CHAPTER 1210

MU, Mixed-Use District

1210.01 INTENT.

   The MU, Mixed-Use District acts as a transition between the traditional downtown center and other commercial and residential areas and includes vertical mixed-use, such as ground-floor retail with residential units on the upper floors, multiple-family housing, live/work units, and small-scale retail, service, and office uses that are compatible with adjacent residential uses. The ground floors of buildings are primarily designed for active uses (i.e., retail, services, dining, and entertainment) to encourage pedestrian activity and a walkable community.

1210.02 PRINCIPAL PERMITTED USES.

   The following are principal permitted uses:
   • Artisan/maker space
   • Bar
   • Body art/tattoo shop
   • Community incubator kitchen
   • Financial institution (includes cash advance)
   • Hookah/cigar/vape lounge
   • Indoor recreation (private and public)
   • Medical office
   • Microbrewery/distillery/winery (when with a bar and/or restaurant)
   • Outdoor recreation (public/private)
   • Personal service establishment
   • Pet grooming
   • Printing production
   • Professional office
   • Public institution
   • Restaurant, full service
   • Restaurant/café, take-away
   • Retail sales
   • Studio (dance, art, photography, etc.)
   • Theater/entertainment venue
   • Upper-level residential dwelling unit

1210.03 ACCESSORY USES.

   The following are principal permitted accessory uses:
   • Accessory structures
   • Fence
   • Food cart/truck
   • Home occupation
   • Residential management facility
   • Satellite television dish
   • Solar energy system
   • Temporary event
   • Outdoor dining
   • Parking lot (surface)
   • Wind turbine
   • Uses customarily incidental to the principal use

1210.04 SPECIAL LAND USES.

   The following special land uses are permitted only after review and approval by the Planning Commission, in accordance with Chapter 1225: Special Land Use:
   • Assembly/banquet hall
   • Brewpub
   • Child care center
   • Funeral home
   • Gas station
   • Government facility
   • Hotel/motel
   • Laundry/dry cleaner
   • Massage establishment
   • Mental health facility
   • Multiple-family dwelling unit
   • Parking structure
   • Pawn shop
   • Senior living (assisted and independent)
   • School, secondary
   • Testing/experimental/research facility
   • Veterinary clinic

1210.05 SITE DEVELOPMENT STANDARDS.

      (1)   No rear setback is required, unless the site is adjacent to residentially zoned property, in which case, the building must have a minimum rear yard setback of twenty-feet.
   (b)   Residential units must meet the following minimum sizes:
      • EED Unit = 400 sq. ft. (only 25% of all units can be EED units)
      • 1-Bedroom Unit = 600 sq. ft.
      • 2-Bedroom Unit = 800 sq. ft.
      • 3-Bedroom Unit = 1,000 sq. ft.
   (c)   Residential units cannot be located on the first floor of buildings or within the basement.
   (d)   At the time of this Code adoption, no new religious institutions may be established in the MU District. However, existing religious institutions may be allowed to expand, provided compliance with all other Code standards.
   (e)   All multiple-family residential projects must incorporate common open/civic space and private open space (i.e., terraces, patios, and/or porches).
   (f)   All anti-theft devices must be constructed or installed on the interior of the structure. No bars, rolling gates or iron work are permitted on any exterior of the structure.
