B-1 Local Shopping District

§ 465-71 Purpose.

The B-1 Local Shopping District is intended to provide for individual or small groups of low-intensity retail and customer service establishments. This type of district is generally located away from the traditional central business district and highway commercial district. The Local Shopping District typically serves a neighborhood or a group of neighborhoods in which it is located. The district should provide such amenities to make the permitted uses more compatible with the character of adjacent land uses.

§ 465-72 Use.

In the Local Shopping District no buildings or premises shall be used and no building shall be erected or structurally altered after the adoption of this chapter, unless otherwise provided in this chapter, except for one or more of the following listed permitted principal uses, permitted accessory uses, or special exceptions.

§ 465-73 Permitted principal uses.

Commercial establishments, retail stores and professional offices, as follows:

Auto parts store
Bakery
Banks and savings institutions
Barbershop, beauty parlor
Bed-and-breakfast establishments - residential and commercial
Beer and liquor stores selling in less than package units
Bookstore
Business and professional office
Candy store, confectionery store
Churches, public and parochial schools, colleges and universities, including dormitories, public libraries, public museums and art galleries
Cleaning and custodial services
Clinic
Coffee shop

§ 465-74 Permitted accessory uses.

Such accessory uses as are customary in connection with the foregoing principal uses and are incidental thereto.

§ 465-75 Conditional uses.

Mini warehouses.

Community living arrangements with a capacity for greater than 15 persons, which are in conformance with § 62.23(7)(i), Wis. Stats.

Brewpub or winery, accessory to a restaurant, tavern, cocktail lounge or package beverage store, provided that no greater than 30% of the gross floor area is devoted to any manufacturing or processing, or storage of beverages produced on premises, and provided that brewpubs produce no greater than 3,000 barrels of fermented malt beverages per year or that wineries produce no greater than 20,000 gallons of wine per year, in conformance with Ch. 125, Wis. Stats., and the City's Code.

§ 465-76 Height.

Buildings erected or structurally altered after January 4, 1955, shall exceed neither 35 feet nor 2 1/2 stories in height. See § 465-18A and B.

§ 465-77 Yard requirements.

In the Local Shopping District, the height of buildings, the minimum dimensions of yards and the minimum lot area shall be as follows, except that for single-family, two-family and multiple-family dwellings the height and area requirements of the RM-1 Multiple-Family Residential District shall apply.
A. 
Front setback. There shall be a minimum setback of 25 feet from the street right-of-way. Subject to all other statutes, ordinances and rules governing signs, a sign shall be allowed in the setback, provided it does not obstruct the vision or passage of pedestrians or operators of bicycles or motor vehicles. Except that no sign shall be allowed in the portion of the setback of a corner lot at the intersection of two streets described as follows: a triangle formed by the corner point of the lot and points on the front and side lot line 20 feet in from the corner.
B. 
Side yard. There shall be a minimum side yard of seven feet on each side of all buildings.
C. 
Rear yard. There shall be a rear yard having a minimum depth of 20 feet for a building 1 1/2 stories or less in height. For each additional story or fractional story in height, the depth of such rear yard shall be increased five feet.
D. 
Lot area. Lots shall have a minimum area of 7,200 square feet.
E. 
Lot width. No such lot shall be less than 60 feet in width.
F. 
Lot occupancy. The ground area occupied by the principal and accessory buildings shall not exceed 50% of the total area of the lot.

§ 465-78 Plan Commission approval.

To encourage individual or small groups of low-intensity retail and customer service establishments that are compatible with existing land uses, the City's Comprehensive Plan and the intent of this chapter, no building permit shall be issued without the review and approval of the Plan Commission, except those items listed in the Plan Commission Approval Matrix.[1] Said review and approval shall be concerned with the location of the use in addition to the site plan review and approval procedures required under this chapter.
