ARTICLE XV

B-4 Highway Business District

§ 465-96 Purpose.

The B-4 Highway Business District is intended to accommodate those businesses that require ready access to major arterials, require large areas for development and serve the traveling public.

§ 465-97 Use.

In the B-4 Highway Business District, no building or premises shall be used, erected or structurally altered except for one or more of the listed permitted principal uses, permitted accessory uses or conditional uses.

§ 465-98 Permitted principal uses.

Appliance store
Auto sales and service
Auto supply stores
Banks and other depository institutions
Boat dealers
Business and professional offices
Car rental agency
Car washes
Coffee shops

Equipment rental - large, vehicles, etc./with outside storage
Farm equipment and machinery sales and service
Food products (retail)
Furniture store
Gasoline service stations
General merchandise store
Gift shop

Insurance offices
Lumber and other building supplies
Mobile or manufactured homes sales and services centers, excluding construction. All storage of mobile or manufactured homes which is adjacent to or across an alley from a residential district shall be within completely enclosed buildings or contained within accessory outdoor storage areas effectively screened from the residential district.

Municipal buildings, except sewage disposal plants, garbage incinerators, public warehouses, public garages, public shops and storage yards and penal or correctional institutions and asylums.

§ 465-99 Permitted accessory uses.

Accessory uses permitted in the B-2 District.

§ 465-100 Building height.

Buildings erected or structurally altered shall not exceed 96 feet or eight stories in height.

§ 465-101 Yard requirements.

A. 
Setback. There shall be a minimum building setback of 40 feet from the right-of-way of all streets. Subject to all other statutes, ordinances, and rules governing signs, a sign shall be allowed in the setback, provided it does not obstruct the vision or passage of pedestrians or operators of bicycles or motor vehicles; except that no sign shall be allowed in the portion of the setback of a corner lot at the intersection of two streets described as follows: a triangle formed by the corner point of the lot and points on the front and side lot line 20 feet in from the corner.
B. 
Side yards. There shall be a side yard (not less than 20 feet in width) on each side of all buildings.
C. 
Rear yard. There shall be a rear yard having a minimum depth of 20 feet for a building three stories or less in height. For each additional story or fractional story in height, the depth of such rear yard shall be increased four feet.
D. 
Area. Lots shall have a minimum area of 15,000 square feet.
E. 
Lot width. Lot shall be not less than 100 feet in width.
F. 
Lot coverage. The ground area occupied by the principal and accessory buildings shall not exceed 50% of the total area of the lot.

§ 465-102 Plan Commission approval.

To encourage a commercial use environment that is compatible with existing land uses, the City's Comprehensive Plan and the intent of this chapter, no building permit shall be issued without the review and approval of the Plan Commission, except those items listed in Article XXXV entitled "Plan Commission Approval Matrix."[1] Said review and approval shall be concerned with the location of the use in addition to the site plan review and approval procedures required under this chapter.
