CHAPTER 1231

Severability, Repeal, Effective Date & Adoption

1231.01 SEVERANCE CLAUSE.

   Each portion of this Zoning Code is severable. Should any chapter, section, subsection, paragraph, subparagraph, sentence, or clause hereof be declared by a court to be unconstitutional, invalid, or be rejected by referendum or similar process, such holdings do not affect the validity of this Zoning Code as a whole or any part hereof, other than the part so declared to be unconstitutional, invalid, or rejected.

1231.02 REPEAL OF EXISTING CODES.

   (a)   Repeal. The previous City of Wayne Zoning Code and all amendments to that Code are repealed upon the effective date of this Code.
   (b)   Future Enforcement. The adoption of this Zoning Code and repeal of previous codes does not affect or prevent any pending or future prosecution of or action to abate any violation of any previous zoning code if the violation is also a violation of this Zoning Code.
   (c)   Pending Actions. The adoption of this Zoning Code does not alter, limit, void, affect, or abate any pending litigation, administrative proceeding, or appeal that existed on the effective date of this Zoning Code, order, permit, or decision that was based on the codes repealed by this section.

1231.03 ADMINISTRATIVE LIABILITY.

   No officer, agent, employee or member of the City, City Council, Planning Commission, or Zoning Board of Appeals are personally liable for any damage that may accrue to any person as the result of any act, decision, or other consequence or occurrence arising out of the discharge of duties and responsibilities pursuant to this Zoning Code.

1231.04 EFFECTIVE DATE.

   The Wayne Zoning Code, which specifically includes the Zoning Map, was approved, and adopted by the Wayne City Council, Wayne County, Michigan, on February 7, 2023 shall take effect twenty-one days after the date of adoption.
