CHAPTER 16

ADMINISTRATION

11-16-1: Building Official

The building official has primary responsibility carrying out those powers and duties ex¬pressly identified in this zoning ordinance, including the following general powers and duties:

  1. Interpreting and administering the provisions of this zoning ordinance;
  2. Conducting periodic inspections of structures and uses of land to determine compliance with this zoning ordinance;
  3. Notifying in writing all persons responsible for violating this zoning ordinance;
  4. Taking appropriate actions to ensure compliance with this zoning ordinance and remedying violations of its provisions, including:
    1. Ordering discontinuance of any illegal use of land or structures;
    2. Ordering removal of illegal structures and additions or alterations thereto;
    3. Ordering discontinuation of work being done in violation of zoning ordinance provisions;
  5. Maintaining permanent and current records of this zoning ordinance, including all zoning maps, amendments, planned unit developments, zoning exceptions, special uses, variations and administrative adjustments;
  6. Maintaining a records of permits, certificates, registers of pollutants, and copies of notices of violation and orders of discontinuances or removal for such time as necessary to ensure continuous compliance with zoning ordinance provisions;
  7. Receiving and processing all applications for permits and development approvals under this zoning ordinance;
  8. Providing technical assistance and support to the village board, staff, zoning board of appeals;
  9. Exercising other powers and performing other duties as specified or necessarily implied by the provisions of this zoning ordinance.

11-16-2: Zoning Board Of Appeals

  1. Composition: The zoning board of appeals must consist of 7 members.
  2. Appointments: Zoning board of appeals members must be appointed by the village president and confirmed by the village board.
  3. Terms: Members of the zoning board of appeals serve 5-year terms.
  4. Vacancies: In the event of a vacancy occurring in the membership of the zoning board of appeals for any reason, an appointment for the remainder of the vacant term must be made in the same manner as regular appointments.
  5. Removal: A zoning board of appeals member may be removed for cause by the village board after notice, written charges and public hearing.
  6. Compensation: Members of the zoning board of appeals serve without compensation.
  7. Officers: The zoning board of appeals must elect a chairperson and vice chairperson.
  8. Rules of Procedure: The zoning board of appeals may adopt rules necessary for the conduct of its affairs.
  9. Meetings: Meetings are held at the call of the chairperson and at other times as the zoning board of appeals may determine. The chairperson, or in the chairperson’s absence, the acting chairperson, may administer oaths and compel attendance of witnesses. All meetings of the zoning board of appeals must be conducted in compliance with the Illinois Open Meeting Act. The zoning board of appeals must keep records of its proceedings and official actions, all of which must be open to the public in compliance with the Illinois Open Records Act.
  10. Powers and Duties: The zoning board of appeals has the powers and duties that are expressly identified in this zoning ordinance, including hearing and acting on applications for variances and appeals of administrative decisions.
