodations consist of any living quarters, dwelling, boardinghouse, or other housing accommodations for six or fewer employees.
B. The accommodations are maintained in connection with any work or place where work is being performed, whether or not rent is involved.
"Entirely enclosed building or structure"means a building or structure so designed and constructed that all exterior walls of the building or structure shall be solid from the ground to the roof line and containing no openings except for windows and doors which are designed so that they may be closed for the purpose of controlling sound, or for other purposes.
"Erected"means the construction of any building or structure, or the structural alteration of a building or structure, the result of which would be to change the exterior walls or roof, or to increase the square foot floor area of the interior of the building or structure.
Equipment, heavy duty. "Heavy duty equipment"means high-capacity mechanical devices for moving earth or other materials, mobile powered units including, but not limited to, carryalls, graders, loading and unloading devices, cranes, drag lines, trench diggers, tractors, augers, caterpillars, concrete mixers and conveyors, and similar devices operated by mechanical power as distinguished from manpower.
"Equivalent financial incentive"means a monetary contribution, based upon a land cost per dwelling unit value, equal to: (A) a density bonus and/or additional incentive(s); or (B) a density bonus, where an additional incentive(s) is not requested or is determined to be unnecessary.
"Estheticians"can perform facials; remove hair by tweezing or waxing. They may also apply makeup and false eyelashes. They may not perform procedures that penetrate the skin or affect any living tissue.
"Face of building"means the general outer surface not including the cornices, bay windows or other ornamental trim of any main exterior wall of the building.
"Factory-built housing"means a residential building, dwelling unit, or an individual dwelling room or combination of rooms thereof, or building component, assembly, or system manufactured in such a manner that concealed parts or processes of manufacture cannot be inspected before installation at the building site without disassembly, damage, or destruction of the part, including units designed for use as part of an institution for resident or patient care, which is either wholly manufactured or is in substantial part manufactured at an off-site location to be wholly or partially assembled on-site in accordance with building standards published in the State Building Standards Code and other regulations adopted by the State of California Commission of Housing and Community Development pursuant to
Health and Safety Code Section
19990. Factory-built housing does not include a mobile home, mobile accessory building, recreational vehicle or commercial coach as elsewhere defined.
"Family"means one or more persons living together in a dwelling unit, with common access to, and common use of all living, kitchen, and eating areas within the dwelling unit.
"Family entertainment center"means an indoor or out facility that provides interactive entertainment activities for individuals or groups and may have a full service restaurant component. Examples of interactive entertainment activities shall include, but not be limited to, arcade games, kiddy-rides, miniature golf, bumper vehicles, go-karts, music and dancing, mild thrill rides, bowling, laser tag and skating. Banquet facilities and places offering wagering or gambling are expressly not permitted under this definition.
"Farmers market"means a community event operated by an entity approved by the California Federation of Certified Farmers Markets, and devoted primarily to the distribution and sale of agricultural products, flowers and plants, prepared food, and items incidental to food growing and gardening. The term "farmers market" does not include items unrelated to agriculture and food, such as arts, crafts, clothing or antiques, or the sale or distribution of alcoholic beverages nor does it include flea markets, swap meets, auctions, open air markets, or other similarly named or labeled activities. However, community booths by the city of Hawthorne, the school district, or the county of Los Angeles will be allowed. Farmers markets shall comply with Chapter
9.39, Community Events Permits, of this code. Farmers markets under the community events permit are exempt from the provisions of this title.
"Fence"means a masonry wall, or a barrier composed of posts connected by boards, rails, panels or wire for the purpose of enclosing space or separating parcels of land. The term "fence" does not include retaining walls.
"First permitted"refers to the most restricted zone in which a particular use is indicated as a permissible use.
"Floor area"means the total floor space contained within the exterior walls of all buildings on a lot or building site, except for the space therein devoted to vents, stairways, elevator shafts, light courts, and areas within the building devoted exclusively to loading and unloading facilities and parking of motor vehicles.
"Foster family day care home"means a residence licensed by authorized public authorities, to be used to care for not more than six children by the day, with or without compensation. A foster family day care home may be considered to include a day nursery conducted on a half-day basis, when such home is licensed by authorized public authorities, provided the number of children cared for at any one time shall not exceed six.
"Freeway overlay zone" or "FO"shall mean a zone that overlays the areas adjacent to the I-405 and I-105 Freeways and shown on the official Freeway Overlay Zoning Map adopted by the city council, and that allows for the placement of new and relocated billboards that conform to this chapter and the California Outdoor Advertising Act.
"Freight forwarding"is the business of moving property from location to location for a fee wherein the hauler does not own the property being moved. Freight forwarding includes parcel delivery service.
Garage, private. "Private garage"means an accessory building or a portion of the main building, enclosed on not less than three sides and designed or used for the shelter or storage of vehicles owned or operated only by the occupants of the main building or buildings.
Garage, public. "Public garage"means a building, other than a private garage, used for the care, repair or equipment of automobiles, or where such vehicles are kept for remuneration, hire or sale.
"Gas station"means an occupancy limited to the retail sales of petroleum products and automobile accessories; waxing and polishing of automobiles; tire changing and repairing (excluding recapping); battery service, charging and replacement, but not including repair and rebuilding of batteries; radiator cleaning and flushing, but not excluding steam cleaning or repairing; installation of accessories; also including the following operations if conducted within a building: lubrication of motor vehicles, brake servicing limited to servicing and replacement of brake cylinders and brake shoes, wheel balancing, the testing, adjustment and replacement of carburetors, coils, condensers, distributor caps, fan belts, filters, generators, points, rotors, spark plugs, voltage regulators, water and fuel pumps, water hoses and wiring.
"Grade"means the natural level of the ground at any point along a building, structure or fence prior to fill or excavation.
"Health club"means a facility where individuals use equipment or space for the purpose of physical exercise. Health clubs may have locker rooms, showers, massage rooms, saunas and related accessory uses.
"Holiday decorations"mean cultural observance imagery, and strings of lights that are on display in conjunction with a state or national holidays for not more than forty-five calendar days per year (cumulative, per parcel or use) and which do not include commercial advertising messages.
"Home occupation"means an occupation or business activity which results in a product or service conducted entirely in a dwelling unit by the residents thereof, which is clearly incidental and secondary to the residential use of the dwelling unit.
"Hospital"means an institution specializing in giving clinical, temporary and emergency services of a medical or surgical nature to human patients, and licensed by state law to provide facilities and services in surgery, obstetrics and general medical practice as distinguished from treatment of mental and nervous disorders and alcoholics but not excluding surgical and post-surgical treatment of mental cases.
Hospital, emergency. "Emergency hospital"means a hospital whose primary service is to render care and treatment in acute medical or surgical cases as distinguished from hospitals rendering continuing prescribed treatment and care.
"Hotel"means an establishment containing guest rooms with access to units primarily from interior lobbies, courts, or halls and providing, for a fee, sleeping accommodations and customary lodging services, including maid service, the furnishing and upkeep of furniture and bed linens, and telephone and desk service. Related ancillary uses may include, but shall not be limited to, conference and meeting rooms, restaurants, bars, and recreational facilities.
"Housing cost"means the sum of actual or projected monthly payments for all of the following associated with for-sale target units: principal and interest on a mortgage loan, including any loan insurance fees, property taxes and assessments, fire and casualty insurance, property maintenance and repairs, homeowner association fees and a reasonable allowance for utilities.
"Housing development"means construction projects consisting of five or more residential units, including single-family, multifamily and mobile homes for sale or rent, pursuant to Chapter
17.17.
"Income household"means households whose income does not exceed the following income limits:
A. Very low income household is a household with income that does not exceed fifty percent of the median family income of Los Angeles County;
B. Lower income household is a household with income that does not exceed eighty percent of the median family income of Los Angeles County;
C. Moderate income household is a household with income that does not exceed one hundred twenty percent of the median family income of Los Angeles County.
"Institution"means an establishment maintained and operated by a society, corporation, individual, foundation or public agency for the purpose of providing charitable, social, educational or similar services to the public, groups or individuals.
"Intercity transportation business"means an express corporation, freight forwarder, motor transportation broker, or person or corporation owning or operating motor vehicles in the transportation of property for hire upon the public highways, under the jurisdiction of the public utilities commission. For purposes of this chapter, intercity transportation business includes every service performed in connection with the transportation of property by such transportation companies where both the origin and destination points of such transported property are not with the exterior boundaries of the city of Hawthorne.
"Junkyard"means any premises devoted wholly or partially to the storage, buying or selling or otherwise handling or dealing in old rags, sacks, bottles, cans, papers, metal, rubber or other articles commonly known as junk.
"Kennel"means a place where four or more adult dogs or cats or any combination thereof are kept, whether by owners of the dogs and cats or by persons providing facilities and care, including bathing, clipping and boarding, whether or not for compensation. An adult dog or cat is one of either sex, altered or unaltered, that has reached the age of four months.
"Kitchen"means any room or portion of room used or intended or designed to be used for cooking or the preparation of food.
"Landscaping"shall include lawns, trees, bushes and groundcover in area designed to be permanently maintained and irrigated for vegetation growth.
"Lighter uses"mean uses involving performance standards having less detrimental effect upon surrounding properties and uses in the same or other classifications than do uses first permitted in a next succeeding classification in terms of nuisance, hazard, generation of traffic and volume of traffic, both passenger and freight, and which uses make less demand upon public services such as electricity, gas, sewers and streets. Where residential uses are involved, the term "lighter uses" mean less permitted population density, possibly greater required yards, open spaces and floor area within dwellings than is permitted or required in the next succeeding residential classification.
"Loading position/area"shall be defined as not less than ten linear feet of dock or opening with direct access to the interior of a building or other shelter, including trailers or an opening that is greater than four feet in width and a height greater than six feet eight inches. Loading positions shall be a minimum of eleven feet wide by sixty-five feet in length. A minimum forty foot clear area shall be required in front of a loading position for access. Loading positions with less than eight feet of unobstructed space directly in front of them shall not be counted. Loading positions with a ramp in front of them that prevent truck access to the interior of a building shall not be counted. "Obstructions" are defined as permanent immovable objects that prevent access over or through the obstruction by vehicles, equipment, property or products other than people walking.
"Loading space"means an on-site space or berth on the same lot or site with the buildings or use served, such space to serve for the temporary parking of a vehicle while loading or unloading merchandise, materials or passengers.
"Lot"means:
A. A delineated unit of land with a number or other designation on a plat recorded in the office of the county recorder of Los Angeles County; or
B. Any unit of land containing not more than one acre which was of record as a separate unit on the effective date of the ordinance codified herein and which abuts one or more public thoroughfares and has direct legal access to at least one of such thoroughfares, or a unit of land not contiguous to a public thoroughfare but having access to a public thoroughfare by other means as provided in Title 16, Subdivisions on the private street ordinance; or
C. Any approved unit of land legally created subsequently to the effective date of the ordinance codified herein and containing not less than the minimum lot area and width required by the zone in which the property is located and having frontage on a public-dedicated street or a private street.
"Lot area"means the total horizontal area within the boundary lines of a lot.
Lot, corner. "Corner lot"means a lot situated at the intersection of two or more streets, the street frontages of which lot form an angle not greater than one hundred twenty-eight degrees, and not less than forty-five degrees.
"Lot depth"means the horizontal length of a straight line drawn from the midpoint of the lot front line and at right angles to such line to its intersection with a parallel line passing through the midpoint of the lot rear line. In the case of a lot having a curved front line, the lot front line, for purposes of this section, shall be deemed to be a line tangent to the curve and parallel to a straight line connecting the points of intersection of the lot side lines of the lot with the lot front line.
Lot, key. "Key lot"means the first lot to the rear of a reverse corner lot and whether or not separated by an alley.
Lot line, front. "Front lot line"means, in the case of an interior lot, the boundary line separating the lot from the street. In the case of a corner lot and reverse corner lot, the lot front line shall be the line separating the narrowest street frontage of the lot from the street. In the case of corner lots or reverse corner lots having equal street frontages, that property line the prolongation of which creates the front property line for the greatest number of interior lots in the same block shall be considered as the lot front line of such corner or reverse corner lot.
Lot line, rear. "Rear lot line"means a lot line which is opposite and most distant from the lot front line. For the purpose of establishing the lot rear line of a triangular or trapezoidal lot, or of a lot the rear line of which is formed by two or more lines, the following shall apply:
A. For a triangular or gore-shaped lot, a line ten feet in length within the lot and farthest removed from the lot front line and at right angles to the line comprising the depth of such lot shall be used as the lot rear line;
B. In the case of a trapezoidal lot for the rear line of which is not parallel to the lot front line, the rear line shall be deemed to be a line at right angles to the line comprising the depth of such lot and drawn through a point bisecting the recorded rear lot rear line; or
C. In the case of a pentagonal lot the rear boundary of which includes an angle formed by two lines, such angles shall be employed for determining the lot rear line in the same manner as prescribed for a triangular lot;
D. In no case shall the application of the above be interpreted as permitting a main building to locate closer than three feet to any property line.
Lot, reverse corner. "Reverse corner lot"means any corner lot the side street line of which is substantially a continuation of the lot front line of the lot upon which the rear of said reverse corner lot abuts.
Lot, through. "Through lot"means a lot having frontage on two streets, including a lot at the intersection of two streets when the street sides of such lot form an internal angle of less than forty-five degrees. Corner lots and reverse corner lots, as defined in this title, are not through lots.
Lot, transitional. "Transitional lot"means a residential classified lot, a side line of which forms a common boundary with contiguous property, classified for either a higher density residential use or commercial or industrial uses.
"Lot width"means the horizontal distance between the lot side lines measured at right angles to the line comprising the depth of the lot at a point midway between the lot front and rear lines. The length of the line constituting the rear line of the required front yard shall never be less than the lot width required in the zone in which the property is located.
"Low barrier"means best practices to reduce barriers to entry for people entering temporary living facilities and shelters. Low barrier practices may include, but are not limited to:
A. Accommodating the presence of partners if it is not a population-specific site, such as for survivors of domestic violence or sexual assault, women, or youth.
C. Providing for the secure storage of personal possessions.
D. Accommodating personal privacy, such as providing partitions around beds in a dormitory setting or in larger rooms containing more than two beds, or private rooms.
"Low barrier navigation center"means a housing first, low-barrier, service-enriched shelter focused on moving people into permanent housing that provides temporary living facilities while case managers connect individuals experiencing homelessness to income, public benefits, health services, shelter, and housing pursuant to
California Government Code Sections 65660-65668.
"Major retail commercial center"means a retail commercial center developed as a single project which is in excess of one hundred seventy-five thousand square feet in gross land area. A retail project for which there is an executed development agreement with the city or the city's redevelopment agency shall also be considered a major retail commercial center.
"Major supermarket"means a supermarket or grocery center which has in excess of twenty-five thousand square feet of gross floor space, and at least eighty percent of annual gross receipts are from the sale of non-alcohol merchandise.
"Manicurists"can give manicures and pedicures and apply false nails (using gel, acrylic or selk). Their licenses limit their contact to the hand and foot area only. They may not perform procedures that penetrate the skin or affect any living tissue.
"Manufacturing"means uses conducted within an enclosed building that includes fabricating, assembling, testing, repairing, servicing or processing products where the nature of the operation is not obnoxious or offensive by reason of emission of odor, dust, noxious gas, noise, vibration, glare, heat or other adverse environmental impacts.
"Marijuana (including medical and non-medical)"means all parts of the plant Cannabis, whether growing or not, with a THC concentration greater than 0.3 percent on a dry weight basis; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin.
"Martial arts studio"means place in which an individual or group for sport, recreation or for purposes of learning, participate in any of the various philosophies of self-defense and techniques of single combat.
"Massage"means any method of pressure on or friction against, or stroking, kneading, rubbing, tapping, pounding, or stimulating the external parts of the body, with or without the aid of any mechanical or electrical apparatus or appliances, or with or without supplementary aids such as rubbing alcohol, liniments, antiseptics, oils, powder, creams, lotions, ointments, or other similar preparations commonly used in this practice.
"Massage establishment"means any establishment having a fixed place of business or vehicle where any person engages in, conducts, carries on or permits to be engaged in, conducted or carried on as regular functions any of the activities mentioned in Chapter
5.58 of this code. Any establishment engaging in or carrying on, or permitting any combination of massage and health treatment or bathhouse, showers, hot tubs, saunas or other dry or wet heat shall be deemed a massage establishment.
"Maximum allowable residential density"means the density allowed under the zoning ordinance, or if a range of density is permitted, it means the maximum allowable density for the specific zoning range applicable to the project.
"Medical-dental building or buildings"mean a building or group of buildings designed for the use of and occupied and used by physicians and dentists and others engaged professionally in such healing arts for humans as are recognized by the laws of the state, including medical clinics; the installation and use of therapeutic equipment, x-ray equipment or laboratories; chemical, biochemical and biological laboratories used as direct accessories to the medicaldental professions: dental laboratories including facilities for the making of dentures on prescription; pharmacies limited to the retail dispensing of pharmaceuticals and sick room supplies (but not room, orthopedic equipment or furniture); provided, there shall be no exterior display windows or signs pertaining to such accessory uses other than a directory sign.
"Medical-dental clinic"means an establishment for treatment of outpatients, and providing no overnight care for patients.
"Mobile home"means a structure transportable in one or more sections, designed and equipped to contain no more than one dwelling unit and to be used with or without a foundation system. A mobile home does not include a recreational vehicle, commercial coach or factory-built housing as elsewhere defined.
"Mobile home park"means any area or tract of land where two or more mobile home spaces or lots are rented or leased or held out for rent or lease to accommodate mobile homes for human habitation.
"Mobile recycling unit"means an automobile, truck, trailer or van, licensed by the Department of Motor Vehicles, which is used for the collection of recyclable materials. A mobile recycling unit also means the bins, boxes or containers transported by trucks, vans, or trailers, and used for the collection of recyclable materials. A mobile recycling unit shall not occupy an area of more than five hundred square feet and shall not be allowed overnight.
"Motel"means a building or series of buildings in which lodging is offered for compensation, and which is distinguished from a hotel primarily by reason of providing direct independent access to, and adjoining parking for, each room. In addition, an establishment shall be considered a motel when it is required by the
Health and Safety Code of the state to obtain the name and address of the guests, the make and the license number of the vehicle and the state in which it was issued.
"Multifamily development"means any building or portion thereof which contains three or more dwelling units including planned unit developments and condominiums.
"Natural surveillance"means increasing the opportunity for people who are in or near public or common spaces to be easily seen.
"Nonconforming"describes a land use, structure, sign, or parcel that was lawfully established before a zoning regulation took effect, with which the subject use, structure, sign, or parcel does not comply.
"Non-restricted unit"means all units within an affordable housing development excluding the target units.
"Off-sale alcohol license"means an alcohol license issued by the state of California which authorizes the sale of alcoholic beverages for consumption off the premises where sold.
"Off-sale CUP"means a conditional use permit issued to allow a use which operates under an off-sale general or off-sale beer and wine license.
"On-sale alcohol license"means an alcohol license issued by the state of California which authorizes the sale of alcoholic beverages for consumption only on the premises where sold.
"On-sale CUP"means a conditional use permit issued to allow a use which operates under an on-sale general license, an on-sale beer and wine license, or an on-sale beer license; it shall not include operations under club license.
"Open space"means a portion of the area of a lot or building site, other than required yards, which area is required by this title, as set forth in the different classifications contained herein, to be maintained between buildings, between wings of a building and between buildings and any portion of a property boundary line not contiguous to a required front or side yard. Such open spaces, as in the case of required yards, are required to be free and clear of buildings and structures and to remain open and unobstructed from the ground to the sky.
Open space, active. "Active open space"means a common open space that may be improved and set aside, dedicated, designated, or reserved for recreational activities. Such spaces may contain amenities such as tot lots, pool areas, cabanas, multi-purpose courts or similar improvements.
Open space, common. "Common open space"means a space within a residential or mixed use development that may be improved and set aside, dedicated, designated, or reserved for the exclusive use of residents of a development and their guests.
Open space, passive. "Passive open space"means a common open space that may be improved and set aside, dedicated, designated, or reserved for recreational activities. Such spaces may contain amenities such as accessible landscaping and outdoor seating areas or similar improvements.
Open space, private. "Private open space"means a usable open space adjoining and directly accessible to a dwelling unit, reserved for the exclusive recreational use of residents of the dwelling unit and their guests. Private open space may include patios and landscaped areas but does not include required parking areas, common, or public open areas.
"Operator"shall be defined as a party or a property owner engaged in a trucking use.
"Outdoor advertising display"means any card, paper, cloth, metal, glass, wooden or other display or device of any kind or character whatsoever placed or painted for outdoor advertising purposes on the ground or on any tree, wall, fence, rock, structure or thing whatsoever.
"Outdoor advertising structure"means a structure of any kind or character erected or maintained for outdoor advertising purposes upon which any outdoor advertising display is, or can be placed.
"Outdoor dining"means outdoor dining facilities that are associated with and in the immediate vicinity of a restaurant, café, or other permitted establishment that serves food or drinks for on-site consumption. Outdoor dining includes areas on public property or in the public right-of-way, where allowed by encroachment permit, as well as on private or semiprivate property.
"Parcel"means any piece of land as defined herein as a lot.
"Parcel delivery service"is the business of delivery or moving of mail, parcels, packages, and/or property from location to location and other similar activities, for a fee wherein the hauler does not own the property being moved.
Parking area, private. "Private parking area"means an open area other than a street, alley or other public property, limited to the parking of automobiles of occupants or employees of a dwelling, hotel, motel, apartment hotel, apartment house, boardinghouse, lodging house, commercial or industrial establishment to which those facilities are appurtenant.
Parking area, public. "Public parking area"means an open area other than a street, alley or private parking area, which open area has as its primary purpose the providing of parking facilities for the general public, with or without a charge. Parking facilities provided by a public agency shall be considered as being public parking areas.
"Parking space"means an area accessible to vehicles which is provided, improved, maintained and used for the sole purpose of accommodating a motor vehicle.
"Person"means any individual, firm, association, corporation, governmental agency or political subdivision.
"Personal cosmetic services"can provide services for beautification only. They may not perform procedures that penetrate the skin or affect any living tissue (with the exception of the electrologist, who may penetrate the skin with the appropriate tools in the scope of their license). Specifically included are barbers, cosmetologists, estheticians, manicurists, electrologists, make-up consultants, make-up artists, and skin care consultants.
"Pet shop"means an establishment dealing in buying and selling small animals and birds, such as are customarily or occasionally harbored in domestic establishments as pets, such as fish, dogs, cats, parrots, canaries and other song and decorative birds, monkeys, hamsters and similar animals, but specifically excluding dangerous animals, fish or birds or dangerous or poisonous or constricting reptiles. No boarding or veterinarian services are permitted excepting bathing and clipping of dogs and cats.
"Planned unit"means an estate in real property consisting of an undivided interest in common in a portion of a parcel of real property together with a separate interest in a residential, commercial or industrial building, or a portion thereof, and the ground upon which such building, or portion thereof, is located on such real property, such as an apartment, office, store, or industrial use. A planned unit may include in addition, a separate interest in other portions of such real property, including buildings, or portions thereof.
"Porte cochere"means a structure that may be placed over a driveway in a side yard; provided, such structure is not more than one story in height, is unenclosed on at least three sides and is entirely open except for the necessary supporting columns and reasonable architectural features and where said driveway is leading to the required garaging facility.
"Price point store"and/or "variety store" refers to a store that sets a single price for all items or a limited number of prices for items sold.
"Principal use"means the primary or predominant use to which the property is devoted, and to which all other uses on the premises are accessory.
"Professional offices"mean offices maintained and used as a place of business conducted by persons engaged in the healing arts for human beings, such as doctors and dentists (but wherein no overnight care for patients is given) and by engineers, attorneys, accountants and architects and other persons providing services utilizing training in and a knowledge of the mental disciplines as distinguished from training in occupations requiring mere skill or manual dexterity or the handling of commodities whether tangible or intangible.
"Public utility"means a private business organization such as a public service corporation performing some public service and subject to special governmental regulations, or a governmental agency performing similar public services, the services by either of which are paid for directly by the recipients thereof. Such services shall include, but are not limited to, water supply, electric power, gas, transportation for persons and freight.
"Qualified street frontage"for signing purposes, means the total street frontage of property fronting on a public right-of-way, not to include freeways or alleyways. Private streets that are legally recorded on a parcel or tentative tract map or official city map shall also qualify as street frontage.
"Qualifying resident"means senior citizens or other persons eligible to reside in senior citizen housing.
"Rear line of the required front yard"means a line parallel to the lot front line and at a distance therefrom equal to the depth of the required front yard, and extending across the full width of the lot.
"Reclassification of property"means a change in zone boundaries upon the zoning map, which map is a part of this title when adopted in the manner prescribed by law.
"Reclassification of use"means the assignment, by amendment of this title, of a particular use to a different use classification than that in which the use was originally permitted.
"Recorded"means to be contained in the public file, or registered with the county recorder of the county of Los Angeles, state of California, unless otherwise stated in this title.
"Recreational vehicle"means a motor home, travel trailer, truck camper or camping trailer, with or without motive power, designed for human habitation for recreational or emergency occupancy, with a living area less than two hundred twenty square feet, excluding built-in equipment such as wardrobes, closets, cabinets, kitchen units or fixtures, bath and toilet rooms.
"Recreational vehicle park"means any area or tract of land where one or more spaces or lots are rented or leased or held out for rent or lease to owners for uses of recreational vehicles and which are occupied for temporary human habitation.
"Recycling facility"means a center for the collection or processing of recyclable materials. Recycling facilities include collection facilities, mobile recycling units, retail collection facilities and reverse vending machines for recyclables. A recycling facility does not include storage containers located on the premises of a residential, commercial, or manufacturing use.
"Regional shopping center"means a retail shopping area planned and designed to function as a single contiguous complex with a varying number or retail outlets located on not less than twenty acres of land. The shopping complex may be retained under one ownership, or be subdivided into separate ownerships, provided the retail outlets located therein are interrelated and serve as a single planned complex.
"Residence"means a building or structure, or portion thereof, which is designed for or used to provide a place of abode for human beings, but not including hotels or motel units having no kitchens. The term "residence" includes the term "residential" as referring to the type of, or intended use of, a building or structure.
Residential care facility, large."Large residential care facility" means a community care facility licensed for the 24-hour care of seven or more persons requiring personal services, supervision, protection, or assistance with daily tasks pursuant to the California
Health and Safety Code Section
1500 et seq. Amenities may include shared living quarters, with or without a private bathroom or kitchen facilities. This definition does not include a rest home, sanatorium, boardinghouse, or lodging house.
Residential care facility, small."Small residential care facility" means a licensed community care facility for the 24-hour care of six or fewer persons requiring personal services, supervision, protection, or assistance with daily tasks pursuant to the California
Health and Safety Code Section
1500 et seq. Amenities may include shared living quarters, with or without a private bathroom or kitchen facilities. This definition does not include a rest home, sanatorium, boardinghouse, or lodging house.
"Rest home and home for the aged"mean homes operated as boarding homes, the operator of which is licensed by the state or county to give special care and supervision to his or her charges, and in which nursing, dietary and other personal services are furnished to invalids and aged persons but in which are kept no persons suffering from a mental sickness, disease, disorder or ailment or from a contagious or communicable disease, and in which are performed no surgery, maternity or other primary treatments such as are customarily provided in sanitariums or hospitals, or in which no persons are kept or served who would normally be admittable to a mental hospital.
"Retail collection facility"means a recycling facility completely enclosed within a building used for the collection and processing of recyclable materials. Processing means the preparation of material for efficient shipment, or to an end-user's specifications, by such means as baling, briquetting, compacting, flattening, grinding, crushing, sorting, shredding and cleaning.
"Retaining wall"means any wall used to resist the lateral displacement of any solid material.
"Reverse vending machine"means an automated mechanical device, similar in size and appearance to a soda vending machine, which accepts empty recyclable beverage containers and issues to the consumer, based upon the number of containers deposited or by weight a cash refund or a redeemable credit slip with a value not less than the container's redemption value as determined by the state.
"Roof"means a structural covering over any portion of a building or structure or open area, including the projections beyond the walls or supports of the building or structure. An open work covering shall not be considered a roof if the upper surface area of the component solid portions thereof, measured on the horizontal plane, does not exceed twenty percent of the area of the covering.
"Room"means an unsubdivided portion of the interior of a dwelling unit excluding bathrooms, closets, hallways and service porches.
"Row houses"mean multiple dwellings built in sequence, which multiple dwellings are designed for occupancy by three or more families living separately from each other with the dwelling units separated from each other by common walls on not to exceed two sides, which sides shall be opposite from each other.
"Rumpus room, recreation room or family room"means a room or an area within a dwelling, or in a building accessory to a dwelling, designed, equipped or used as a recreation room, but which room shall not be used as a separate dwelling unit.
"Sanitarium, convalescent home, nursing home and convalarium"mean establishments providing long-term care medical facilities for human patients, but not including alcoholics, drug addicts, persons with mental diseases or communicable diseases. Such establishments shall be licensed by state agencies under provisions of law, and shall perform no surgery, maternity or other primary treatments such as are customarily provided in hospitals.
"Seat wall"means a permanent structure with a minimum dimension of two feet in width and two to three feet in height and at least twelve inches in depth. Constructed of block and/or concrete and capped with a smooth surface. Anti-skating deterrents are permissible.
"Self-storage"means a facility in which storage space, such as rooms, lockers, containers, and/or outdoor space (also known as "storage units") is rented to tenants, usually on a short-term basis (month-to-month). Self-storage facilities may include an on-site unit for a caretaker.
"Senior citizen housing project"means a housing development consistent with the California Fair Employment and Housing Act (
Government Code Section
12900 et seq., including
12955.9 in particular), which has been "designed to meet the physical and social needs of senior citizens," and which otherwise qualifies as "housing for older persons" as that phrase is used in the Federal Fair Housing Amendments Act of 1988 (P.L. 100—430) and implementing regulations 24 CFR, part
100, subpart E, and as that phrase is used in California
Civil Code Sections
51.2 and 51.3.1.
"Shipping container"means a type of equipment used in freight transport and for storage of materials. Shipping containers are approximately eight feet wide by eight feet high, and vary in length from ten feet to fifty-three feet. Storage containers are typically smaller. Containers are usually made to be stacked on top of each other and typically have access doors on the narrow ends.
"Shopping centers"mean commercial multiple-tenant facilities where parking is not determined by the respective requirements of each individual tenant and the center is predominantly retail commercial use.
Shopping centers, strip. "Strip shopping centers"mean any developments with a site area of less than one hundred thousand square feet, which is to be improved with more than one retail store, shop, business, service or with the structure or structures located within eighteen feet of the rear lot line and/or side lot line, and with surface parking situated between the structure or structures and the street or rear property line.
"Sign"means a display board, screen, structure, object or part thereof, used to announce, declare, demonstrate, display or otherwise advertise and attract the attention of the public to any business, service, product provided on the premises upon which such sign is placed, or to convey other information. See "Sign copy."
"Sign area"means the total face area within the perimeter of the sign, including all open spaces. The area of a sign with two faces approximately opposed shall be that of the larger face, or if each face is equal in area, the computed area shall be that of one face. For three sided signs, the computed area shall be the sum of the two largest faces. For multi-sided signs, the area shall be the sum of all faces divided by two. For spherical signs the computed area shall be of the circumference. In all other cases the sign area shall be calculated by the area of the silhouette, subject to the approval of the planning director.
"Sign copy"means any graphics, letters, numbers, symbols, insignia, text, model, device or combination thereof which is intended to inform, advertise, identify, notify, or otherwise transmit information.
Sign copy, noncommercial. "Noncommercial sign copy"means that the copy consists of commentary or advocacy on topics of public debate and concern. By way of example and not limitation, "noncommercial copy" typically are expressions of opinions on matters of religion, politics, public policy, arts, etc. Noncommercial copy does not have a location factor, such as on-site or off-site.
Sign, electronic message center (EMC). "Electronic message center (EMC) sign"means an on-premises sign or portions of a sign, capable of displaying words, symbols, figures, or images that can be electronically changed by remote or automatic means. The elements may be internally illuminated or may be illuminated by reflected light. The sign may be a portion of a permanent sign that is not an electronic message center. EMCs are not digital billboards.
Sign, flashing and/or blinking. "Flashing and/or blinking sign"means a sign with any continuous or sequential flashing operation that does not change faces, with or without a pattern of changing light illumination where the sign illumination alternates suddenly between fully illuminated and fully non-illuminated for the purpose of drawing attention to the sign.
Sign, freestanding. Freestanding sign"means a sign, over six feet in height, that is attached to the ground and not to a building and supported by one or more posts, columns, or other visible vertical support structures.

Sign, institutional flag. "Institutional flag sign"means a wind-activated sign made of durable cloth or similar non-rigid material which contains a message that is an inherently distinctive symbol for a particular government jurisdiction or nonprofit organization.
Sign, monument. "Monument sign"means any sign typically supported by a solid base and by an internal structural framework or integrated into landscaping or other solid structural features other than support poles. Any groundmounted sign over six feet in height is a freestanding sign.

"Sign, off-premises, off-site, outdoor advertising or billboard"means a sign that identifies, advertises or attracts attention to a business, product, service, event, or activity sold, existing, or offered at a different location (subject to the qualifications stated in the definition of "on-premises sign"). This includes, but is not limited to, building graphics, supergraphics, building wraps, and wall drop signs containing off-site messages, and billboards painted or applied to building walls. The terms off-premises, outdoor advertising or billboard may be used interchangeably to mean the same thing. However, the off-premises/on-premises distinction applies only to commercial copy.
Sign, on-premises or on-site. "On-premises or on-site sign"means any sign or portion thereof, that identifies, advertises, or attracts attention to a business, product, service, event, or activity sold, existing, or offered upon the same property or land use as the sign. The off-premises/on-premises distinction applies only to commercial copy. In the case of multiple tenant commercial or industrial developments, a sign is considered "on-premises" whenever it is located anywhere within the development. In the case of a duly approved sign program or specific plan, a sign placed at any location within the area controlled by the sign program or specific plan is "on-premises."
"Sign, painted-on-the-wall."means any sign painted directly onto the wall surface of a building as an on-premises or on-site sign and does not include supergraphics.
Sign, political. "Political sign"means a sign stating the name and/or picture of an individual seeking election or appointment to a public office, or pertaining to a forthcoming public election or referendum, or pertaining to or advocating political views or policies.
Sign, roof. "Roof sign"means any sign which extends above the height of the roof and is attached to and supported wholly or primarily by or through the roof of a building, excepting eaves.
Sign, temporary banner. "Temporary banner sign"means a sign that is made of durable cloth, plastic or similar non-rigid material, extending across a wall, building or space bearing a message, emblem, or slogan for advertising a product, activity, service or event and that is displayed only for a short period of time as regulated in this title. This definition shall not include real estate signs, political signs or institutional flags.
Sign, temporary decorative flag. "Temporary decorative flag sign"means a sign or string of signs that are made of cloth, plastic or similar non-rigid material, extending across a wall, building or space, that either displays no message or displays only a predominately pictorial message that does not directly identify or advertise a business on the premises, or any goods or services for sale on the premises, and that is displayed only for a short period of time as regulated in this title. This definition shall not include real estate signs, political signs or institutional flags.
Sign, temporary portable. "Temporary portable sign"means any sign that is self-supporting and not permanently attached to the ground or other permanent structure including, but not limited to, A-frame or T-frame signs, umbrellas used for advertising and menu and sandwich board signs, that are displayed only for a short period of time as regulated in this title. This definition shall not include real estate signs, political signs, or the use of portable umbrellas used in conjunction with eating establishments.
Sign, temporary window. "Temporary window sign"means a sign that is displayed on the surface of any glass or glazed material, or that is displayed in the interior and is within six feet of a window to be reasonably visible from out-side the window and that is made of water, soluble paint, cloth, paper, plastic or similar light material without frames, and that is displayed only for a short period of time as regulated in this title. This definition shall not include real estate signs or political signs.
Sign, vehicle. "Vehicle sign"means a display board, screen structure, object or part thereof, which is affixed, attached to or upon a vehicle, used to announce, declare, demonstrate, display or otherwise advertise and attract the attention of the public to any business, service or product; except however, artwork, graphics, sign or other written or pictorial message which is permanently placed upon or affixed to a vehicle and which is incidental to the usual and customary use of the vehicle, shall not constitute a vehicle sign.
Sign, wall. "Wall sign"means any sign painted on, attached to, or from and parallel to the wall surface of a building, including awnings with sign copy.
"Single-room occupancy"means a facility providing five or more units intended or designed to be used, rented, or hired out to be occupied for sleeping purposes, generally for one person per unit for at least 30 consecutive days. Individual units typically share communal features such as kitchen, bathroom, and entertainment area.
"Small-format grocery store"means a supermarket or grocery center which has between eight thousand and twenty-five thousand square feet of gross floor space and at least eighty percent of annual gross receipts are from the sale of non-alcohol merchandise. Does not include convenience, price point and/or variety stores.
"Smog check only"means a facility that provides state-licensed smog check services and does not also provide repair services.
"Snacks"mean light quick meals which generally do not require any or minimal on-site preparation. Snacks include, but are not limited to, popcorn, nuts, candy, chips, salsa, and dips.
"Solar panel"means an array of devices for extracting and converting the energy in sunlight into a more usable or storable form.
"Stand"means a structure for the display and sale of products with no space for customers within the structure itself.
"Stock cooperative"means a corporation which is formed or availed of primarily for the purpose of holding title to either in fee simple or for a term of years, improved real property, if all or substantially all of the shareholders of such corporation receive a right of exclusive occupancy in a portion of the real property, title to which is held by the corporation, which right of occupancy is transferable only concurrently with the transfer of the share or shares of stock in the corporation held by the person having such right of occupancy.
"Storage positions"mean spaces which shall be a minimum of eleven feet by fifty-three feet for trailers, eleven feet by seventy feet for trailers with tractors, and eleven feet by thirty feet for truck/tractors.
"Story"means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above it. If there is no floor above it, then the space between the floor and the ceiling next above it shall be considered a story. If the finished floor level directly above the basement or cellar is more than six feet above grade, for more than fifty percent of the total perimeter or is more than twelve feet above grade at any point, such basement or cellar shall be considered a story.
"Street"means a public or recorded private thoroughfare which affords primary means of access to abutting property, or a thoroughfare providing secondary means of access but having a width not less than forty feet.
"Street line"means the boundary line between a street and the abutting property.
"Structural alterations"mean any changes to a structure, including the supporting members of a sign, and including, but not limited to, foundations, bearing walls, upright supports, beams, floor or roof joists, girders or rafters, or change in the exterior dimension of a sign or sign structure.
"Structure"means anything constructed in the ground, or anything erected which requires location on the ground, or is attached to something having location on or in the ground, but not including fences or walls used as fences six feet or less in height, or paved areas.
"Studio"means a place in which individuals or groups participate in or are trained in any of the various forms of the arts, including, but not limited to, dance, music, painting, sculpture, photography and video production. Studios may also be used for performances and exhibitions of the works taught or created on site. For martial arts, yoga, exercise and other related studios, see "Health club."
"Supergraphics"means a sign containing off-site advertising, and consisting of an image that is applied to and integrated with a wall, or projected onto a wall, or printed on vinyl, mesh, or any other material not enclosed in a rigid frame. The term "supergraphic" shall also include signs known as "building wraps."
"Supportive housing"means housing with no limit on length of stay, that is occupied by the target population, and that is linked to on-site or off-site services that assist the supportive housing resident in retaining the housing, improving their health status, and maximizing their ability to live and, when possible, work in the community.
"Supportive safety design"means utilization of site design and features that express ownership, including fences, pavement treatments, art, signage and landscaping, that aid in efficiency of safety services.
"Take-out"means a food sales or service establishment which by design, physical facilities, and/or service procedures predominantly encourages or permits customers to receive goods or services at a walk-up window or station but does not provide for or encourage consumption on the premises.
"Target population"is defined in California
Health and Safety Code Section
53260(d), and may include persons with disabilities, families with children, elderly persons, young adults aging out of the foster care system, individuals exiting from institutional settings, veterans, homeless families, and homeless youth.
"Target unit"means a dwelling unit within an affordable housing development which will be reserved for sale or rent to moderate, lower or very low income households, or qualifying residents.
"Tasting room"means a separate area on the alcoholic beverage manufacturer's licensed premises maintained and operated by and for an alcoholic beverage manufacturer, wherein alcoholic beverages may be sold and served by an employee or designated representative of the alcoholic beverage manufacturer to consumers of legal drinking age for consumption on the alcoholic beverage manufacturer's licensed premises. The alcoholic beverages served shall be limited to the products that are authorized to be sold by the alcoholic beverage manufacturer under its license issued by the California Department of Alcoholic Beverage Control. Alcoholic beverages manufactured elsewhere may not be sold in the tasting room or on the alcoholic beverage manufacturer's licensed premises.
"Tattoo"means an art form involving in which pigments are inserted under the surface of the skin of a human being by pricking with a needle or otherwise to produce an indelible mark or figure visible through the skin.
"Thrift shop"means a retail establishment operated by a nonprofit/charitable organization granted federal tax exemption pursuant to Section
501(c)(3) of the Internal Revenue Code and is engaged in selling donated used merchandise, such as clothing, shoes, household furnishings and appliances, books, magazines, and sports/recreational equipment. This classification does not include the selling of motor vehicles, auto parts, and accessories.
"Tobacco specialty store"means a retail store where more than twenty percent of the annual gross receipts are from the sale of tobacco products (including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco and smokeless tobacco) and smoking paraphernalia.
To place.The verb and any of its variants as applied to advertising displays and outdoor advertising structures, includes maintaining, erecting, constructing, posting, painting, printing, nailing, gluing or otherwise fastening, affixing or making visible in any manner whatsoever.
"Trade school"means a school established to provide for the teaching of employment related skills. This definition applies to schools that are owned and operated privately for profit and that do not offer a complete educational curriculum (e.g., beauty school, modeling school, nursing school). Incidental instructional services in conjunction with another primary use shall not be considered a business and trade school.
Trade school, commercial. "Commercial trade school"means a specialized instructional establishment that provides on-site training of business, commercial, or trade conducted as commercial enterprises including but not limited to teaching culinary arts, barbering, hairdressing, medical care, billing and office/computing skills. This classification excludes establishments providing training in an activity that is not otherwise permitted in the zone.
Trade school, industrial. "Industrial trade school"means a specialized instructional establishment that provides on-site training of trade and/or industrial skills in which machinery is employed as a means of instruction such as welding, warehouse, and trucking and mechanical repair. This classification excludes establishments providing training in an activity that is not otherwise permitted in the zone.
"Transitional housing"means a development with buildings configured as rental housing developments, but operated under program requirements that call for the termination of assistance and recirculation of the assisted unit to another eligible program recipient at some predetermined future point in time, which shall be no less than six months.
"Travel trailer"means a vehicle other than a motor vehicle, which is designed or used for human habitation and which may be moved upon a public highway without violating any provisions of the
California Vehicle Code.
"Travel trailer park"means any area or tract of land or a separate designated section within a mobile home park where one or more spaces or lots are rented or leased or held out for rent or lease to owners or users of travel trailers and recreational vehicles used for travel or recreational purposes and for temporary human habitation.
"Treatment/recovery facility"is a residential or commercial facility that holds a license from the Department of Health Care Services (DHCS) to deliver drug or alcoholism recovery or treatment services.
"Tree"means any woody perennial plant, whether coniferous or deciduous, of a species which normally reaches a height of eight feet or more at maturity.
"Truck"shall be defined as a commercial motor vehicle pursuant to Section 15210(b) of the state of
California Vehicle Code and includes trucks, truck/tractor, truck tractor with trailer or semi-trailer, semi-trailer and trailer, excluding vans and pick-up trucks under three fourth ton capacity.
"Trucking uses"are defined as freight forwarding, intercity transportation business, parcel delivery service and warehouse/distribution center as defined in this chapter.
"Truck position"shall be defined as either a loading position or a storage position.
"Unlisted uses"mean uses which are not specifically named as permitted in any use classification contained within this title.
"Use"means the nature of the occupancy, the type of activity, or the character and form of improvements to which the land is devoted or may be devoted.
"Valet parking"means parking service provided by a commercial business for patrons of the facility, whereby automobiles are driven to and from the parking facility by an employee of the business.
"Variance"means an adjustment in the application of the specific regulations of this title to a particular piece of property which property, because of special circumstances applicable to it, is deprived of privileges commonly enjoyed by other properties in the same vicinity and zone and which adjustment remedies disparity in privileges; provided, however, a variance may involve modifications of permissible uses for special periods of time when related to initial land development, or for essential public purposes.
"Vehicle"means any automobile, trailer, boat or motorcycle, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks.
"Vehicle autobroker"means an individual and/or business entity who provides, for a person(s), the service of arranging, negotiating, assisting, or effectuating, the purchase of new or used vehicles. Services are rendered in exchange for a fee or compensation.
"Vehicle dealer"means an individual and/or business entity engaged wholly or in part in the business of selling vehicles or buying or taking in trade, vehicles for the purpose of resale, selling, or offering for sale, consigned to be sold, or otherwise dealing in vehicles, whether or not such vehicles are owned by the person.
"Vehicle dealership—new and/or used"means a retail business whose primary use is the sale of new and/or used vehicles. Accessory uses may include vehicle rental and leasing agencies, service and warranty repair work, or the sale and storage of parts.
"Walk-up"means a food sales or service establishment which by design, physical facilities, and/or service procedures encourages or permits customers to receive goods or services at an exterior walk-up window or station and encourages or provides for consumption on the premises.
"Warehouse/distribution center (does not include warehousing)"is defined as the use of a building or structure as storage space for goods of any type with more than five loading positions for the first seventy-five thousand square feet of gross floor area or where the lot area is greater than three acres or where the floor area ratio is greater than six tenths. In a warehouse/distribution center, the owner and operator of the warehouse/distribution center is the owner of the goods or is the entity that offers the goods for sale or resale.
"Warehousing"is the use of a building or structure as storage space for goods or storage of any type. Warehousing use shall be differentiated from the trucking uses by limiting the average daily rate for trip ends (including all vehicles and trucks) to six and ninety-seven hundredths per one thousand square feet of gross floor area. Included in this category of use are business records storage, and warehousing uses associated with on-site manufacturing operations.
"Winegrower"means any person licensed by the department who has facilities and equipment for the conversion of grapes, berries, or other fruit into wine and is engaged in the production of wine within the city.
"Wireless telecommunications facility (also cellular antennae sites)"means any antennae, equipment cabinets, cables, mounting structures, and other necessary or required features, including stealth features, poles, brackets, hardware, and telephone and power connection equipment, which collectively are used to send or receive radio waves for voice and/or data transmission for commercial providers of such services. New wireless telecommunications facilities should comply with the Wireless Telecommunication Policy Statement approved by the planning commission.
"Yard"means an open space other than a court on a lot, unoccupied and unobstructed from the ground to the sky, except as otherwise specifically set forth in this title.
Yard, front. "Front yard"means an area extending across the full width of the lot and lying between the lot front line and a line parallel thereto, and having a distance between them equal to the required front yard depth as prescribed in each classification. Front yards shall be measured by a line at right angles to the lot front line, or by the radial line, or the radial line extended in the case of a curved front line. When a lot lies partially within a street for which a precise plan has been adopted pursuant to law, and where such street, as defined on the precise plan, is of the type that will afford legal access to such lot, the depth of the front yard shall be measured from the contiguous street line of such street as defined on the precise plan in the manner prescribed in this definition.
Yard, side. "Side yard"means a yard between the main building and the lot side line extending from the rear line of the required front yard or from the lot front line if there is no required front yard, toward the lot rear line to a point measuring two-thirds of the depth of the lot, except that on the side street side of corner lots and reverse corner lots the required side yard shall extend to the rear line of the lot and, in the case of a reverse corner lot shall include all of that portion, if any, of a triangle formed in the following manner:
A. On the common lot line of the reverse corner lot and the key lot a point shall be established where the rear line of the required front yard on the key lot meets such common lot line;
B. On the side street side line of the reverse corner lot a point shall be established at a distance from the common street corner of the key lot and the reverse corner lot equal to the depth of the required front yard on the key lot. If an alley intervenes between the key lot and the reverse corner lot, the width of the alley shall be included in determining the length of the line on the side street line of the reverse corner lot;
C. On the third side of the triangle shall be a straight line connecting points as set out in subsections
A and
B of this section.
The width of a side yard shall be measured horizontally from and at right angles to the nearest point of a lot side line toward the center of the lot. |
"Zone"means an area accurately defined as to boundaries and location, and classified by the zoning ordinance as available for certain categories of uses as set forth in this title, and within which other categories of uses are excluded.
