CHAPTER 1175

M-1 Light Manufacturing District

1175.01 PERMITTED USES.

   (a)   Manufacturing. Except for uses and processes in Section 1175.05 prohibited herein, the manufacturing, compounding, processing, packaging and assembly of products, such as:
      (1)   Food products. Bakery goods, candy, light meat packing, sausage making, canning, milk products and the like, excluding fish products, slaughterhouses, sauerkraut, vinegar, yeast and rendering and refining of fats or oils.
      (2)   Pharmaceuticals. General pharmaceutical products, cosmetics, toiletries.
      (3)   Products from the following previously prepared materials. Bone, canvas, cellophane, cloth, cork, feather, fiber, fur, glass, hair, horn, leather, paper, plastics, precious or semi-precious metals or stones, sheet metal (except where presses over twenty tons rated capacity are employed), shell, textiles, tobacco, wax, wood (except where saw and planning mills are employed), yarns.
      (4)   Pottery and figurines. Using previously pulverized clay, and kilns fired only with gas or electricity.
      (5)   Novelties. Including musical instruments, toys, rubber or metal stamps and other small rubber products.
      (6)   Appliances, etc. Electrical and electric appliances, instruments and devices, television sets, radios, phonographs, electric and neon signs, billboards and other commercial advertising structures, refrigerators, stoves.
      (7)   Light sheet metal products. Including heating and ventilating equipment, cornices, eaves and the like.
      (8)   Laboratories. Experimental, film or testing laboratories, provided no operation shall be conducted or equipment used which would create hazards, noxious or offensive conditions.
      (9)   Industrial product sales. Any business selling, servicing or renting mobile or non-mobile equipment or components used in industrial or commercial applications.
      (10)   Assembly and packing operations. Assembly of sub-components into finished products or the packing of finished products for shipment to retailers or wholesalers.
      (11)   Warehousing distributors and freight services. Any wholesale business, storage or warehousing, freight service centers, commercial greenhouses.
      (12)   General office activities. General business offices, employment services, billing and payroll operations.
      (13)   General institutions. Banks and credit unions.
      (14)   Bottling works and bakeries. Bakery goods, candy, canning, milk and dairy products, excluding fish products.
      (15)   Trade schools. Building trades, special needs or educational cosmetology.
      (16)   Contractor’s yards. Sale or distributions of building products.
      (17)   Trades, other businesses or uses as approved by the BZBA.

1175.02 SPECIAL USES.

   Provided no part of a building occupied by such uses shall have any opening other than stationary windows or required fire exits, within 200 feet of any R District.
   (a)   Welding Shops. Or other metal working shops or machine shop, including punch presses over twenty tons rated capacity, drop hammers and other noise-producing, machine-operated tools.
   (b)   Foundry. Casting lightweight nonferrous metals, or electric foundry not causing noxious fumes or odors.
   (c)   Rag Cleaning. Bag, carpet and rag cleaning, provided necessary equipment is installed and operated for the effective precipitation or recovery of dust.
   (d)   Ice manufacturing and cold storage plants, creamery and bottling plants.
   (e)   The following uses when located not less than 200 feet from any R District:
      (1)   Inflammable liquids. Underground storage only, not to exceed 25,000 gallons per storage unit.
      (2)   Building materials sales yards. Including concrete mixing, lumberyards including millwork, open yards for storage and sale of feed and/or fuel.

1175.03 OTHER USES.

   Any other use that is determined by the Board to be of the same general character as the above permitted uses, but not including any use which is prohibited in the M-1 District under Section 1175.06 or which is first permitted in the M-2 District.

1175.04 ACCESSORY USES.

   Accessory uses and structures permitted and as regulated in the B-2 District, except as hereinafter modified and such other uses and structures customarily accessory and incidental to any of the foregoing principal permitted uses, except for uses prohibited in an M-1 District.

1175.05 REQUIRED CONDITIONS.

   Same as specified in the B-3 District.
   (a)   Night Operations. No building customarily used for night operation such as a bakery or milk bottling and distribution station, shall have any opening, other than stationary windows or required fire exits, within 200 feet of any R District, and any space used for loading or unloading commercial vehicles in connection with such an operation shall not be within 150 feet of any R District.
   (b)   Manufacturing Equipment and Manufacturing Operations. All materials, equipment, and manufacturing operations must be stored and conducted wholly within a completely enclosed building on M-1 zoned properties that are adjacent to a residentially zoned property. No outdoor storage or operations are permitted. Materials and equipment to which this section applies are considered to be those not already contemplated under Section 1136.08 of the City of Heath Codified Ordinances.
   (c)   Underground Storage of Materials and Liquids. The storage of any liquids or materials, whether used for manufacturing purposes or stored onsite, shall be in accordance with applicable local, state, and federal environmental laws and regulations. In instances where local, state, and federal environmental laws and regulations do not require adequate safeguards to prevent soil, water, and air contamination, the storage of liquids and materials must be within a wholly enclosed structure with adequate safeguards in place to eliminate the possibility of soil, water, and air contamination.

1175.06 PROHIBITED USES.

   (a)   General. Any use which is first permitted or is prohibited in the M-2 District.
   (b)   Dwellings. Dwellings and residences of any kind, including motels and trailer parks; also schools, hospitals, clinics and other institutions for human care, except where they are incidental to a permitted principal use; provided, however, that any of the aforesaid uses legally existing in the M-1 District at the time of the adoption of this Zoning Ordinance, or any amendment thereto, shall not be classified as a noncommerical use as defined in Section 1123.02(71).
   (c)   Offensive Uses. No use shall be permitted or authorized to be established or maintained, which, when conducted under adequate conditions and safeguards in compliance with the provisions of this Zoning Ordinance and any additional conditions or requirements prescribed by the Board, is or may become hazardous, noxious or offensive due to emission of odor, dust, smoke, cinders, gas fumes, noise, vibration, beat frequency, refuse matter or water-carried waste, as further specified in Chapter 1181. 1175.07 HEIGHT.

   If located adjacent to any residentially zoned property, no structure shall exceed forty (40) feet in height. In all other cases, no structure shall exceed fifty (50) feet in height.

1175.09 SCREENING BETWEEN MANUFACTURING AND RESIDENTIAL

   (a)   Notwithstanding those requirements outlined in Section 1136.07 of the City of Heath Landscape Ordinance, newly established manufacturing uses shall be required to provide one of the following options in order to adequately screen the industrial area from the residential area:
Option 1: Requires a 6-foot height wall or fence to be located within ten (10) feet of the residential property line, ran parallel to and along the entire length of the residential property line, constructed of brick or natural cut stone on both sides if the wall option is selected or vinyl if a fence option is selected, free of all advertising, and be maintenance free as approved by the City of Heath. In addition, three (3) staggered rows of six (6) foot height minimum evergreen trees at twenty (20) foot maximum spacing and two, two (2) inch caliper minimum small class trees per each 100 lineal feet of property line are to be planted behind the six (6) foot high wall or fence.
Option 2: Requires a continuous eight (8) foot height minimum earthen mound to be ran parallel to and along the entire length of the residential property line. In addition, two (2) staggered rows of six (6) foot height minimum evergreen trees at twenty (20) foot maximum spacing are to be planted so each row is located on either side of and offset ten (10) feet from the centerline at the top of the mound and two, two (2) inch caliper minimum small class trees per each 100 lineal feet of property line is to be planted between the earthen mound and the residential property line.

1175.10 OFF-STREET PARKING AND LOADING.

   There shall be provided in the M-1 District adequate off-street parking and loading in accordance with the schedule in Chapter 1183.
