CHAPTER 1155

A-1 Conservation District

1155.01 PURPOSE.

   The purpose of the A-1 Conservation District is to protect the public health and to reduce the financial burdens imposed on the community, its governmental units and its individuals which may result from improper use of land having excessively high water tables or which are subject to frequent and periodic floods and overflows.

1155.02 PERMITTED USES.

   (a)   Any customary agricultural use; forestry.
   (b)   Any public or private noncommercial recreation facility, including fishing lakes, golf courses, parks and other similar uses.
   (c)   Water conservation works, including water supply works, flood control and watershed protection, etc.
   (d)   Accessory uses and buildings.

1155.03 CONDITIONAL USES.

   The following uses are permitted as conditional uses when authorized by the Board of Zoning Appeals after a public hearing and recommendation by the Planning Commission. Such conditional uses shall be subject to the following requirements and any other requirements the Board feels necessary to further the purpose of the Conservation District as stated in Section 1155.01:
   (a)   Commercial recreation; such as commercial fishing lakes, rifle ranges and gun clubs, providing they are not located closer than 200 feet distant from any R District.
   (b)   Commercial mining; in accordance with the provisions of Chapter 1199.
   (c)   Reclamation of lands subject to flooding, providing that no filling, draining, construction of levees or other improvements intended to reduce the danger of flood or erosion shall be authorized by the Board, unless the Board finds that such reclamation work is in concert with the objectives of the Land Use Plan, and that any such work is done under the supervision of a competent civil engineer.
   (d)   Disposal of garbage and refuse, including sanitary fills, and sewerage disposal by the City or its authorized agents, subject to Health Department approval.

   (e)   Essential services as defined herein.
   (f)   Essential services, provided that static transformer stations, booster stations, transmitters, pump houses and utility stations shall be landscaped and screened so as to be in harmony with the general appearance of the area and not objectionable as to noise, odor, vibration and other disturbances.

1155.04 REQUIRED CONDITIONS.

   Buildings or structures authorized in the Conservation District shall not obstruct natural drainage courses and floodways. Equipment, materials and wastes stored in areas subject to flooding shall have a specific gravity substantially heavier than water, or shall be otherwise secured against floating away and shall not become a source of water pollution or contamination.

1155.05 LOT AREA; WIDTH.

   None required, except as may be specified by the Board; provided that no structure shall be located closer than thirty-five feet to any existing or proposed public right of way, and not closer than fifteen feet to any side or rear lot line.

1155.06 HEIGHT.

   No structure shall exceed thirty-five feet in height.
