No person shall construct or remodel any building or dwelling in the city without constructing curbs, gutters, sidewalks and streets in accordance with the city specifications along the street frontage adjoining the property upon which such building or dwelling is constructed, unless adequate curbs, gutters, sidewalks or streets already exist. Where insufficient right-of-way has been dedicated for the installation of such street improvements, the required dedication shall be made prior to the issuance of any permits or construction upon the lot. The city engineer shall, upon request, determine the required right-of-way to be so dedicated. When determining the required setback for construction purposes the setback shall be determined from the new property line after dedication of required right-of-way. In the event the city council finds that in a specific instance or instances that sidewalks are impossible or impractical of construction, the foregoing requirement, insofar as it relates to sidewalks, may be omitted. Any person constructing a curb, gutter, sidewalk or street within the city shall first obtain a permit from the director of public works prior to said construction.
