CHAPTER 1212

B2, Regional Business District

1212.01 INTENT.

   The B2, Regional Business District provides for a wide variety of commercial uses that utilize major throughfares for access and often serve the larger community, outside of Wayne.

1212.02 PRINCIPAL PERMITTED USES.

   The following are principal permitted uses:
   • Artisan/maker space
   • Assembly/banquet hall
   • Bar
   • Body art/tattoo shop
   • Brewery
   • Community incubator kitchen
   • Data processing/computer center
   • Financial institution (includes cash advance)
   • Funeral home
   • Government facility
   • Hookah/cigar/vape lounge
   • Indoor recreation (private and public)
   • Laundry/dry cleaner
   • Medical office
   • Microbrewery/distillery/winery
   • Outdoor recreation (private and public)
   • Personal service establishment
   • Pet grooming
   • Pet kennel
   • Printing production
   • Professional office
   • Public institution
   • Restaurant, full service
   • Restaurant/café, take away
   • Retail sales
   • Secondhand store
   • Self-storage
   • Studio (dance, art, photography, etc.)
   • Testing/experimental/research facilities
   • Theater/entertainment venue
   • Vehicle repair
   • Vehicle sales
   • Vehicle wash facility
   • Veterinary clinic

1212.03 ACCESSORY USES.

   The following are principal permitted accessory uses:
   • Drive-thru
   • Fence
   • Food cart/truck
   • Outdoor dining
   • Parking lot (surface)
   • Satellite television dish
   • Solar energy system
   • Temporary event
   • Outdoor sales
   • Outdoor storage (screened)
   • Uses customarily incidental to the principal use
   • Wind turbine

1212.04 SPECIAL LAND USES.

   The following special land uses are permitted only after review and approval by the Planning Commission, in accordance with Chapter 1225:
   • Child care center
   • Essential service facility
   • Gas station
   • Hospital
   • Hotel/motel
   • Landscape nursery/greenhouse
   • Mental health facility
   • Message establishment
   • Parking structure
   • Pawn shop
   • Religious institution
   • School, secondary
   • Senior living (assisted / independent)

      (1)   No building can be closer than 200-feet from any residentially zoned property boundary.
   (b)   All anti-theft devices must be constructed or installed on the interior of the structure. No bars, rolling gates or iron work are permitted on any exterior of the structure.
   (c)   Outdoor storage is only permitted when enclosed and screened with an eight-foot-high privacy fence or masonry wall. Chain link fences, with or without slats, are not an appropriate screening mechanism.
   (d)   Amusement arcades, as defined in Chapter 840 of the Business Regulation and Taxation Code, provided that there is no more than one mechanical and electronic amusement device for each occupant eligible to use such establishment, as the occupancy load is determined by the Department of Engineering and Building and the Fire Division.
   (e)   Not more than four properly licensed mechanical and electronic amusement devices, as defined in Chapter 840 of the Business Regulation and Taxation Code, provided, however, that an establishment that has been issued a Class C Liquor License by the State Liquor Control Commission may have not more than six such devices.
   (f)   Outdoor seasonal sales by a temporary permit for a four-month period. This application includes a report by the Building Official and any other City department, detailing the current conditions and review of the prior conditions of approval.
