- ENFORCEMENT AND PENALTY
The provisions of this ordinance shall be administered and enforced by a building inspector, appointed by the mayor, who shall have the power to make inspection of buildings or premises necessary to carry out his duties in the enforcement of this ordinance.
In case any structure is erected, or structurally altered, or maintained, or any structure or land is used in violation of this ordinance, any proper city official or their duly authorized representatives may institute any appropriate action or proceedings to prevent such unlawful construction, or alteration, or use, or other violations, to restrain, to correct, or to prevent any illegal act, conduct, business, or use in or about such premises. Each day such violation continues shall constitute a separate violation. The building inspector may call upon the chief of police to furnish the necessary police personnel to carry out his orders.
Any resident of the community who believes that a zoning violation is occurring may file a written complaint. Such complaint stating fully the causes and basis thereof shall be filed with the building inspector. The building inspector shall record properly such complaint, immediately investigate, and take action thereon as provided by this ordinance.
Building permits [are] required. No building or other structure or excavation for substructure shall be erected, moved, added to, or structurally altered without a permit therefor, issued by the building inspector. No building permit shall be issued except in conformity with the provisions of this ordinance except after written order from the board of adjustment.
In applying to the building inspector for a building permit, the applicant shall submit a dimensioned sketch drawn to a scale, such plan indicating the shape, size, height, and location of all buildings to be altered or moved and of any building already on the lot. He shall state the existing and intended use of all such buildings and supply other information required by the building inspector for determining whether the provisions of this ordinance are being observed. If the proposed construction as set forth in the application is in conformity with the provisions of this ordinance and other ordinances of the community then enforced, the building inspector shall issue a building permit for such construction. If a building permit is refused, the building inspector shall state such refusal in writing with the cause.
The issuance of a permit shall in no case, however, be construed as waiving any provision of this ordinance. If the work described in any building permit has not begun within 90 days from the date of issuance thereof, said permit shall expire automatically. A building permit shall become void 12 months from the date of issuance unless substantial progress has been made by that date on the project described therein.
It shall be unlawful to install permanent utilities in or to use or occupy or permit the use or occupancy of any part of any building or premises hereafter erected, created, changed, converted, or wholly or partly altered or enlarged in its use or structure until a certificate of occupancy shall have been issued therefor by the building inspector stating that the proposed use of this building or land conforms to the requirements of this ordinance.
No permit for erection, alteration, moving, or repair of any building shall be issued until an application has been made for a certificate of occupancy and the certificate shall be issued in conformity with the provisions of this ordinance upon completion of the work.
A temporary certificate of occupancy may be issued by the building inspector for a period not exceeding six months only in the case of an addition to an existing structure. Then and only then may a temporary certificate be issued to allow occupancy while work is in progress, provided that all necessary precautions have, in the opinion of the building inspector, been taken to assure safety to the occupants.
The building inspector shall maintain a record of all certificates of occupancy and copies shall be furnished upon request to any person.
Failure to obtain a certificate of occupancy shall be a violation of this ordinance and punishable under section 23.07.
A record of all certificates of occupancy, building permits, applications, sketches, and plans shall be maintained in the office of the building inspector.
Any person violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be fined an amount of not less than $10.00 and not to exceed $25.00, or imprisoned for not more than 30 days, for each offense. Each day such violation shall continue shall constitute a separate offense.
