02 - Definitions.

Section 26-02-010 - Definitions.

For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

Accessory Building. A detached subordinate building the use of which is customarily incidental to that of the main building or to the main use of the land and which is located on the same lot with the main building or use.

Adjacent Landowners. Owners of land immediately adjacent within one hundred forty feet of the parcel in question. In determining the one hundred forty feet, the width of any intervening street or alley shall not be included.

Board of Adjustment. The board of adjustment of Lovell, Wyoming, as appointed by the town council of Lovell, Wyoming. The board of adjustment will hear all variances and appeals of the planning and zoning commission.

Building. Any structure built for the shelter or enclosure of persons, animals, chattels or property of any kind, and not including advertising sign boards or fences.

Building Height. The height of a building is the vertical distance from the finished grade to the highest point on the roof.

Building Inspector. An officer appointed by the Mayor, by and with the advice and consent of the town council, to issue building permits and other duties as assigned by the town council.

Building Permit. A permit issued by the town granting approval for construction of a given proposal. The permit states any conditions imposed and the period of time for which the permit is issued.

Commercial. Refers to land uses involving the purchase, sale, or other transaction involving the handling or disposition of any article, substance, commodity, or service for livelihood, profit or nonprofit, or the ownership or management of office buildings, offices, recreational or amusement enterprises or maintenance and use of offices by profession.

Conditional Use. A use designated within a specific zone for which a building permit is not issued until reviewed and approved by the planning and zoning commission in accordance with procedures set forth in this chapter.

Construction. For purposes of this chapter, construction shall include any addition expanding the lot coverage or height of any building as well as the erection of new buildings and shall further apply to the development of parking lots.

Corner Lot. See lot, corner.

Council. The town council of Lovell, Wyoming

Development. Any construction on a site, occupancy of a site, or change in land use of a site.

District. Shall mean the same as zone.

Duplex. A building occupied by two families living independently of each other.

Dwelling. A building designed or used as the living quarters for one or more families.

Dwelling, Multiple-family. A building or portion thereof, designed for or occupied by three or more families living independently of each other, but not including motels and hotels.

Dwelling, Single-family. A building designed, arranged and intended to be occupied by not more than one family, one which has not more than one kitchen and not less than one bathroom.

Factory-Built Home (or Offsite Home). A home that is fully or nearly fully completed in a factory. This includes Mobile, Manufactured, and Modular homes. This does not include Kit homes, Prefab/Precut homes or panelized homes which only incorporate varying degrees of component fabrication offsite.

Family. Any number of persons living and cooking together on the premises as a single housekeeping unit but it shall not include a group of more than five individuals not related by blood or marriage.

Front Yards. See Yard, front.

Highway Business. A commercial enterprise which primarily caters to travelers and/or requires access to major thoroughfares.

Home Occupations. The occupation shall be conducted only by the occupants of the residence. It shall not detract from the residential nature of the area. Any outside storage shall be confined within a building or structures. Outside structures shall not be used as office space or selling areas. The size of the dwelling and any related storage buildings must conform to the provision of this chapter concerning total lot coverage.

Industrial. All developments for the purposes of extracting, manufacturing, or processing materials or where space requirements are extensive and/or are dependent on frequent use by heavy equipment.

Lot. A fractional part or a subdivision of a block or part of land according to a recorded plat.

Lot, Corner. A lot situated at the junction of two or more streets.

Manufactured Home. A factory-built residential structure or portion of residential structure manufactured under the Federal Manufactured Home Construction and Safety Standards Act, commonly know as the HUD Code. This Code was enacted on June 15, 1976. The HUD Code requires a 2 x 4 inch HUD Certification label affixed near the rear end of each transportable section of the home. The HUD Code also requires a permanent chassis. This type of unit shall be set up in a designated mobile home park.

Mobile Home. A factory-built house on a permanent chassis that was constructed prior to June 15, 1976.

Mobile Home Park. Any area or tract of land where space is rented or held for rent to two or more owners or users of mobile homes.

Modular Home. A factory-built house constructed in compliance with the standards of the adopted building code of the regional, state, or local government where the house is to be located. Usually this is one of the model codes such as the Uniform Building Code (UBC), or International Residential Code (IRC).

Multiple-family Dwelling. See dwelling, multiple-family.

Nonconforming Use. A structure or land lawfully used prior to the date of these regulations which does not conform to the use regulations for the district in which it is located.

Official Zoning Map. The official map which describes thereon the several zoning districts to which the regulations set forth in this chapter shall apply.

Overlay. A method for applying a zoning article within an existing zone or overlapping two (2) zones which enable the town to allow for a planned unit development without having to modify the existing zone or zones but which must address the overlay zone or zones performance standards.

Planned Unit Development. A methodology of organizing, arranging, and developing a mixed use type of residential, commercial, or light industrial functions that enhance the open space, commercial, or social opportunities for the residents and does not adversely affect the adjoining properties or add a financial burden to the municipality.

Planning Commission or Commission. The Lovell planning and zoning commission of Lovell, Wyoming.

Plot Plan. A drawing of a preliminary plan for development presented by the applicant including sufficient information for knowledgeable discussion during the review process. Requirements for the plat plan may vary between development proposals, but shall be required for all uses.

Public Use. Governmental buildings, land owned by a governmental unit and uses by public utilities.

Quonset hut. Lightweight prefabricated structure sections of corrugated steel having a semicircular or arched cross section that are connected to form a structure.

Rear Yard. See yard, rear.

Retail Business. A commercial enterprise engaged in the sale of goods or articles individually or in small quantities directly to the consumer.

Setback. Distance from curb to dwelling.

Side Yard. See yard, side.

Single-family Dwelling. See dwelling, single-family.

Single Manufactured Home. One manufactured home placed on one town lot on a permanent foundation, and used for a residential purpose.

Single Mobile Home. One mobile home placed on one town lot on a permanent foundation with wheels and tongue removed, and used for a residential purpose.

Single Modular Home. One modular home placed on one town lot on a permanent foundation, and used for a residential purpose.

Structure. Any thing constructed or erected which requires location on the ground or attached to something having location on the ground, including signs and billboards, but not including fences or walls used as fences.

Schools. An institution accredited by the state for the purpose of teaching. Teachers shall be licensed by the state and shall conform to all requirements of the state.

Use. The purpose for which land or a building is arranged, designed, or intended, or for which either land or a building is or may be occupied or maintained.

Use of Right. A land use for which a building permit may be issued by the building inspector without further review of the planning commission provided performance standards are met.

Variance. A permit for deviation from the standards established in the zone in which the property is located, granted by the board of adjustment pursuant to this chapter.

Yard. An open space other than a court, on a lot, unoccupied and unobstructed from the ground upward except as otherwise provided in this chapter.

Yard, Front. An open unoccupied space on the same lot with a main building, extending the full width of the lot and situated between the street line and the front line of the building projected to the side lines of the lot.

Yard, Rear. An open unoccupied space on the same lot with the building between the rear line of the building and the rear line of the lot and extending the full width of the lot.

Yard, Side. An open unoccupied space on the same lot with the building which is situated between the building and the side line of the lot and extending from the front yard to the rear yard.

Zone. A land area shown or described in the official zoning map to which uniform regulations apply.
