CHAPTER 5

REVIEW BY CITIZEN ADVISORY BODY

15.05.01: DESIGNATION OF CITIZEN ADVISORY BODY:

   A.   With the exception of home occupation permits, sign reviews, temporary use permits, wireless communication facility permits, design review, boundary line adjustments and records of survey, all applications for zoning permits and tentative land division maps on any land within the established boundaries of any citizen advisory board shall be forwarded for review by the advisory board, prior to final action by the Director, Planning Commission or Board, as may be required. Failure of a citizen advisory board to review an application prior to consideration by the final decision-maker shall not constitute grounds for appeal.
   B.   All applications for tentative or final land division map approval shall be forwarded for review by the governmental entities required by Nevada Revised Statutes 278, prior to final action by the Director, Planning Commission or Board. Failure of a governmental entity to review an application prior to consideration by the final decision-maker shall not constitute grounds for appeal. (Ord. 603, 11-1-2018)

15.05.02: REVIEW AND RECOMMENDATION BY ADVISORY BODY:

To have their comments considered by a decision-making body, the advisory body must review and provide a written recommendation on any development applications within its purview prior to the first scheduled public hearing on the development application. Failure of advisory body to make a recommendation may not operate to deprive an applicant of statutory rights, nor shall it delay consideration by any other body charged by this title to act on an application. 15.05.03: EFFECT OF ACTION BY ADVISORY BODY:

All actions by advisory bodies in making a recommendation on any development permit shall be deemed to be advisory and as evidence to be considered by the final decision-maker. However, the record generated before an advisory body may be considered by the decision-making body. (Ord. 603, 11-1-2018)
