CHAPTER 15

ENFORCEMENT

15.15.01: PROCEDURES:

   A.   Any activity contrary to the provisions of this title is declared to be unlawful and may in some circumstances constitute a public nuisance. The following procedures shall apply to the enforcement of the provisions of this title:
      1.   Notice: Upon submission of written notice to the department by a person or appropriate authority of a violation of this title using the appropriate County form, the Director, shall review the complaint for applicability to this title. If it is determined that the complaint is valid and in violation of this title, the department shall deliver (via certified mail) to the party or parties in violation of this title, a written order to comply with the provisions of this title within thirty (30) days of receipt of the notice or other time frame established by the Code Enforcement Officer, Building Inspector or Director.
      2.   No Compliance With First Notice: If the party or parties in violation of this title fail to comply with the order to comply within the identified timeframe, the Director may either choose to send a second notice or refer the item to the District Attorney's Office for a decision concerning the filing of criminal charges or to the Board for other potential remedy.
      3.   No Compliance With Second Notice: If a second notice is provided by the department, and the party or parties in violation of this title have not complied within the timeframe provided within the second letter (up to 30 days from receipt of the letter), the matter will either be referred to the District Attorney's Office for a decision concerning the filing of criminal charges or to the Board for other potential remedy.
      4.   Enforcement By Injunction: Compliance with the provisions of this title may also be enforced by injunction order at the suit of the County or one or more owners of real property situated within an area affected by the regulations of this title. (Ord. 603, 11-1-2018)

15.15.02: REMEDIES:

All remedies provided for by this title shall be cumulative and not exclusive. The conviction and punishment of any person hereunder shall not relieve any person from the responsibilities of correcting prohibited conditions or removing prohibited buildings, structures or improvements, nor prevent the enforced correction or removal thereof. 15.15.03: PENALTIES:

Any person, firm or corporation, whether as principal, agent, employee or otherwise, found to be violating any provision of this title or violating or failing to comply with any order or regulation made hereunder, is guilty of a misdemeanor. The person, firm or corporation is guilty of a separate offense for each day and every separate offense during which the violation of this title or failure to comply with any order or regulation as committed, continued or otherwise maintained.
