§ 35-7.5

Walls and Fences.

a. 
Fences/fill in any combination shall be measured from the grade of the adjacent property so that the neighbor is not looking at a visual obstruction higher than four feet or six feet (depending on the location) in any situation.
b. 
No fence/wall combination shall be erected, maintained or equipped with or having barbed wire, spikes, broken glass, sharp or dangerous devices or any electrical charge sufficient to cause a shock, except that business and public properties within the Borough may be enclosed with fences having barbed wire barriers, provided that all such barbed wire is kept at least six feet above ground level.
c. 
The finished side of any fence shall face the outside of the property it encloses.
d. 
No fence/wall combination shall be erected, maintained or planted on any lot which unreasonably obstructs or interferes with traffic visibility on a curve or at any street intersection.
e. 
No fence/wall combination shall be constructed unless the owner or the person in possession of the lands on which the fence is to be constructed shall first obtain a zoning permit from the Zoning Officer prior to the commencement of construction. A zoning permit shall also be required for the removal of a wall. An application for the permit must be submitted in writing to the Zoning Officer, together with a plan, and must be accompanied by a fee in the amount as stated in Chapter 16, Fees.
f. 
No fence/wall combination shall be erected, maintained in the front yard on property located in the R-4 Beachfront One-Family Residential Zone. A fence not more than six feet in height may be located in the side and rear yards, provided the fence does not extend beyond the front of the building line of the adjacent properties. A solid fence is prohibited.
g. 
A zoning permit shall be required if six inches or greater of soil or fill is removed or added to install a fence/wall to ensure compliance with stormwater management regulations.
