Applications for conditional use building permits shall be filed with the town office at least five days before a regular commission meeting. Applications filed before a meeting but after this deadline shall not be considered until the following meeting, unless excepted by the planning commission.

The application shall be made in eight copies and shall include the following materials:

(a)

A location map.

(b)

A plot plan showing the dimensions of the proposed structures and the parcel on which they are located. All setbacks shall be indicated, parking or recreation areas shown, access point to public ways shown, advertising sign located and described, and the construction and appearance of the structures described graphically or in writing.

Upon its consideration of a conditional use building permit application the commission shall do one of the following:

(a)

Approve the application subject to conditions.

(b)

Request further information including site plans or drawings or other materials relating to the proposed development.

(c)

Determine that a public hearing should be held and set a date for that hearing.

(d)

Disapprove the permit.

Approval of conditional use building permits shall be given only after the commission makes the following findings:

(a)

The town can provide water, sewerage, police and fire protection, garbage pickup and other services for the proposed use;

(b)

The proposed use is in accord with the purpose of which the zoning district in which it is located was established: and

(c)

The proposed use will pose no hazards due to danger of fire or explosion, traffic congestion, noise, excessive storm water runoff or other factors.

When the commission determines that a public hearing should be held, the applicant shall be required to notify all adjacent landowners of the hearing date, time, and place in the official town newspaper.

The commission shall notify the applicant of its decision within thirty days after the public hearing.
