Establishing Overlay Zoning Districts

1130.01 SIGNIFICANCE.

   Overlay zoning districts address special siting, use and compatibility issues which require unique development regulations in addition to those of the underlying zoning districts. Whenever regulations in an overlay zoning district impose greater standards than those required by the base zoning district, the more restrictive standards apply. The zoning code would authorize the establishment of zoning overlay districts, however separate ordinances are required to designate each district. (Ord. 28-2017. Passed 10-2-17.)

1130.02 DESIGNATION CRITERIA.

   The specific purposes of the proposed overlay district must be identified and contrasted to the existing base zoning requirements, to delineate clearly the special requirements of the overlay district from the base requirements. Development or redevelopment standards must be delineated and uniformly applied. (Ord. 28-2017. Passed 10-2-17.)

1130.03 APPLICATION.

   The zoning designations of properties located within an overlay district shall consist of the regular base zone classifications, with the overlay district classification added as a suffix. As an example, if a residential parcel is zoned “R-1" and it also is located within a Historic Monument (HM) overlay district, it would be classified as “R-1" (HM). Therein, the parcel would be bound by the greater standards of the special overlay district.

1130.04 THE DESCRIPTION AND PROCESS.

   (a)   The City shall undertake land use, surveys or other background studies necessary to designate an overlay district. The boundaries must be clearly identified. All property owners within the proposed overlay district and those in immediately adjacent areas shall be afforded the opportunity to comment and otherwise pass along their views on the proposed regulations.
   (b)   The proposed new ordinance is prepared as a draft and introduced to City Council for initial review. It would then be referred to the Planning Commission for review, comment and approval, before being referred back to Council for their final review and action to incorporate into the Codified Ordinances.
