ARTICLE 10

- R-5 MULTIFAMILY RESIDENTIAL

Within all R-5 multifamily residential districts, as shown on the official zoning map, the following regulations shall apply:


Section 10.01.- Permitted uses.

[In an R-5 multifamily residential district, only the following uses of property shall be permitted:]

1.

Uses permitted in R-4 district (except mobile homes).

2.

Apartments, row houses, townhouses, etc.

Section 10.02. - Height regulations.

No building shall exceed 45 feet in height.

Section 10.03. - Area regulations for apartments.

Yards.

1.

Same as R-4, except that the exterior walls of the building nearest the property lines shall be considered the front, side, and rear yard areas in condominium and other similar apartments with joint ownership or common property; that a front yard or rear yard which contains parking shall be a minimum of 40 feet in depth from said property line.

When adjacent to residential property, a solid fence or wall six feet in height or plantings not less than three feet in height which will grow and be maintained to six feet or more shall be installed along the lot line but this requirement shall not apply within 20 feet of a street or along lot lines adjacent and parallel to the street.

Lot area per family.

1.

There shall be a minimum lot width of 70 feet at the building line.

2.

Every lot shall contain a minimum area of 10,500 square feet and shall be increased by an additional area of 800 square feet for each unit in excess of four and 1,800 square feet for each ground level unit in excess of four.

Section 10.04. - Area regulations for row houses, townhouses.

Yards. There shall be a 25-foot yard along [the] sides and rear of the townhouse site whenever it adjoins on R-1, R-2, or R-3 districts.

Each townhouse, row house, etc., shall have its own lot yard space of at least 400 square feet, reasonably secluded from view from streets or from neighboring property. Such yard shall not be used for off-street parking or for any accessory building.

No portion of a townhouse or accessory structure in or related to one group of contiguous townhouses shall be closer than 20 feet to any portion of a townhouse or accessory structure related to another group, or to any building outside the townhouse area. Nor shall any structure be less than 20 feet from a public street.

Courts, open space and recreation areas. There shall be a site area of at least 1,300 square feet per dwelling unit in addition to the 2,500 square feet [of] lot area for common open space, yards and buffer area adequately landscaped, walkways, and access drives, and including at least 200 square feet per dwelling unit for recreation space.

Site area per development. Townhouses [or] row houses may be intermingled with other types of housing except that they shall not be located on lots of less than 150 feet of frontage.

Not more than six contiguous townhouses shall be built in a row with the same or approximately the same front building line, and not more than 12 townhouses shall be contiguous.

Lot area per family. Minimum width for the portion of the lot on which the townhouse is to be constructed shall be 25 feet, with a minimum lot area of 2,500 square feet. Each lot must front on a public street and have direct access to the common green area.
