No building may be erected, nor any existing building be altered, enlarged, or rebuilt, nor any open space surrounding any building be encroached upon or reduced in any manner, except in conformity with the regulations for the district in which the building or use is located, per Section 1217.02: Schedule of Dimensional Regulations.
(Ord. 2023-01. Passed 2-7-23.)

1217.03 FOOTNOTES TO THE SCHEDULE OF REGULATIONS.

   (a)   Residential units must meet the following minimum sizes:
      • EED Unit = 400 sq. ft. (only 25% of all units can be EED units)
      • 1-Bedroom Unit = 600 sq. ft.
      • 2-Bedroom Unit = 800 sq. ft.
      • 3-Bedroom Unit = 1,000 sq. ft.
   (b)   All principal buildings must be separated at least ten-feet from one another.
   (c)   For a one-family dwelling unit on a single lot, the development standards of Section 1203.05 apply.
   (d)   For a two-family dwelling unit on a single lot, the development standards of Section 1204.05 apply.
   (e)   No rear setback is required, unless the site is adjacent to residentially zoned property, in which case, the building must have a minimum rear yard setback of twenty-feet.
   (f)   No building may be closer than twenty-feet from any residentially zoned property boundary.
   (g)   All industrial uses must have a minimum lot area of 10,000 square feet.
   (h)   The building height may not be greater than the horizontal distance to the nearest residential property boundary, or fifty-feet, whichever is less.
   (i)   When the front yard is located on Michigan Avenue, Van Born, Hannan, Cogswell, Howe, Venoy, Annapolis, and Hubbard, a front yard setback of fifty-feet is required. Fifty percent of this setback may be used for parking and circulation.
   (j)   Corner lots must have a minimum setback from the side street equal to the minimum required front setback of the district in which it is located. However, this does not reduce the buildable width of any lot of record to less than twenty-five-feet, and the least required side yard for the district shall be along the interior lot line. A corner lot that has a corner lot abutting or across an alley, on which an existing principal building has a setback from the side street less than required for the district, the side street setback may be reduced, but not to less than fifteen-feet.
   (k)   For existing lots of record less than forty-five-feet wide, the minimum side yard is five-feet (one) and thirteen-feet (total).
   (l)   All principal buildings must be separated by at least twenty-feet.
(Ord. 2023-01. Passed 2-7-23.)

1217.04 EXCEPTIONS TO THE DIMENSIONAL STANDARDS.

   (a)   Height Exceptions. The height limitations of this Zoning Code do not apply to chimneys, religious institution spires, cupolas, domes, water towers, smokestacks, ventilators, skylights, elevators, conveyors, cooling towers, flagpoles, public monuments, or power transmission towers, masts, and other similar mechanical appurtenances pertaining to and necessary to the permitted uses of the district. The Planning Commission may specify a height limit for any such structure when special land use approval is required, and such height limit is reasonably necessary for public safety or to otherwise to comply with the standards set forth in this Zoning Code.
   (b)   Parapet Wall Extension. The provisions of this Zoning Code do not prevent the erection, above the maximum building height limit, for a parapet wall or cornice for screening purposes (without windows), extending above such height limit not more than five-feet.
   (c)   New Lots. Newly created lots must be rectangular, with lot lines meeting at right angles, unless that shape is rendered impossible by natural features, legal restrictions, or other factors out of the control of the applicant for a lot split.
