CHAPTER 239

BUILDING PERMITS

15.239.01: CODES ADOPTED; GENERAL ADMINISTRATION:

   A.   Pursuant to Nevada Revised Statutes 244.105, 278.580, 278.583 and 444.350, Lyon County does hereby adopt the following uniform and specialized codes, as amended herein, which will be collectively known as the Building Codes of Lyon County:
      1.   International Building Code, 2024 edition, published by International Code Council (ICC).
      2.   International Residential Code, 2024 edition, published by ICC.
      3.   International Existing Building Code, 2024 edition, published by ICC.
      4.   International Swimming Pool and Spa Code, 2024 edition, published by ICC.
      5.   International Energy Conservation Code, 2024 edition, published by ICC.
      6.   International Fuel Gas Code, 2024 edition, published by ICC.
      7.   International Mechanical Code, 2024 edition, published by ICC.
      8.   Uniform Mechanical Code, 2024 edition, published by International Association of Plumbing and Mechanical Officials (IAPMO).
      9.   Uniform Plumbing Code, 2024 edition, published by IAPMO.
      10.   National Electrical Code, 2023 edition, National Fire Protection Association (NFPA) 70.
      11.   International Fire Code, 2018 edition, published by ICC.
      All contents of the above codes are adopted as amended herein.
   B.   Where the word "City" appears in the codes, the word "County" shall be substituted and wherever the words "City Council" appear, the words "Board of County Commissioners" shall be substituted.
   C.   The Board is empowered to hear and decide appeals of order, decisions or determinations made by an official relative to the application and interpretation of this chapter. The Board is further empowered to adopt rules and regulations governing the procedures for such appeals. The Board may delegate this authority to the appropriate Fire District Board for appeals concerning interpretation and enforcement of the International Fire Code. Any reference to a "Board of Appeals" and the authority or procedure of said "Board of Appeals" is hereby deleted from the "Building Codes of Lyon County".
   D.   The Board will establish fees for County permits, services and inspections provided pursuant to the several codes. Related fee tables contained in the codes are not adopted for that purpose.
   E.   Any section or provision set forth in the several codes which may be in conflict with the Nevada State Constitution or Nevada Revised Statutes is not adopted.
   F.   Where differences occur between the provisions of the published codes and the requirements of the State or local authority regarding water distribution or sewage disposal systems, the requirements of the State or local authority shall apply.
   G.   Where differences occur between the provisions of the published codes and the requirements of the Nevada Division of Manufactured Housing, Division of Health, Division of Environmental Protection or the Comstock Historic District, the more stringent requirements shall apply as determined by the County building official.
   H.   Where differences occur between the provisions of the published codes and the requirements of the Nevada State Fire Marshal and appropriate Fire Protection District, the codes and amendments adopted by the Nevada State Fire Marshal and the appropriate Fire Protection District shall apply.
   I.   Where differences or code discrepancies occur between the provisions of the published codes or between the published codes and the titled Lyon County codes, the more stringent shall apply as determined by the County building official.

15.239.02: AMENDMENTS; ADMINISTRATIVE AND TECHNICAL:

   A.   Section E3901.4.2 of the Residential Code and section 210.52 (2) of the 2023 National Electric Code shall be amended to require the installation of receptacle outlets at all island countertops in accordance with adopted electrical safety standards. The use of future wiring provisions as a substitute for required receptacles shall be prohibited.
   B.   E3901.4.2 shall be amended so receptacle outlets shall not be required within peninsular countertops measuring less than six feet (6') in length, as measured from the connecting wall to the outer edge of the countertop. Where this exception applies, future wiring provisions, such as capped conductors, conduit stubs, or unused outlet boxes intended for future receptacles in the peninsular section, are expressly prohibited.
   C.   Table R302.6 of the 2024 International Residential Code and section 406.3.2.1 of the 2024 International Building Code shall be amended to require a minimum of 5/8-inch Type X gypsum board on the garage side of walls separating garages from living spaces, and on the ceilings of attached garages, applied directly to framing members.
   D.   Table R301.2 of the Northern Nevada Amendments shall be amended such that the Seismic Design Category for Lyon County shall be amended from D1 to D2.
   E.   All residential projects utilizing prescriptive design methods specified in the 2024 International Residential Code shall design their project to Seismic Category D2 in addition to all other Lyon County adopted amendments.
   F.   All projects utilizing non-prescriptive methods shall design their projects to the 2024 IBC Seismic Design Category D utilizing site specific criteria in addition to all Lyon County adopted codes and amendments. All projects utilizing non-prescriptive methods shall have all structural elements engineered. It shall not be permissible to mix prescriptive and non-prescriptive.
   G.   Section 609.1 of the 2024 Northern Nevada Amendments shall be amended such that water lines shall be installed at a minimum depth of twelve inches (12") below the frost depth per the adopted codes.
   H.   Table R301.2 shall be amended to set the minimum frost line depth at eighteen inches (18") for elevations less than five thousand feet (5,000') and twenty-four inches (24") for elevations greater than or equal to five thousand feet (5,000').

15.239.03: VIOLATIONS AND PENALTIES:

   A.   Criminal Penalties:
      1.   Any person who violates any provision of the published codes hereby adopted shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by not more than six (6) months' imprisonment in the Lyon County Jail or by a fine of not more than one thousand dollars ($1,000.00) or by both such fine and imprisonment.
      2.   Any corporation which violates any provision of the published codes hereby adopted shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than one thousand dollars ($1,000.00).
   B.   Civil Penalties:
      1.   Abatement Procedures: If the owner of a noncomplying building or structure refuses to obey an abatement order made by the Board, the County may proceed with abatement and levy a lien upon the property for the expense thereof.
      2.   Business License Revocation: The Lyon County business license of any person or corporation which, holding such license, violates the provisions hereof, may be terminated or canceled after a duly noticed public hearing and a finding that the person or corporation has violated or caused violation of the provisions hereof. 15.239.04: EXISTING CODES:

All uniform codes heretofore adopted by reference as part of the Lyon County Code are repealed and hereby replaced. However, said uniform codes may remain in effect, temporarily, as a part of the Lyon County Code to the extent that construction projects that are underway or for which building permits have been issued pursuant to such codes, may proceed to completion. Upon completion of such construction projects and/or expiration of such building permits, the said uniform codes shall be of no further force and effect. (Ord. 604, 4-4-2019)

15.239.05: NORTHERN NEVADA AMENDMENTS:

   A.   Lyon County adopts the 2024 Northern Nevada amendments dated February 20, 2025, as published by the Northern Nevada Chapter of the International Code Council.
   B.   Lyon County adopts the Northern Nevada amendments to 2018 International Fire Code dated August 8, 2018.

15.239.06: PERMITS REQUIRED:

Except as specified in the adopted codes, as amended, no building or structure regulated by this chapter may be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained from the Community Development Department. A single permit may be issued covering building, plumbing, electrical work for a single structure. (Ord. 604, 4-4-2019)
