CHAPTER 17

12 OCCUPANCY PERMIT

§ 17.12.010 Certificate of occupancy permit.

To assure compliance with the parking requirements and other provisions of this title, a certificate of occupancy shall be obtained from the building department before:
A. 
Any new building shall be erected;
B. 
Any new building shall be initially occupied or used;
C. 
Any existing building is structurally altered or enlarged; or
D. 
Any change or addition to the occupancy of a building or premises is made.
If the subject requiring a certificate of occupancy is also required to secure a building permit, a business license or any other evidence of authority required by law, such required certificate of occupancy for such use may constitute a separately identified part of such permit, license or other evidence, and shall be cleared through the building department as conforming, or not conforming, to the provisions of this title before any other license or permit or authority may be issued.
Each certificate of occupancy shall be issued only upon application signed by the authorized applicant, and shall contain over the signature of the applicant a correct statement of the use intended to be established and such certificate of occupancy may be issued only if such declared intended use conforms in every respect to the provisions of this title. The term "use," as employed in this section, includes considerations of all of the applicable controls set forth herein.

§ 17.12.020 Conflicting licenses or permits.

All departments, officials or public employees vested with the duty or authority to issue permits or licenses where required by law shall conform to the provisions of this title. All such licenses where required by law shall conform to the provisions of this title. No license or permit for uses, buildings or purposes where the same would be in conflict with the provisions of this title shall be issued. Any such license or permit, if issued in conflict with the provisions hereof, shall be null and void.

§ 17.12.030 Enforcement.

It shall be the duty of the building department to enforce the provisions of this title pertaining to erection, construction, reconstruction, conversion or alteration of buildings, or any use of premises. It shall be the duty of the officials charged with the issuance of licenses to enforce the provisions of this title pertaining to the use of land or buildings for which any such license is required by any other ordinance of the city.
