- R-I ZONE RESIDENTIAL INFILL OVERLAY
The zone is created to encourage infill of additional single-family housing units in established single-family residential areas where such infill is deemed beneficial to the city and to residents. It is applied to or overlayed on existing zoning districts and supersedes the underlying zoning regulations only in specific subject areas. The R-I zone is specifically established to:
(1)
Increase residential density to maximum use of existing public services and facilities.
(2)
Expand the tax base.
(3)
Provide quality residential infill which is in harmony with adjacent residential uses.
(4)
Ensure privacy for existing residential uses as well as for new infill through use of proper sitting of new residential structures, landscaping and screening; control of lighting to exclude direct, intense or glaring light; and architectural design which is harmonious with neighboring residences.
(5)
Provide adequate standards and procedures for increasing residential density in single-family residential uses.

Only the following uses may be developed under provisions of the R-1 overlay zone:
(1)
Single-family detached residential.
(2)
Single-family attached residential.
(3)
Single-family attached (patio) residential.
(4)
Group homes, subject to the restrictions in section 93-2-19.

(a)
All uses permitted by the existing underlying zoning are permitted on the R-I overlay zone. In addition, the residential uses listed above are permitted subject to submission by the applicant to the building official, for review and approval by the planning commission, of a written application specifying the proposed use and containing a plan drawing, information and reports as may be reasonably required to determine whether or not the proposed use and its proposed method of establishment and operation would comply with the intent provisions of the R-I overlay zone.
(b)
The planning commission will hold a public hearing prior to issuing a building permit for any proposed development which is subject to the provisions of the R-I zone.
(c)
Upon a finding by the planning commission that the proposed use and its proposed method of establishment and operation would comply with the intent provisions of the R-I overlay zone, a building permit for such use shall be issued. In the absence of such findings by the planning commission, a building permit for the proposed new use shall not be issued.

The following uses, while permitted in other areas within the city, are not permitted in the R-1 zone:

Adult daycare facilities.
(2)
Reserved.
(3)
Nursing homes.
(4)
