ARTICLE 10

- R-4 ZONE MULTIFAMILY RESIDENTIAL

Sec. 93-10-1.- Intent.

Because of the location within the comprehensive land development plan of the city of certain areas of land, both developed and undeveloped, with particular characteristics such as high density dwelling units, unusual topographic features, proximity to commercial developments or proximity to major streets, and because of a continued demand for such dwelling accommodations which are well-designed, pleasant places to live, the R-4 zone is established in order to:

(1)

Protect the present development pattern.

(2)

Provide for the orderly development and redevelopment of such land according to its best usage by providing adequate minimum zoning standards for such usage.

(3)

Protect and promote a suitable environment for family life and encourage the discontinuance of existing incompatible uses.

Sec. 93-10-2. - Permitted uses.

(a)

The following uses are permitted in any R-4 zone, subject to the general requirements of the zone:

(1)

Single-family detached dwellings.

(2)

Two-family dwellings.

(3)

Group homes, subject to the restrictions in section 93-2-19.

(4)

Customary home occupations, as defined in section 93-1-2.

(5)

Customary accessory uses and buildings.

(6)

Playgrounds, parks and buildings operated on a noncommercial basis for purposes of recreation only.

(b)

The following uses are permitted in any R-4 zone subject to the general requirements of the zone and the site plan review requirements of section 93-2-16; provided that any unit for occupancy shall have a total floor area of not less than 480 square feet for an efficiency or one bedroom unit, a total floor area of not less than 730 square feet for a two bedroom unit and an additional 150 square feet of floor area for each additional bedroom.

(1)

Single-family attached developments, including single-family attached patio developments, in structures with not more than four attached dwellings.

(2)

Multifamily dwellings, in buildings containing no more than four dwelling units and having a minimum lot area of 7,200 square feet per dwelling unit, and provided that the minimum total lot area is 30,000 square feet.

(3)

Multifamily dwelling developments having a minimum lot area of 3,000 square feet per dwelling unit, and provided that the minimum total lot area for any such development is five acres.

Sec. 93-10-3. - Nonpermitted uses.

The following uses, while permitted in other areas within the city, are not permitted in the R-4 zone:

(1)

Adult daycare facilities.

(2)

Reserved.

(3)

Nursing homes.

(4)

Personal care homes.
