CHAPTER 1166

R-3-C Condominium District

1166.01 PURPOSE.

   The purpose of the condominium district is to provide an area for condominiums developed as outlined and described in the Ohio R.C. Chapter 5311.

1166.02 PERMITTED USES.

   (a)   Condominiums in accordance with Ohio R.C. Chapter 5311.
(Ord. 13-2017. Passed 4-17-17.)

1166.03 CONDITIONAL USES.

   (a)   Small retail which are incidental accessory uses to the main project.

1166.04 PROHIBITED USES.

   (a)   Communication Towers.
   (b)   Single-family dwellings and multiple-family dwellings (i.e., apartments).

1166.05 ACCESSORY USES.

   (a)   Any accessory use or structure permitted and as regulated in the R02 District, and any accessory use or structure customarily incident or accessory to a principal or conditional permitted use in the R-3 District. (Ord. 35-2003. Passed 7-21-03.)

1166.06 HEIGHT.

   No principal building or structure shall exceed four (4) stores without the approval of the City of Heath Planning Commission and Board of Zoning Appeals.

1166.07 AREA; FRONTAGE; YARDS.

Minimum Distance Between Buildings
=10 ft.

1166.08 GREEN SPACE REQUIRED.

   Project sites shall contain no less, than 20% green space. The green space shall be properly landscaped as per City of Heath and Landscape Ordinance Chapter 1136.

1166.09 PARKING.

   There shall be 2 ½ spaces per unit. Garages shall not be counted as parking spaces.
