SECTION 23

- Changes and amendments.

1.

Subject to the provisions set forth in the State of Florida, statutory requirements and amendments thereto, the Town Council may amend, supplement, change, modify, or repeal the regulations, restrictions, and boundaries herein established.

Upon the petition of the owner or owners of the majority of frontage in any area, the Town Council may, after complying with all legal requirements, rezone land within the town's corporate limits.

There is hereby fixed a charge to be set by Resolution, which will be nonrefundable to particularly cover the costs of mailing, legal advertisements for all advertisements necessary to complete the rezoning, posting costs, engineering fees and attorney's fees, and other incidental expenses connected with the petition to rezone the boundaries herein established, which amounts shall be paid to the Town Clerk at the time of filing such petition. Said sum shall be the minimum charged and shall not be refundable. In the event that the costs set forth herein exceed the sum set by Resolution, then in that event the Town Clerk shall bill the petitioner for the additional costs incurred and the petitioner shall be responsible for the payment of same.

Should a proposed rezoning amendment be denied, the Town Council shall not reconsider such request for an amendment for a period of six (6) months after denial, unless the Town Council determines that the public interest shall require it to do so.
