FIRE CHIEF: The Fire Chief in each Fire District in Lyon County.
FIRE DISTRICT: As used in this chapter, "Fire District" includes the Central Lyon County Fire Protection District, the Mason Valley Fire Protection District, the North Lyon County Fire Protection District and the Smith Valley Fire Protection District.
Central Lyon County Fire Protection District: The Fire Protection District as organized pursuant to the provisions of chapter 474 of the Nevada Revised Statutes ("NRS") and adopted by ordinance 385 on July 15, 1993.
Mason Valley Fire Protection District: The Fire Protection District as organized pursuant to the provisions of chapter 474 of the Nevada Revised Statutes ("NRS") and created by election on January 6, 1948.
North Lyon County Fire Protection District: The Fire Protection District as organized pursuant to the provisions of chapter 474 of the Nevada Revised Statutes ("NRS") and created by election on April 15, 1952.
Smith Valley Fire Protection District: The Fire Protection District as organized pursuant to the provisions of chapter 474 of the Nevada Revised Statutes ("NRS") and created by election on May 5, 1945.
OPEN BURNING: Any fire from which the products of combustion are emitted into the atmosphere without passing through a stack or chimney. (Ord. 603, 11-1-2018)
15.270.02: AUTHORITY; AUTHORIZATION REQUIRED:
The Fire Chief or his authorized designee shall establish regulations for open burning within each Fire District. No person shall kindle or maintain any open fire for the purpose of weed abatement, conservation, disease control, game or forest management, personnel training, elimination of hazards, agricultural purposes and management, recreational, educational or ceremonial purposes or authorize any such open fire to be kindled or maintained on any public or private land without first having obtained a permit from the Fire District having jurisdiction. 15.270.03: PERMITS REQUIRED:
Burning under the regulations stated above shall not be done without first obtaining a burn permit from the Fire Chief or their designee of the Fire District having jurisdiction. The permittee shall follow the burning regulations as stated on the burn permit and will be responsible for fire suppression costs as stated in section 15.270.10 of this chapter. 15.270.04: BURN BARRELS PROHIBITED:
The use of burn barrels, where permitted, shall be in compliance with the burn permit and regulations of the Fire District having jurisdiction. (Ord. 603, 11-1-2018)
15.270.05: HOURS; IGNITION; EXTINGUISHMENT:
The hours of burning shall be adopted by each Fire District. Before igniting a fire, the permit holder must comply with procedures adopted by the Fire District having jurisdiction, which may include contacting the appropriate Fire District to confirm that burning is allowed for that day. 15.270.06: EXCEPTIONS TO PROVISIONS:
Outdoor fires in each Fire District may be used for heating, cooking or branding in an appropriate approved fireplace or appliance at any time without permission except as restricted by the Fire Chief or their authorized designee of the Fire District having jurisdiction. (Ord. 603, 11-1-2018)
15.270.07: FIRE DISTRICT; EXTINGUISHMENT POWERS:
The Fire District having jurisdiction, its officers and/or agents may without further process of law extinguish or require to have extinguished any fire ignited or maintained in violation of the requirements of this chapter. (Ord. 603, 11-1-2018)
15.270.08: WAIVER OF PROVISIONS:
The provisions of this chapter may only be waived under extraordinary circumstances by written authorization from the Fire Chief or their authorized designee of the Fire District having jurisdiction. (Ord. 603, 11-1-2018)
15.270.09: BURNING OF TRASH, WASTE, RUBBISH OR TOXIC MATERIALS:
The burning of garbage, trash, waste, rubbish, toxic materials, construction debris, plastics or other hydrocarbon products or fuels is prohibited in each Fire District. (Ord. 603, 11-1-2018)
15.270.10: VIOLATION; PENALTY:
Any person who violates any provision of this chapter is guilty of a misdemeanor and is responsible for all costs of response and fire suppression associated with the violation of this chapter. (Ord. 603, 11-1-2018)
15.270.11: CITATION AUTHORITY:
The Fire Chief or their designee of the Fire District having jurisdiction is hereby authorized and empowered to prepare, sign and serve criminal misdemeanor citations for violations of this chapter. (Ord. 603, 11-1-2018)

BURNING REGULATIONS
15.270.01: DEFINITIONS:
