SECTION 24

- Notice requirements.

A.

Application and filing fee. The filing fees for all development applications shall be set by resolution of the town council. Said fees are due and payable to the Clerk of the Town of Mangonia Park upon submission of an application. All applicants shall submit seven (7) copies of proposed site plans, if applicable, and shall be responsible for any additional expenses incurred by the town for publication and notices in addition to the required filing fee.

B.

Notice requirements; planning and zoning board, local planning agency and board of adjustment.

Due public notice as herein required for all development applications, including but not limited to re-zoning real property, zoning code text amendments, comprehensive plan amendments, variances and special exceptions shall be deemed sufficient when a notice is published once in newspaper of general circulation within the town, at least ten (10) days before the public hearing date set for the appropriate board or agency responsible for the review of the requested development order.

A copy of such notice shall be mailed by regular mail to the parties in interest and to all property owners as shown on the records of the county property appraiser within three hundred (300) feet of the property involved when such application involves a request to re-zone specific parcels of property,

When such application involves a comprehensive plan amendment for, or the re-zoning of, land within the bioscience overlay to be converted to a residential use, notice shall also be sent to all member participants of the Bioscience Land Protection Advisory Board.

C.

Notice requirements; town council hearings. Due public notice as herein required for re-zoning real property, zoning code text amendments and comprehensive plan amendments shall be in accordance with the notice requirements as set forth at F.S. § 166.041, as such section may be amended from time to time. When such application involves a comprehensive plan amendment for, or the re-zoning of, land within the bioscience overlay to be converted to a residential use, notice shall also be sent to all member participants of the Bioscience Land Protection Advisory Board.

D.

Hearing determination; town council. The town council shall hold public hearings regarding proposed ordinances which change the actual list of permitted, conditional or prohibited uses within a zoning category or changes the actual zoning map designation of a parcel or parcels of land and public notice shall be provided as specifically set forth in paragraph C. above. Changes proposed to the zoning code other than those referenced hereinabove shall be noticed as all other ordinances for the town; i.e. ten (10) days prior to second reading.
