ARTICLE 13

- C-1 ZONE RETAIL COMMERCIAL

Sec. 93-13-1.- Intent.

By virtue of its location within the comprehensive land development plan for the city, the C-1 zone is established in order to:

(1)

Provide and protect sufficient land for those retail goods and services appropriate for high-density development in the vicinity of mass transit stations.

(2)

Provide transit patrons the goods and services they need.

(3)

Protect these land uses from detrimental effects of land uses which, because of the traffic congestion, noise, odor and glare they tend to create, might hinder the growth the development around transit facilities, and reduce the access to and desirability of riding the mass transit.

(4)

Exclude uses which might have a detrimental effect on adjoining districts and developments, including residential districts.

(5)

Stimulate the orderly arrangement, growth and development of retail and office facilities.

Sec. 93-13-2. - General use criteria.

The uses permitted in any C-1 zone shall be limited to professional and business offices, retail sales of new merchandise, personal services and other uses as specifically enumerated below. All such uses shall be conducted wholly within a completely enclosed building.

Sec. 93-13-3. - Permitted uses.

The following uses are permitted within any C-1 zone:

(1)

Adult daycare facilities.

(2)

Apparel shops.

(3)

Art studios.

(4)

Bakery shops.

(5)

Banks and other financial institutions, including loan and finance companies.

(6)

Barbershops and beauty shops.

(7)

Book, cards and stationery stores.

(8)

Business offices and agencies.

(9)

Clubs and lodges.

(10)

Churches and other places of worship.

(11)

Customary accessory buildings and uses.

(12)

Dance studios.

(13)

Department and variety stores.

(14)

Drugstores, pharmacies and soda shops.

(15)

Florist shops.

(16)

Medical clinic, medical or dental laboratory, medical or dental office, surgical center.

(17)

Hobby shops.

(18)

Jewelers and jewelry stores.

(19)

Veterinarians, animal hospitals and kennels.

(20)

Minor storage, repackaging and servicing of goods and small nonmotorized equipment, provided such use does not violate the intent provisions of this article. In addition, incidental activities associated with this use such as sales, loading, bookkeeping and administration shall also be permitted.

Office supply stores.

(22)

Off-street commercial automobile parking and storage only in those cases where such specific uses and buildings were in existence on lots of record at the time of adoption of this chapter.

Opticians and optical stores.

Photography stores.

Professional offices.

Public, private and parochial schools operated for the purpose of instructing in elementary and high school general education subjects. In addition, other schools are allowed subject to a finding by the planning commission that the proposed method of establishment and operation would not adversely impact the use and enjoyment of surrounding properties.

Restaurants or carry-out restaurants but not including drive-through/drive-in restaurants. Such restaurants shall be allowed to operate no more than six billiard tables upon the premises. Drive-through or drive-in restaurants may be allowed through special permit. The desired configuration for a drive-through or drive-in restaurant is not a stand-alone building in this district but rather part of a larger development.

Sec. 93-13-4. - Nonpermitted uses.

The following uses are not permitted in any C-1 zone:

(1)

Group homes.

(2)

Reserved.

(3)

Reserved.

Sec. 93-13-5. - Special uses.

The following uses require a special use permit, in accordance with section 93-3.2-5 and 93-3.2-6, in any C-1 zone:

(1)

Nursing home.

(2)

Personal care home, subject to the restrictions in section 93-2-20.
