ARTICLE 13

- R-B APARTMENT COMMERCIAL

Section 13.01.- Permitted uses.

[In an R-B apartment commercial district, only the following uses of property shall be permitted:]

1.

All uses permitted in R-5 and B-1 districts.

2.

Offices; restaurants; grocery and drug stores; barber shops; florists; beauty shops; meat markets; clinics; banks, including drive-in banks; launderettes; bakeries; cleaners; similar retail business or service which is established for the convenience of neighborhood residents; funeral homes and mortuaries; art and dance studios.

Section 13.02. - Prohibited uses.

All uses not permitted herein [are prohibited]. Uses detrimental due to odor, smoke, dust, gas, excessive glare, noise, vibrations [are prohibited].

Section 13.03. - Height regulations.

No building shall exceed 45 feet in height.

Section 13.04. - Area regulations.

[In R-B apartment commercial districts, the following area regulations shall apply:]

Yards.

When used as apartments:

1.

Same as R-5 except that the exterior walls of the building nearest the property lines shall be considered the front, side, and rear yard areas in condominium and other similar apartments with joint ownership or common property; that a front or rear yard which contains parking shall be a minimum of 40 feet in depth from said property line.

2.

When adjacent to single-family residential property a solid fence or wall six feet in height or plantings not less than three feet in height which will grow and be maintained to six feet or more shall be installed along the lot line but this requirement shall not apply within 20 feet of a street or along lot lines adjacent and parallel to the street.

When used as commercial:

1.

No front, side or rear yard required except when a commercial district abuts on a residential district which requires front, side, and rear yards. These requirements shall apply for the commercial district for the entire block in which the abutment occurs.

2.

When adjacent to single-family residential property, a solid fence or wall six feet in height or plantings not less than three feet in height which will grow and be maintained to six feet or more shall be installed along the lot line, but this requirement shall not apply within 20 feet of a street or along lot lines adjacent and parallel to the street.

Lot area per family.

When used as apartments:

1.

There shall be a minimum lot width of 70 feet.

2.

Every lot shall contain a minimum area of 10,500 square feet and shall be increased by an additional area of 800 square feet for each unit in excess of four, and 1,800 square feet for each ground level unit in excess of four.
