§ 35-11.11

Corner Lot Sight Lines.

a. 
Sight Triangle. The sight triangle shall be determined by the intersection of two street lines and a line connecting points along each street located at a distance of 25 feet from their point of intersection. This distance may be modified upon the recommendation of the Borough Engineer.
b. 
Height Limitations Within the Sight Triangle. Within the defined sight triangle, any fence or similar structure shall not exceed a height of 30 inches (2.5 feet) above the adjacent grade level to ensure unobstructed sight lines.
c. 
Fencing Outside the Sight Triangle. Fences erected outside the designated sight triangle but within the property's front yard setback area shall not exceed four feet in height, unless otherwise permitted pursuant to additional zoning district regulations applicable to the property.
d. 
Transparency Requirements. Any fence situated within 10 feet of the boundary of a sight triangle shall be constructed with at least 50% open area (e.g., using designs such as picket or chain-link fences) to maintain adequate visibility around the intersection.
e. 
Exceptions and Variances. Any property owner who wishes to construct or maintain a fence that does not conform to the specifications set forth in this section may apply for a variance with the Borough's Planning Board. The application shall include:
1. 
A detailed site plan illustrating the proposed fence placement and dimensions.
2. 
Certification by a licensed engineer that the proposed fence will not materially reduce visibility at the affected intersection.
f. 
Enforcement and Penalties. The Zoning Officer shall enforce the provisions of this section. Any fence that is constructed or maintained in violation of the requirements herein shall be subject to a notice of violation. Failure to comply with this notice within the stipulated timeframe shall result in penalties as provided in Chapter 1, Section 1-5.1, with each day of noncompliance deemed a separate offense. The Borough shall have the right to require removal, modification, or replacement of any noncompliant fence at the expense of the property owner.
